MINUTES OF THE WORKSHOP MEETING
OF THE
LOCAL PLANNING AGENCY OF THE
VILLAGE OF TEQUESTA, FLORIDA
AUGUST 22, 1985
A meeting of the Village of Tequesta Local Planning Agency was
held at 5:00 P.M.; Thursday, August 22, 1985 in the Village Hall, 357
Tequesta Drive, Tequesta, Florida.
Agency members present were: Stoddard, Murphy, Gemino and Howell.
Also present were: R. Harp, Village Manager, John C. Randolph, Village
Attorney, Scott D. Ladd, Building Official and Jack Horniman, Planner.
Stoddard advised that the. Workshop Meeting was called to review
the Coastal Zone Protection/Conservation Element of the Comprehensive
Plan and turned the meeting over to Horniman.
Horniman referred to Page 1 of the review of the element noting
that many of the existing goals, objectives and recommendations in the
plan are controlled by State Authority and he recommends deletion or mo-
dification of same. He noted the recommendation of the Environmental
Suitabilities Composite Map and appendix for deletion since it is a good
tool for use at the County level but not usable atithe municipal level.
He said that it would be mentioned in the plan.
Stoddard reminded of the need for intergovernmental coordination
between Palm Beach County and the Village on various sections of this
element.
The review of Class II and Class III Waters was satisfactory to
the members.

Under the section on Selected Coastal Mangroves, Stoddard noted
the Village had observed the environmental aspects of preservation of sea
grass (Turtle grass) within the Water Department Intracoastal Crossing was
installed. The last of the review was satisfactory to the members.
Atlantic Beaches and Dunes - It was noted the Village conforms to
the State set backline. Stoddard noted that Village property owners on
the ocean were the first to approve and agree to the Coastal Erosion set
backline. The rest of the review as satisfactory (Objective B, Plan
Recommendations 1, 2 and 3) .

Stoddard said the matter of rupturing of dunes on Jupiter Island adjacent
to the Village should be a great concern and intergovernmental cooperation
by the County is necessary to provide for the preservation of the dunes.
Murphy noted that when beaches are discussed, especially when the matter of.

public access is mentioned, there tends to be a lack of cooperation from the
• property owners involved. Stoddard said there is a need for dune restoration
and stabilization. Horniman said he would include this as a plan recommendation.
The Village Attorney advised that. the County has a beach and dune preservation.
ordinance but it was noted it is very hard to enforce. Stoddard reviewed how
Dorner, a property owner has attempted to keep vehicles off of his property in
an attempt to preserve the dune. Ladd noted that highway type guard rail
would probably be the best way to keep vehicles out. .
- .. Under 5 - Atlantic Beaches and Dunes, it was decided to note that
Coral, Cove Park is now within the Village.
Item 6 was satisfactory as written.
Item 7 - Acquatic Preserves merited a lot of discussion. Stoddard
noted a portion of the Loxahatchee River had been federally designated as
a Wild and Scenic River and the Village was a member of the Local Management
Committee. He said it was a watchdog committee for the preservation of the
river. Horniman said his recommendation for deletion was based upon the fact
that the State has authority over Aquatic Preserves. Stoddard said the Wild
and Scenic designation was an important thing for the area. Howell asked if
there was any agency that kept track of all development and their impacts
upon the. river. Horniman agreed to include the Village's involvement in the
Local Management Committee in the plan. Stoddard said coordination with
other governmental agencies is important. Horniman noted that when developing
of the waterfront permits must be obtained from Corps of Engineers,
DER, etc. Stoddard spoke of various drainage projects the Village had
accomplished and the manner of construction met all required and requested
standards and that this was a good example of preserving the river. He also
advised that the Village had a representative of the County Beaches and
Shores Council. Howell asked sewerage in the area and was advised that the
ENCON policy was not to provide same for areas that had good septic tank
percolation . Horniman said this item needed to be rearranged and discuss
the Village's involvement on the Local Management Committee of the Loxahatchee
River.
Item 8, Commercial Docking facilities is to be deleted because it
is not provided for in the Zoning Ordinance.
Item 9 was satisfactory as written.
Item 10 was satisfactory as written as well as Items 11 and 12.
Item 13 -. Parks and Recreation was very thoroughly discussed with
the major; part of the discussion being on the F.E.C. Railway right-of-way
lying north of Tequesta Drive. It was noted that the size of the property

• would probably preclude commercial. development. Horniman noted that a
land used of R/OP gives the Village a tool to control the land and can still
look at any proposals for development of the land. Horniman noted that the
new zoning regulations precluded parks/recreational development in commer-
cial areas and the existing plan is in conflict with this. Stoddard said
he agrees that F.E.C, right-of-way should be land used R/OP and that F.E.C.
seems'to be cooperating with the Village by their past actions such as
removal of unloading area, etc. The Village Attorney asked Horniman if he
thought he could support and justify R/OP planning along a railroad and
he said he thought he could. Horniman mentioned the possibility of providing
for a transportation land use. Stoddard asked if the railway would fight
R/OP land use and Village Attorney answered yes because they would think the
Village was taking •.away their use of the property. Horniman said this
R/OP land use would indicate what the. Village prefers since. the size of the
area almost precludes commercial activity. Stoddard agreed with Horniman.
Horniman noted that the intent is on open space more than recreation, and any
other use is against the new Zoning Ordinance. Horniman said we could
restructure this section to keep the recommendation and have zoning amended
to allow R/OP in all Zoning Districts. The Village Attorney said he thought •
• R/OP would be calling the railroad's attention to a problem and raising a
red flag. He said he would recommend support of Horniman's recommendation •
if he can support same. Howell said he thought it would be easier to
change zoning than land use. Stoddard said F.E.C. would probably not fight
it too hard. The Members generally agreed that the F.E.C. Railway right-
of-way should be R/OP. Stoddard then discussed the U.S. Coast Guard property
within the Village.
Item No. 14 was satisfactory as written.
Ladd spoke of concerns that the National Academy of Sciences and
Environmental -Protection Agency were making coastal areas aware of in
regard to future searise and landdrop and are suggesting that the communities
address it now. Information indicates a 5" drop in land and a 3'-5' rise
in sea level. in the next century.
The meeting was adjourned at 6:45 P.M. •
