A meeting was held by the Village Council of the Village of Tequesta, Florida at 7:32 P.M. , Tuesday, July 13, 1982 in the Village Hall, 357 Tequesta Drive,' Tequesta, Florida. Councilmembers present were: Beddow, Brown, Little, Mapes and Stoddard. Also present were: Robert Harp, Village Manager, Cyrese Colbert, Village Clerk and John C. Randolph, Village Attorney. The opening Prayer and Pledge of Allegiance was given by Councilmember Beddow. • Representative "Doc" Myers was not present yet so Council agreed to go thru the agenda until Dr. Myers arrived. The first item under new business was the considerationof Site Plan Review for Unit #2, Village Square Shopping Center. This item had been discussed earlier at'Site: Plan Review. Little moved, "that we accept the Site Plan Review for Unit #2, Village Square Shopping Center as presented". Stoddard seconded and vote on the motion was: Beddow -for i Brown -for . Little -for Mapes -for Stoddard -for and therefore the motion was passed and adopted. "Doc"Myers arrived and was welcomed by the Council. "Doc" Myers .gave Council an up-to-date report on the SalesTax Increase, the Building Code change for Energy Efficiency, the water amount. limits in water closets, jails that now may be built outside County Seats, Code Enforcement Boards powers, National Electrical Code and Mass Transporation System. . Mr. Bill Payne, Attorney for Rinker Materials, told Council that representatives from Rinker were before Council about nine (9) months ago. Since then they have been in negotiations with F.E.C. Railway. They have reached an agreement with F.E.C. on the additional land needed for the improvements. He told Council that Rinker will submit plans to the Building Official within the next thirty (30) days for the Community Appearance Board. Mr. Payne told Council that the area between Tequesta Drive and Rinker Plant will be beautified and that the trains will be able to side track on the south. He also told Council that Rinker has plans to improve Old Dixie with proper drainage and are working with Palm Beach County on the resurfacing of Old Dixie from the Jupiter line to the area that has already been resurfaced by Bridge Road. Mr. Payne had requested that he be on the agenda in response ` 07-13-82 -02 to a letter sent to Rinker from the Village Attorney on the violations of the Village's dumping ordinance occurring on Rinker's property. Mr. Robert Moore, resident, told Council that violations of the truck Ordinance are occurring but maybe the Police Department do not understand the Truck Ordinance. Mrs. Young, resident, told Council she doesn't believe the truck permitting system is working. Mrs. Marsha Evans, resident, asked if it was true that every time there is a noise.occurring at' the..railroad that a new noise level reading has to be taken? The Village Attorney told Mrs. Evans, that it was true, each time a new reading has to be taken. The next item on the agenda was the discussion of dredging the • Intracoastal Waterway and deposit of the spoil by the Army Corps of Engineers. In a letter to Florida Inland Navigation District the Corps said that maintenance dredging of the Intracoastal Waterway in the vicinity of Jupiter • Inlet was considered necessary to provide for waterway usage. The disposal will start at the north end of the disposal area and progress southerly approximately 1,000 to 2,000 feet. It was estimated the south limit of material placed in this area will not be closer than 3,000 feet to Jupiter Inlet. The Village Manager read by title, A RESOLUTION IN ACCORDANCE WITH • THE REQUIREMENTS OF CHAPTER 253.125(1) FLORIDA STATUTES, INFORMING THE, DEPARTMENT OF ENVIRONMENTAL REGULATION OF THE VILLAGE COUNCIL, VILLAGE OF TEQUESTA, APPROVAL OF REQUEST BY THE U.S. ARMY, CORPS OF ENGINEERS, TO DREDGE THE ATLANTIC INTRACOASTAL WATERWAY ONE AND ONE-HALF MILES NORTH OF JUPITER INLET AND TO DEPOSIT THE SPOIL IN THE ATLANTIC OCEAN BEACH NORTH OF THE INLET NO HIGHER THAN THE VEGETATION LINE, AND 'NOT CLOSER THAN ONE HALF MILE FROM THE INLET. Stoddard moved, "that we adopt the Resolution ' • as read". Brown seconded and vote on the motion was: • Beddow -for Brown • -for Little -for Mapes -for • Stoddard -for and therefore Resolution No. 18-81/82 was passed and adopted. Mayor Mapes said this was on the agenda because Palm Beach County has certain objections to Tequesta annexing the County Park site on Jupiter Island. Mapes said that the County is concerned with Tequesta's present zoning in that area and that Tequesta would have to come down in the density from 18 units_ per acre to 10 or 12 to make the county happy. The Village Attorney told Council that because of the problems the County has had with other. municipalities relating to lands acquired by the County for use as parks within the corporate limits of those municipalities the County is not anxious to subject itself to the jurisdiction of another governmental entity. 07-13-82 -03 The Village Attorney also told Council that the answer was "no" to the Village's question of, "can the Village enter into an agreement with the County to provide that the Village would not exercise any land use control or zoning authority within the park or as to other unincorporated areas which may be annexed". The Attorney told Council they could not speak for future Councils. Mayor Mapes told Council that he has asked for a Workshop Meeting with the County for early in September. Stoddard moved, "that the Minutes of the April 13, 1982 Council Meeting be approved to include Beddow's verbatim comments off of the tape". . Brown seconded and vote on the motion was: Beddow -for Brown -for Little -for Mapes -for Stoddard -for and therefore the motion was passed and adopted. Brown moved, "that the Minutes of the April 27, 1982 Council Meeting be approved". Little seconded and vote on the motion was: Beddow -for Brown -for Little -for Mapes -for it Stoddard • -for and therefore the motion was passed and adopted. Little read a'`letter. about Police Chief Flannery honoring him for his involvement in various drug investigations from the Drug Enforcement Administration. Little thanked Council for their support and involvement in the 4th, of July Celebration. The Village Attorney told Council that Tequesta was on the Agenda of the Martin County Commission Meeting on July 27, 1982 at 1:30 P.M. for . the Connector Road.
