RESOLUTION NO. 14-23, A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, FLORIDA, ADOPTING A REVISED SCHEDULE OF FEES AND CHARGES FOR THE
PROVISION OF WATER SERVICES RENDERED BY THE VILLAGE FOR ITS RESIDENTS AND
OTHER MEMBERS OF THE PUBLIC; PROVIDING THAT THIS REVISED SCHEDULE OF FEES AND
CHARGES SHALL BE AVAILABLE FOR INSPECTION AT ALL TIMES AT THE VILLAGE HALL
DURING REGULAR BUSINESS HOURS; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER
PURPOSES
The Utilities Department (UD) recommends approval of Resolution 14-23, adopting a revised schedule
of fees and charges for water services and other purposes as described within the resolution (Rate
Resolution).
At the May 11, 2023, Village Council regular meeting, UD requested direction on bringing forward a
Rate Resolution based on the results of a financial feasibility study prepared by Raftelis Financial
Consultants, Inc. (Raftelis), originally presented at the February 2023 Village Council workshop.
The Rate Resolution under consideration incorporates the direction received from the Village Council
at the May 2023 meeting as recommended by Raftelis and UD:
i. A 5% base rate recalibration adjustment to recognize the effects of recent high inflation on the
cost of operations experienced during FY23 and headed into FY24, plus
ii. Maintaining the previously approved 3.5% annual rate adjustments for the next five fiscal years,
FY24 (effective October 1, 2023) through FY28 (effective October 1, 2027) in this resolution
iii. Introduces a monthly capital improvement charge (CIC) of $10 per equivalent residential
connection (ERC)*
The 3.5% rate indexing is included annually in the 20-year financial model and is proposed to be in
effect for the next 20 years or until economic and/ or funding needs warrant a reduction or elimination
of the change.
The capital improvement charge (CIC) is designed to provide a proactive and dedicated source of
revenue to be used for certain infrastructure improvements to the water system. Based on the
anticipated funding needs for infrastructure improvements over the next 20 years, the CIC is proposed
to be in effect for a period of 20 years. This links to the term of low interest loans administered by the
Florida Department of Environmental Protection's State Revolving Fund (SRF) loans, which is the
anticipated financing vehicle assumed in the Raftelis report to fund infrastructure improvements.

