Military Tr. , 201D Palm Beach Gardens, FL 33410 Dear Mr. Strassler: Subject: Community Appearance Board review of your application for a TV satellite dish for the K—Mart store at 500 U. S. Hwy. One. This letter is to confirm the action of the Village of Tequesta Community Appearance Board at the October 20, 1988 meeting approving your application for the above referenced subject as submitted. This approval has no bearing or relationship to any other approvals or permits which might be required. The Village of Tequesta building department should be contacted in this regard. Bradford, Village Manager Building Official property owners, to provide for traffic safety and the elimination of fire hazards, and to achieve other appropriate community objectives inherent in the special exception application. (0) Satellite Television Antenna Systems and Structures (1) Satellite television antenna systems may be permitted in any zoning district upon site plan review and approval by the village council and the issuance of a building permit by the building official. (2) Satellite television systems shall be considered as accessory struc- tures and shall be subject to the applicable site plan review require- ments and regulations of this zoning ordinance. (3) Unless specific approval is granted by the village council, satellite television antenna systems shall be ground mounted, and shall not exceed twelve (12) feet in diameter or width, and located in such area as to be screened or buffered from view from adjacent properties and/or rights-of-way and shall be placed in the rear yard. (4) There shall not be more than one (1) satellite television antenna system on any platted lot or parcel. However, the joint use of such a system as a community antenna system by two (2) or more adjacent or adjoining buildings, associations, lots, or parcels may be permitted by the village council on a noncommercial, not-for-profit basis. SECTION XI. UNITY OF TITLE DECLARATION (A) Where it reasonably appears that a certain proposed use of property, as set forth in an application for a building permit, may subsequently be changed by the sale or transfer of a portion of said property and that such change would negate the application of zoning requirements relating to the proposed use, the village shall require the property owner(s) to execute a unity of title declara- tion as a condition precedent to the approval of the site plan, or the issuance of a building permit for the proposed use. The unity of title declaration shall apply to all the property necessary for the proposed use, and shall declare that no portion of said property shall be sold or transferred by the owner(s) or suc- cessors in interest apart from the whole. (B) In the event of a sale or transfer in contravention of a unity of title declaration, no building permit will be issued for any portion of the property contained in the unity of title declaration. Declaration shall remain in effect until a release of unity of title declaration is executed by the village. (C) The unity of title declaration shall be filed at the expense of the owner(s) in the public records of Palm Beach County, Florida. Proof of such filing shall precede the issuance of a building permit. • - 101 -
