Drawer M West Palm Beach, Florida 33402 Dear Skip: Re: Resolution No. 7-84/85 Building Boards We have received your May 2, 1985 letter pertaining to the referenced subject and have discussed same with Scott Ladd. We have also discussed this matter. with Mr. Robert Palchanis, Building Official, Palm Beach County and he believes we can enter into an agreement with Palm Beach County to provide service as necessary and act as the Village's Building Board of Appeals and Housing Board of Appeals. Mr. Palchanis advised that we are required to have such boards. He also advised that the County currently has such agreements with some of the smaller municipalities. We We would suggest that you contact Mr. Richard W. Carlson, Jr. , Assis- tant County Attorney, to work out such an agreement. The letter is self-explanatory. I do not recommend that any action be taken in. regard to this matter. ' I still believe that the • Boards that the Village had previously established are passe ' and do not serve any continued purpose. That is evident by the fact that those Boards have not functioned for several years. Johnston, Sasser, Randolph & Weaver 310 Okeechobee Boulevard West Palm Beach, Florida 33402 Re: Tequesta Resolution No. 7-84/85 Dear Skip: At the Building Code Advisory Board meeting of April 17, 1985 the Building Code Advisory Board was presented a letter from Tequesta Village manager Robert Harp and a resolution adopted by Tequesta disbanding the Building Board of Appeals, Building Code Review Committee, Housing Board of Appeals, Electrical Code Review Committee, and Housing Code Review Committee of Tequesta, and purportedly "substituting" the functions of the Boards by the Building Code Advisory Board of Palm Beach County. I am not in receipt of the ordinances or resolutions establishing the dissolved Boards. However, from the titles of the Boards, it appears that some serve the function of advising and some serve the function of appeals relating to the various codes of Tequesta. The Building Code Advisory Board of Palm Beach County is a body created by Special Act of the Legislature. Its function, inter alia, is to advise the various building departments, including municipalities, of Palm Beach County. In this capacity, the Board advises and recommends to the cities and County various building related codes and addenda thereto. To the best of my knowledge, it has never undertaken individual counseling and recommendation to ' municipality with respect to their individual adopted codes that are different from those recommended by the Advisory Board. Of course, municipal input is strongly desired by the Board when it is formulating its addenda to the building related codes. Also, the Building Code Advisory Board is available for products approval. Finally, regional inspectors are established in the Special Act to interpret building related code provisions at the request of the building official. However, the Building Code Advisory Board is not empowered to hear appeals from individuals contesting the interpretation of the building official.. Based on the above-discussed matters, should the issue be presented for Building Code Advisory Board action, I would advise the Building Code Advisory Board that its dutiesare spelled out in the Special Act, and that it is not empowered to take upon itself any duties in addition to those set forth. DATE: February 26, 1985 � It has come to our attention that the membership on the following Boards: Building Board of Appeals Building Code Review Committee Housing Board of Appeals Electrical Code. Review Committee Housing Code Review Committee has not been reappointed or appointed for some years now, and some of the Boards have lost members through attrition. Some of the members were not local residents but contractors in their specific fields. The Building. Board of Appeals met once many years ago and none of the other Boards have ever met. Further, the Village has for the past several years fallen., under the purview of the State Act which provides for the Building Code advisory Board of Palm Beach County and the Building Official advised that we would use the services of this Board for any matters falling under the above referenced committees since we use the amendments to the various code as adopted for Palm Beach County by the Building Code Advisory Board. It is the Building Official's opinion, and I concur, that since the services of these Boards is practically NIL and if necessary, they can be provided by the Building Code Advisory Board of Palm Beach County, that the above referenced Boards be dissolved and the persons presently named on same be so notified and thanked for the time they were on the Board. This matter should be included on the agenda for tonight's Council Meeting. Box 3273 Tequesta, Florida 33458 Re: Dissolution of Certain Boards and Committees Dear Scott: I have drafted a Resolution relating to the above-referenced matter. I recommend that we have such a Resolution so that our records are clear on this matter. I would, therefore, appreciate it if you would review this and advise as to whether it needs any changes or corrections. A RESOLUTION OF THE VILLAGE OF TEQUESTA, FLORIDA, DISSOLVING THE BUILDING BOARD OF APPEALS, THE BUILDING CODE REVIEW COMMITTEE, THE HOUSING BOARD OF APPEALS, ELECTRICAL CODE REVIEW COMMITTEE AND HOUSING CODE REVIEW COMMITTEE. WHEREAS, the Village of Tequesta has established the Building Board of Appeals, Building Code Review Committee, Housing Board of Appeals, Electrical Code Review Committee and Housing Code Review Committee; and WHEREAS, the functions of each of these Boards has been taken over by the Building Code Advisory Board for Palm Beach County, NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, as follows : Section 1. The Building Board of Appeals, Building Code Review Committee, Housing Board of Appeals, Electrical Code Review Committee, and Housing Code Review Committee of the Village of Tequesta are hereby dissolved, said functions to be substituted by the Building Code Advisory Board of Palm Beach County. Section 2 . A copy of this Resolution shall be provided to the Building Code Advisory Board of Palm Beach County. THE FOREGOING RESOLUTION was offered by Councilmember , who moved its adoption. The Resolution was seconded by Councilmember and upon being put to a vote, the vote was as follows : FOR ADOPTION AGAINST ADOPTION The Mayor thereupon declared the Resolution duly passed and adopted this day of 1985 .