The application of the CIC is assumed to be based on capital projects financing needs by paying the
debt service and, in some cases, on a pay-as-you-go basis. If the Finance Department, UD, and the
Village's rate & financial consultant Raftelis determines that the CIC is no longer needed to complete
the 20-year capital program, then the CIC can be reduced or eliminated.
The net change to an average residential customer (6,000 gallons per month water use) by this Rate
Resolution, which includes the base rate recalibration and annual adjustment, would be $3.09 per
month plus the capital improvement charge of $10 per month for a total of $13.09 per month.
BACKGROUND
Rate Re -calibration Adjustment
The rates that are currently in effect were based on a revenue sufficiency and rate analysis performed
by Raftelis, which was completed during the beginning of FY21. The study was based on data and
assumptions in effect prior to the pandemic and high inflation that the Village of Tequesta's Utilities
system (System) and utilities across the United States have recently been experiencing. By way of
example, the inflation assumptions in the 2021 rate analysis were based on an approximate 2.5%
annual rate and over the last 12 -18 months, the rate of inflation has ranged from 8.0% to 10% and
sometimes more for certain utilities -related commodities. The impact on operating expenses has been
significant which is reducing System revenue margins and the ability to fund capital projects (higher
expenses result in less funds remaining to perform ongoing capital and payment of debt). In order to
address this issue, the UD financial team is recommending a one-time increase of an additional 5.0%
to be added to the approved rate adjustment to recover the recent impact of inflation on System
operating expenses. Most recently in February 2023 the Village Council received and discussed a
presentation on the water enterprise fund's financial forecast by Raftelis and subsequently a rate and
capital program financing plan recommendation was brought forward to the May 2023 Village Council
Regular Meeting for discussion.
Village Council directed staff to bring a resolution incorporating the additional 5.0% rate recalibration
adjustment to become effective on October 1, 2023, and to continue the implementation of the approved
3.5% annual inflationary adjustments thereafter. This will result in an overall rate adjustment being
placed into effect on October 1, 2023 (FY24), of 8.5%. For the average Tequesta residential customer
using 6,000 gallons per month in water service, this will result in a monthly bill increase of $3.09.
Capital Improvement Charge
The Village has a significant amount of aging infrastructure and capital projects that are vital to provide
sound water system operations. Several significant issues face the Village. The water treatment plants
have many components that are at or nearing their useful life expectancy and need safety, redundancy,
rehabilitation, or efficiency upgrades so it is imperative that we address our aging infrastructure issues
before the risk of failure increases. Another significant issue deals with our water distribution system,
which currently consists of over 75 miles of aging pipe. This pipe includes asbestos cement (AC) and
non -AC water pipe that is between 50 and 75 years old and is beginning to reach its useful service life.
This is an issue that has been discussed at length over the years internally and before the Village
Council, and our engineering consultants have recognized this issue in our water system master
planning process. The process outlined a general phased approach to upgrading, replacing, and/ or
rehabilitating the water distribution network. The water piping system has experienced line breaks in
the recent past with 25 pipe breaks since September 2020 with an anticipated increase in frequency
as the pipes continue to age, causing increased interruption in water service to our customers.
Most recently, as we have begun to implement a second pipe replacement project, the construction
prices came back 60% higher than was estimated only months before the bid. The issue of high
construction prices is plaguing every utility system in Florida and across the nation and is expected to

continue, resulting in increased competition to obtain the limited funds available from System revenues.
The water utility has faced other significant operational and capital project cost increases over the last
few years, and rate indexing has not kept up with cost increases. One pipe replacement project is
complete, a second will begin construction in August, and a third will be bid in FY24. Planned water
treatment plant improvements will be bid in FY25. Additional capital projects are under design, nearly
at 100% design, or planned over the next several years
To address this issue, especially as it relates to the water treatment plant and water main replacement
program, additional funds will be needed immediately to fund the program. The estimated cost for just
the 20-year pipe replacement program by our engineers is approximately $60 million, in today's cost.
The Village staff and its rate and engineering consultants presented the capital and funding issues at
a series of public workshops and meetings. Most recently in February 2023, the Village Council
received and discussed a presentation on the water enterprise fund's financial forecast by Raftelis and
subsequently a rate/ program financing plan recommendation was brought forward to the May 2023
Village Council Regular Meeting for discussion. At the direction of the Village Council, staff was
requested to bring a resolution incorporating the adoption or a capital improvement charge equal to
$10.00 per month per ERC to become effective on October 1, 2023, to provide a dedicated source of
funds to continue with the capital plan on a proactive basis.
The capital improvement charge would help fund projects that are specifically identified as infrastructure
system repair/ rehabilitation and replacement (R&R) capital projects. These projects include fire
protection and hydraulic improvement projects, pipe replacement projects (pipes at risk of failure), plant
hydraulic efficiency projects, automation, and any other project specific to our current CIP infrastructure
R&R program. This charge would only be in place as long as the currently planned programs are
ongoing, and would sunset after that point. The recommended charge is $10 per month on an average
resident's water utility bill over a 20-year period consistent with the financing plan presented to the
Village Council by UD and its consultants. The Utilities Department recognizes that the CIP plan is
reviewed and analyzed annually and projects may be reprioritized as required to maintain system
integrity.
Other Adjustments
Other fees and charges were updated, if warranted, in Exhibit A to reflect the increase in the cost to
perform the work if the existing charges and fees were not covering the cost of the work. For example,
under Section 2. A. 2), the cost for installing a water service connection with a water main tap was
updated to include the cost of directional boring, engineering, and permitting that were not previously
recovered in the charges. Another example is Section 'A." which provides for development review fees
and charges for both water and stormwater. In the past, the charges have not been recovered. The
modified section was modeled based on other nearby utilities review fees. The third attachment to this
agenda item provides a comparison of Exhibit A (rates and charges) for Resolution 19-21 that is in
place and for Exhibit A of proposed Resolution 14-23.
SUMMARY
Since there are many dynamic factors that enter into the determination of a water utility financial and
rate plan, the financial forecast and capital funding plan should be reviewed every two to four years or
as needed if some of the factors change significantly or a potential impact is recognized, especially in
this current economy. Capital projects are reviewed annually for reprioritization as needed.
The water utility must maintain its financial health. We're in the business of public health and safety,
providing fire protection through fire hydrants to our citizens and drinking water to our customers within
our 4 square mile water utility service area. Village leadership and elected officials recognize these
facts and have supported the needed rate adjustments. Based on that support, UD has brought forward

