AN ORDINANCE OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY,
FLORIDA, AMENDING ORDINANCE NO. 355,
RELATED TO LOCATION AND SCREENING OF
DUMPSTERS; PROVIDING REGULATIONS FOR
SAME; AND PROVIDING A PENALTY.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, FLORIDA, as follows:
The Code of Ordinances of the Village of Tequesta is
hereby amended by the addition of a new section, entitled
"Location and Screening of Dumpsters, "to read as follows:
LOCATION AND SCREENING OF DUMPSTERS
Section I: INTENT
The purpose and intent of this section is to provide
regulations for the location and screening of dumpsters for
the enhancement of community amenities of beauty and visual
interest and to protect public health, safety and welfare by
promoting refuse and litter control.
Section II. APPLICATION OF REGULATIONS
The regulations provided by this section shall apply
within all zoning districts within the Village of Tequesta,
on properties having or using dumpsters for their sanitation
service. Temporary dumpsters, such as those which are placed
on job sites during construction activity, are not subject
to the provisions of this section.
Section III. REGULATIONS PERTAINING TO DUMPSTERS
1. All dumpsters in the Village of Tequesta shall be
located on the property serviced so as to be reasonably
accessible for trash collection by the sanitation vehicles,
and shall not be located within the right-of-way of a public
street or alley.
2. All dumpsters shall be screened from public view,
from public streets, and from abutting properties having a
residential zoning district classification.
3. Screening on three (3) sides of the dumpster shall
be erected with access to the dumpster on the fourth side
being obtained by an approved opening. The sufficiency of
the access of the dumpster shall meet the concurrence of the
Village and the franchised sanitation company.
Dumpsters are not required to be screened when
placed in the rear setback behind buildings and not in view
of the general public; except when the rear of a commercial
establishment abuts residentially zoned property.
5. Screening shall be opaque in nature and be
constructed in conformity with material approved by the
Standard Building Code. A permit must be obtained from the
Village Building Official prior to the commencement of
construction.

6. The buffering of the dumpsters shall be of a
material that blends in with the architecture of the
building, when possible. All screening must be a minimum of
four (4' ) feet high. The height of the dumpster may not
protrude above the screening.
7. All dumpsters must be placed on a hard surface,
the minimum dimensions of which shall be adequate for the
size of the dumpster located there. Inadequate or non-
durable pads shall be the responsibility of the property
owner to repair or replace as needed.
8. In the event the property owner elects to place
gates on the screened dumpster enclosure, the doors must be
kept closed at all times except when the dumpster is being
serviced. The doors must be kept in good repair at the
expense of the owner.
9. These regulations cover all existing and future
development within the Village of Tequesta. In the case of
new development, the location of these dumpsters shall be
shown on the approved site plan.
10. All existing non-conforming dumpsters in the Village
of Tequesta shall be in compliance with these regulations no
later than eighteen (18) months from the date of the passage
of the Ordinance.
11. Appeals to the decisions of the Village staff to
these matters may be implemented by the appeal process to the
Board of Adjustment as described elsewhere in the zoning
Ordinance.
Section IV: VIOLATIONS
Any person violating the provisions of this Ordinance
shall, upon conviction, be subject to the penalties provided
by the General Penalty Provision of the Code of Ordinances of
the Village of Tequesta. Each day that such violation shall
continue shall constitute a separate offense.
Section V: SEVERABILITY
If any provisions of this Ordinance or the application
thereof is held invalid, such invalidity shall not affect the
other provisions or applications of this Ordinance which can
be given effect without the invalid provisions or
applications and to this end the provisions of this Ordinance
are hereby declared severable.
Sectin VI: CODIFICATION
This Ordinance shall be codified and made a part of the
official Code of Ordinances of the Village of Tequesta.
Section VII: EFFECTIVE DATE
This Ordinance shall take effect immediately upon its
passage and approval, as provided by law.

The VILLAGE OF TEQUESTA, FLORIDA proposes to change the zoning regulations within
the area shown in the map in this advertisement by adoption of zoning ordinances amending the
regulations contained within all the zoning districts of the Village as set forth in Village Ordinance
No. 355, as amended,
The proposed change in the zoning regulations consists of the amendments contained within
the proposed Ordinance Nos. 361 and 363, which provide as follows:

on file and are available for inspection and copying in the Office of the Village Clerk, Village
Hall, 357 Tequesta Drive, Tequesta, Florida, 33469, during regular business hours.

FLORIDA,WILL HOLD A PUBLIC HEARING ON THE ABOVE-REFERENCED MATTERS ON SAID

AN ORDINANCE OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY,
FLORIDA, AMENDING ORDINANCE NO. 355,
PERTAINING TO TRAILERS OR TEMPORARY
STRUCTURES OR VEHICLES; PROVIDING REGULATIONS
FOR SAME; AND PROVIDING A PENALTY.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, FLORIDA, AS FOLLOWS:
Section I. : Section X (K) of Ordinance No. 355 is hereby
amended to read as follows:
Section X (K) : Trailers or Temporary Structures or Vehicles
(1) On construction sites trailers, or temporary
structures, or vehicles used for construction offices on
a construction site or in a subdivision shall be
permitted during the period of construction only after a
building permit for the construction job has been issued.
(a) Such trailers, or temporary structures, or
vehicles, must be removed from the building site or
subdivision within thirty (30) days following the
issuance of the final certificate of occupancy, or in
the case of subdivision development, thirty (30) days
following acceptance by the Village of the tangible
improvements required prior to the granting of
approval of the final plat. An additional thirty
(30) day extension period may be granted by the
Building Official for good cause shown.
(b) Such permitted trailers, structures, or vehicles,
may be used for sales habitation or promotional
purposes, only upon permission of the Village Council
and shall be permitted only after receiving a permit
from the Building Official for each such trailer.
(c) A trailer, or temporary structure, or vehicle
used for a construction office on a construction site
located within a residentially zoned district of the
Village shall not have an interior dimension greater
than ninety-six (96) square feet. The interior
dimension restriction shall not apply to trailers, or
temporary structures, or vehicles which may be
permitted for subdivision infrastructure
construction. Only one (1) such trailer, or temporary
structure, or vehicle used for a construction office
on a construction site , shall be permitted for each
owner-builder or prime contractor within any given
subdivision for which the Village has previously
accepted the tangible improvements required prior to
the granting of approval of the final plat.
Section 2: If any provision of this Ordinance or
application thereof is held invalid, such invalidity shall
not affect the other provisions or applications of this
Ordinance which can be given effect without the invalid
provisions or applications and to this end the provisions of
this ordinance are hereby declared severable.

Section 3: All Ordinances or parts of Ordinances in
conflict herewith are hereby repealed.
Section 4: This Ordinance shall be codified and made a
part of the Official Code of Ordinances of the Village of
Tequesta, Florida.
Section 5: This Ordinance shall take effect immediately
upon its passage and approval, as provided by law.
