AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, FLORIDA, AMENDING THE VILLAGE CODE OF
ORDINANCES AT CHAPTER 2. ADMINISTRATION. SECTION 2-81.
VILLAGE MANAGER; AUTHORITY AND DUTIES. TO INCREASE THE
VILLAGE MANAGER'S CONTRACT EXECUTION THRESHOLD FROM
$25,000.00 TO $76,000.00; PROVIDING THAT EACH AND EVERY
OTHER SECTION AND SUB -SECTION OF CHAPTER 2
ADMINISTRATION. SHALL REMAIN IN FULL FORCE AND EFFECT AS
PREVIOUSLY ADOPTED; PROVIDING A CONFLICTS CLAUSE, A
SEVERABILITY CLAUSE AND AUTHORITY TO CODIFY; PROVIDING
AN EFFECTIVE DATE; AND FOR OTHER PURPOSES.
WHEREAS, The advent of COVID-19 and all of the ancillary issues caused by the
pandemic, i.e. inflation, supply chain issues, shortages, etc., has made it very apparent
that the Village needs to revisit its purchasing policies to overcome these issues.
Construction costs have increased substantially, the difficulties obtaining new fleet
vehicles, and the Fire Department's lead time for bunker gear all point to the need for the
Village to update/increase the purchasing thresholds to increase our ability to procure
necessary items more efficiently; and
WHEREAS, the Village Charter at Section 3.03 authorizes the Village Council to
establish by ordinance, contract execution limits for the Village Manager; and
WHEREAS, the Village Council desires to increase the Village Manager's contract
execution authority from $25,000.00 to $75,000.00 pursuant to said Village Charter
authority; and
WHEREAS, the Village Council has determined that the code amendment
contained in this ordinance will be in the best interests of the citizens of the Village of
Tequesta.
NOW THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1: Chapter 2. Administration. of the Code of Ordinances of the Village
of Tequesta is hereby amended at Section 2-81. — Village manager; authority and duties.
to increase the Village Manager's contract execution threshold from $25,000.00 to
$75,000.00; providing that Section 2-81. shall hereafter read as follows:
Sec. 2-81. - Village manager; authority and duties.
(a) Generally. The village manager shall generally be vested with the authority and
duties as set forth in Section 3.03 of the Village Charter.
(b) Ex officio responsibilities. The village manager may assume ex officio, the duties
of department head for any department under his jurisdiction with the exception
of the police department, the fire department and the public safety department, if
any,, in the event that a separate department head is not employed in that
capacity.
(c) Contracts. The village manager is authorized to sign contracts in the maximum
amount of Seventy Five Thousand Dollars ($75.000.00) $25,000.00, as well as
employment agreements for interim firefighters without prior village council
approval.
Section 2: Each and every other section and subsection of Chapter 2.
Administration. shall remain in full force and effect as previously adopted.
Section 3: All ordinances or parts of ordinances in conflict be and the same are
hereby repealed.
Section 4: Should any section or provision of this Ordinance or any portion
thereof, any paragraph, sentence or word be declared by a court of competent jurisdiction
to be invalid, such decision shall not affect the validity of the remainder of this Ordinance.
Section 5: Specific authority is hereby granted to codify this Ordinance.
Section 6: This Ordinance shall take effect immediately upon adoption.
