AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE
OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, PROVIDING
FOR AMENDMENTS TO ARTICLE II OF CHAPTER 11 OF THE
CODE OF ORDINANCES OF THE VILLAGE AT SECTIONS 11-19,
11-22, 11-23, 11-24, 11-25, 11-26 AND 11-27 WITH ALL
OTHER SECTIONS UNCHANGED, RELATING TO THE
OCCUPATIONAL LICENSES REQUIRED AND ISSUED BY THE
VILLAGE AND RELATING TO THE FEES FOR SUCH LICENSES;
PROVIDING FOR SEVERABILITY; PROVIDING FOR
CODIFICATION; PROVIDING AN EFFECTIVE DATE.
Section 1. Chapter 11, Article II of the Code of
Ordinances of the Village of Tequesta is hereby amended as
follows:
(a) Section 11-19 is amended to read as follows:
"Section 11-19. Supporting affidavits required.
Whenever the amount of the license applied for
depends upon the amount of stock in trade carried
by the applicant or the number of rooms in a
hotel or rooming house, or the number of
employees, or on any other facts not within the
personal knowledge of the building official, no
license shall be issued until the applicant
therefore has made and filed with the building
official an affidavit, duly authenticated,
setting forth the amount of his or her stock in
trade, number of rooms in his or her hotel or
rooming house, or other facts on which the amount
of such license depends. "
(b) Section 11-22 is amended to read as follows:
"Section 11-22. Master-servant relationships.
Where the principal, master or employee has
complied with the provisions of this article, it
shall be unnecessary for his or her agent,
servant or employee to comply herewith, unless
otherwise expressly provided for herein; however,
in the event such principal, master or employer
shall not have complied with this article, each
of his or her agents, servants or employees shall
be subject to prosecution, and upon conviction,
to fine or imprisonment to the same extent as his
or her principal, master or employer. "
(c) Section 11-23 is amended to read as follows:
"Section 11-23. Suspension; revocation;
cancellation.
"Any license hereafter issued by the Village may
be temporarily suspended or absolutely revoked or
cancelled by a majority vote of the Council, when
such Council shall have ascertained and
determined, in the exercise of its sound
discretion, that such action will promote the
public peace, health, safety, welfare, harmony or
good order of the neighborhood in which the
licensee 's place of business is located;
provided, however, that in the case of revocation
and cancellation of such license, the Village

shall refund to such licensee the pro rata
unearned or unused portion of his or her
license, provided, further, that no refund shall
be made where the license is temporarily
.3' suspended. "
(d) Section 11-24 is amended to read as follows:
"Section 11-24. Exceptions.
Disabled United States Veterans, handicapped
persons, widows with minor dependents and
persons sixty-five ( 65) years of age, or older,
shall be allowed the same exceptions as such
persons are now or shall hereafter be entitled to
by law in connection with state and county
licenses. "
(e) Section 11-25 is amended to read as follows:
"Section 11-25. Unlawful to engage in trade or
business without license or with license on false
statements; dates fees payable.
"It shall be unlawful for any person to engage in
any trade, business, profession, or occupation
within the village without a license or upon a
license issued upon false statements made by any
person, or in his or her behalf. All licenses
shall be sold by the village beginning September
1 of each year and shall be due and payable on
October 1 of each , year and shall expire on
September 30 of the succeeding year. Licenses
not renewed by October 1 shall be considered
delinquent and shall be subject to a delinquency
penalty of ten percent (10%) for the month of
October plus an additional five percent (5%)
penalty for each month of the delinquency
thereafter until paid; provided, however, that
the total delinquency penalty shall not exceed
twenty-five percent (25%) of the occupational
license fee for the delinquent establishment.
Any person engaging in or managing any business,
occupation or profession without first obtaining
a local occupacional license if required
hereunder shall be subject to a penalty of twenty-
five percent (25%) of the license determined to
be due in addition to any other penalty provided
by law or this Code. "
( f) Section 11-26 is amended to read as follows:
"Section 11-26. Categories tax levied upon;
evidence of doing business.
The occupational license taxes set forth in this
article shall be levied only on the following:
(a) Any person who maintains a permanent
business location or branch office within
said municipality for the privilege of
engaging in or managing any business within
its jurisdiction;
(b) Any person who maintains a permanent
profession or occupation within said
municipality for the privilege of engaging

in or managing any profession or occupation
within its jurisdiction;

(c) Any person who does not qualify under the
provisions of (a) or (b) above and who
transacts any business or engages in any
occupation or profession in interstate
commerce where such license tax is not
prohibited by Section 8 of Article 1 of
the United States Constitution.
The fact that any person represents himself or
herself as being engaged in any business,
occupation or profession for which a license is
required for the transaction of business or the
practice of such profession, shall be evidence of
the liability of such person to pay a license
tax, regardless of whether such person actually
transacted any business or practices a
profession. The burden shall be on the person
representing himself or herself as being engaged
in any business, occupation or profession within
the Village for which an occupational license is
required, to rebut the presumption that he or
she is required to have an occupational license
issued by the Village. Displaying a sign or
advertisement indicating the conduct of a
business or profession within the Village in the
classified section of the telephone directory or
city directory or other media shall be evidence
that such person is holding himself or herself
out to the public as being engaged in a business
or profession requiring a license under this
article.
For the purpose of this section, any person shall
be deemed to be in the business or engaging in
non profit enterprise, and thus be subject to the
requirements of this article, when he or she does
one act of:
(a) Selling any goods or service.
(b) Soliciting business or offering goods or
services for sale or for hire.
The agents or other representatives of non
residents who are doing business in this Village
shall be personally responsible for the
compliance of their principals and of the
business they represent with this article.
Vehicles used by any person licensed under state
law for the sale and delivery of tangible
personal property at either wholesale or retail
from his or her place of business at which a
license is paid shall not be construed to be
separate places of business and no license may be
levied on such vehicles or the operators thereof
or the operators thereof as salespersons or
otherwise, anything else in this article
notwithstanding. "
(g) Section 11-27 is amended to read as follows:

"'--' "Section 11-27. Enumeration of license taxes.
The tax provided for in this section for
architects, auctioneers, auditors or accountants,
dentists, draftsmen, civil engineers, lawyers,
osteopaths, chiropractors, chiropodists,
physicians, or surgeons, real estate salespeople,
or other similar professions, shall be construed
to mean that each individual shall pay the tax
herein provided, whether practicing solely or in
partnership, or employed by another.
The amount which shall be paid by the several
firms, persons or associations engaging in or
• managing businesses, professions or occupations
for which a license is required are hereby fixed
as follows:

Note:
Bible canvassing and soliciting, house to
house, restricted solely to Holy Bibles,
shall be exempt from occupational licenses.
SUBSCRIPTION AGENTS: (AG)
Temporarily engaged in taking orders for
magazines, encyclopedias, books, etc. , to
be delivered at later date.
Each person, ten days or less 40.00
Each person, more than ten days,
but not over 30 days 120.00
Section 2. All other sections of Article II, Chapter 11
are unchanged.
Section 3. If any provision of this Ordinance or
application thereof is held invalid, such invalidity shall
not affect the other provisions or applications of this
Ordinance which can be given effect without the invalid
provisions or applications and to this end, the provisions
of this Ordinance are hereby declared severable.
Section 4. All Ordinances or parts of Ordinances in
conflict herewith are hereby repealed.
Section 5. This Ordinance shall be codified and made a
part of the Official Code of Ordinances of the Village of
Tequesta, Florida.
Section 6. This Ordinance shall take effect immediately
upon its passage and approval, as provided by law.
THE FOREGOING ORDINANCE was offered by Councilmember
