Bradford, Village Manager DATE: August 5, 1988 SUBJECT: Proposed Ordinance No. 373 The attached Ordinance has been prepared for your consideration to rectify a deposit discrepancy being experienced by the Water Department. Currently, all accounts regardless of meter size, pay a deposit equal to three times the minimum monthly service charge. The vast majority of accounts require a 5/8-inch meter. The monthly service charge for 5/8-inch meters is $8.30. Therefore, the security deposit for such services is $24.90 ($8.30 x 3) . As you know, many accounts today utilize irrigation systems upon their property. This causes the average monthly bill for such accounts to greatly exceed the $24.90 security deposit. This situation often places the Village in the precarious position of having to issue a final bill upon close-out of the account because the security deposit is inadequate to cover the average monthly bill. Often times the homeowner has relocated to another community requiring the Village to rely upon the customer' s good faith to pay the final bill. The final bill is the amount owed after the inadequate security deposit previously paid has been deducted from their account. This deposit discrepancy also affects the Village's position in dealing with delinquent accounts. A person is more reluctant to be delinquent if required to put up a new deposit of $50.00 each time service is restored. Therefore, we are requesting Village Council 's consideration to change the security deposit amount for 5/8-inch meter services to $50.00. TGB/mk Attachment cc: Thomas C. Hall, Water System Manager, w/attachment ORDINANCE NO. 373 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AMENDING CHAPTER 18 OF THE CODE OF ORDINANCES OF THE VILLAGE OF TEQUESTA AT SECTION 18-3 RELATING TO RATES AND CHARGES OF THE VILLAGE WATER WORKS SYSTEM BY PROVIDING AT SUB-PARAGRAPH (H) THEREOF THAT THERE SHALL BE A SECURITY DEPOSIT OF $50.00 FOR ALL NEW ACCOUNTS WITH A METER SIZE OF 5/8-INCH x 3/4-INCH, THEREBY AMENDING THE SECURITY DEPOSIT AMOUNT FOR NEW ACCOUNTS REQUESTING A 5/8-INCH BY 3/4-INCH METER; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA AS FOLLOWS: Section 1. Chapter 18 of the Code of Ordinances of the Village of Tequesta is hereby amended at Section 18-3 (h) to read as follows: "Section 18-3. Same-Enumerated. The schedule of rates and charges be, and the same are hereby determined, as follows: "(h) Security Deposits. There shall be a security deposit of $50.00 for each account established after the effective date of this Section requiring a 5/8-inch x 3/4-inch meter to be paid at the time of application for service. For all other meter sizes there shall be a security deposit equivalent to three (3) times the minimum monthly service charge for each account established after the effective date of this Section to be paid at the time of application for service. The security deposit is intended as security for payment of any final bill prior to disconnection. In computing the final bill for an account, the meter deposit shall be credited to that account. The deposit will not bear interest. " Section 2. If any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance which can be given effect without the invalid provisions or applications, and to this end the provisions of this Ordinance are hereby declared severable. Section 3. This Ordinance shall be codified and made a part of the official Code of Ordinances of the Village of Tequesta. Section 4. This Ordinance shall take effect immediately upon its passage and approval as provided by law. THE FOREGOING ORDINANCE was offered by Councilmember , who moved its adoption.
