AN ORDINANCE OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA,
AMENDING ARTICLE IV OF THE CHARTER OF THE VILLAGE
AT SECTION 4.02, RELATING TO THE ENUMERATED
POWERS OF THE VILLAGE BY PROVIDING AT SUB-
PARAGRAPH 29 THEREOF THAT THE VILLAGE SHALL
HAVE THE POWER TO ANNEX SUCH LANDS TO THE
TERRITORIAL LIMITS OF THE VILLAGE AS PROVIDED
BY CHAPTER 171, FLORIDA STATUTES, THEREBY
AMENDING THE POWERS OF THE VILLAGE BY DELETING
REFERENCE TO ANNEXATION WITHIN NATURAL BOUNDARIES
OF THE VILLAGE; PROVIDING FOR SEVERABILITY;
PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE Village Council of the Village of
Tequesta, Palm Beach County, Florida, as follows:
Section 1. Article IV of the Charter of the Village of
Tequesta is hereby amended at Section 4.02(29) to read as
follows:
"Section 4.02 Enumerated Powers.
The Village hereby established shall have power.
(29 ) To annex such lands to the territorial limits of the
Village of Tequesta as provided by Chapter 171, Florida
Statutes, 1975, as the same may be amended from time to
time. "
Section 2. If any provision of this Ordinance or the
application thereof is held invalid, such invalidity shall
not affect the other provisions or applications of this
Ordinance which can be given effect without the invalid
provisions or applications, and to this end the provisions
of this Ordinance are hereby declared severable.
Section 3. This Ordinance shall be codified and made a
part the official Code of Ordinances of the Village of
Tequesta.
Section 4. This Ordinance shall take effect immediately
upon its passage and approval as provided by law.
