THE NATIONAL ELECTRIC. CODE AND FOR THE ADOPTION OF THE UNIFORM MINIMUM COUNTYWIDE 1983 ADDENDUM . TO THE NATIONAL ELECTRIC CODE; PROVIDING FOR ,j CODIFICATION; PROVIDING AN EFFECTIVE DATE. jj Section 1. Section 6-41 of the Code of. Ordinances of the Village of Tequesta is hereby amended to read as follows: "Section 6-41. Code Adopted. The National Electric Code, 1984 Edition, of which copies have been and are now filed in the Office of the Building Official of the Village, is herebyy adopted and incorpor- ated as fully as if set forth at length herein, and from the date on which this Section shall .. ' take effect, the provisions therein shall be controlling in the area of jurisdiction of the Village. " Section 2. Section 6-42 of the Code of Ordinances of. the Village .is 'hereby amended to read as follows: "Section 6-42. Same Uniform, Minimum Countywide Amendments Adopted. The uniform, minimum countywide amendments, as recommended by the Building Code Advisory Board of Palm Beach County, to the National Electric Code, 1983 Edition, is hereby adopted and incorporated herein as fully. as if set forth at length herein. " Section 3.. This Ordinance shall be codified and made a part of the official Code of Ordinances of the Village of Tequesta, Florida. Section 4 . This Ordinance shall take effect immediately upon its passage and approval as provided by law. THE FOREGOING ORDINANCE was offered by Councilmember , who moved its adoption. Official . ! 2/28/85:CC:bd . 1 H ORDINANCE NO. 85-9 2 AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF 3 PALM BEACH COUNTY, FLORIDA, ENACTING THE 1984 4 EDITION OF THE NATIONAL ELECTRIC CODE AS THE MINIMUM 5 CODE FOR ALL AREAS OF PALM BEACH COUNTY, BOTH 6 UNINCORPORATED AND INCORPORATED; REPEALING LAWS IN 7 CONFLICT; PROVIDING A PENALTY; PROVIDING FOR 8 H SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING 9 H AN EFFECTIVE DATE. 10 WHEREAS, the Board of County Commissioners of Palm 11 . Beach County, Florida is vested with the authority to adopt an 12 `:updated edition of the 1981 Electrical Code as the minimum code 13 throughout Palm Beach County, both unincorporated and 14 :. incorporated areas, pursuant to Laws of Florida, Chapter 15 : 81-457; and 16 WHEREAS, the Building Code Advisory Board has 17 '' recommended that the Board of County Commissioners adopt the 18 ': 1984 edition of the National Electric Code as the minimum 19 uniform code throughout Palm Beach County; and 20 WHEREAS, Florida Statutes, Sections 125.01(i) and 21 163.295 provide for the Board of County Commissioners to adopt 22 building related codes; and 23 • WHEREAS, Florida Statutes, Section 163.295 requires 24 that the penalty provision for the violation of such codes be 25 set out in full in the adopting ordinance; and 26 WHEREAS, it is in the best interest of the public to 27 have uniform building codes throughout all of Palm Beach 28 County. 29 NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY 30 COMMISSIONERS OF PALM BEACH COUNTY, FLORIDA as follows: : 2/28/85:CC:bd ;I 1 .1 Section 1. 2 Pursuant to Laws of Florida, Chapter 81-457 and Florida 3 ; Statutes, Section 125.01(i) and 163.295, the National Electric Code, 1984 4 Edition, is hereby adopted as the minimum uniform electrical code in Palm 5 Beach County. Said code shall be effective as the minimum code 6 throughout Palm Beach County, in both municipalities and the 7 •'unincorporated area. 8 H Section 2. REPEAL OF LAWS IN CONFLICT 9 All ordinances adopting previous editions of the National • 10 HElectric Code and any ordinances in conflict with any provisions of this 11 `. ordinance are hereby repealed; provided, however, the 1983 Addendum to 12 ; the National Electric Code adopted by Ordinance 83-7 shall remain in full 13 Hforce and effect to the extent that such is not less stringent than the 14 iqqational Electric Code, 1984 Edition. 15 Section 3. PENALTY 16 Violation of this ordinance shall be punishable by a fine not 17 `.; to exceed Five Hundred ($500.00) Dollars or by imprisonment not to exceed 18 .;sixty (60) days, or by both such fine and imprisonment. 19 Section 4. SEVERABILITY 20 If any section, paragraph, sentence, clause, phrase, or word of 21 ,! this ordinance is for any reason held by the Court to be unconstitu- 22 tional, inoperative or void, such holding shall not affect the remainder 23 'of this ordinance. 24 Section 5. INCLUSION IN THE CODE OF LAWS AND ORDINANCES 25 The provisions of this ordinance shall become and be made a 26 part of the code of laws and ordinances of Palm Beach County, Florida. 27 The Sections of the ordinance may be renumbered or relettered to 28 accomplish such, and the word "ordinance" may be changed to "section," 29 ,"article," or any other appropriate word. 30 := Section 6. Box 3273 Tequesta, Fla. 33458 Dear Mr. Ladd : Enclosed is a copy of the recently adopted ordinance of the Board of County Commissioners of Palm Beach County, Florida establishing a uniform minimum electric code effective in both Palm Beach County and the municipalities. The effective date of the ordinance was April 17, 1985 at 4:13 P.M. This is adopted pursuant to Chapter 81-457, Laws of Florida. As you are probably aware, the Building Code Advisory Board has recommended an addendum to this code. On behalf of the Building Code Advisory Board, I urge its adoption, if such has not already been done.