the rate adjustment resolution for consideration of approval. The presentation on the financial feasibility
and rate sufficiency model update, upon which the rate recommendations were made, is attached to
this agenda item.

*ERC-equivalent residential connection — a factor used to convert a given average daily flow to an equivalent
number of residential connections. As stated in Chapter 74, Section 31 in the Village of Tequesta's Code of
Ordinances, the Village has determined that one ERC is estimated at 350 gallons per day. ERC and equivalent

WHEREAS, the Village Council of the Village of Tequesta, Florida, desires to
adopt a revised schedule of fees and charges relating to the provision of water services
rendered by the Village of Tequesta for the citizens of the Village of Tequesta,
Unincorporated Martin County, Unincorporated Palm Beach County, Town of Jupiter
Inlet Colony, and for other members of the public served by the Village's water utility;
and
WHEREAS, the Village Council desires to incorporate all such fees and charges
assessed in accordance with Section 74-61 of the Code of Ordinances of the Village of
Tequesta into one comprehensive fee schedule; and
WHEREAS, the Village Council desires to make certain the schedule of fees and
charges is available for inspection such that any member of the public may be aware of
the cost of service provided by the Village of Tequesta's Utilities Department.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1: The Village Council of the Village of Tequesta, Florida, hereby officially
adopts the Schedule of Fees and Charges attached hereto as "Exhibit A" which is
hereby made part hereof as if fully set forth herein. The revisions adopted herein
incorporate the recommendations of a Water Utility Financial Forecast and Capital
Recovery Charge Update Study.
Section 2: This duly adopted "Schedule of Fees and Charges" shall be available
for inspection by the public at Village Hall during normal business hours.
Section 3: This Resolution shall take effect beginning October 1, 2023.

B. Metering of Multi -Family Buildings (MF)
Where a single meter is installed in a water connection serving a multi -family structure, the
minimum monthly service charge shall be the greater of:
i. An amount equal to the number of dwelling units multiplied by the minimum charge for a
3:4-inch meter, or
ii. The base facilities charge for the installed meter size.
In the event there is a single meter measuring quantities of water for two (2) or more residential
units, the gallons measured and charged pursuant to the terms of this section shall be prorated
by dividing the total number of gallons metered by the number of units included on the single
meter.
C. Metering of Multi -Unit Buildings - Non -Residential
In the case of any non-residential multi -unit building housing more than one (1) business or entity,
each business or entity therein shall be metered individually. Monthly minimum service charges
shall be based on the established charge by meter size. Where an existing single meter is installed
in a water connection serving two (2) or more businesses or entities, the minimum monthly service
charge shall also be based on the established charge by meter size. Fire protection charges for
fire lines shall be separately included; see section E, paragraph number "2)" herein below.

4. Development Fees & Charges
Development reviews, permitting, inspection — both residential and non-residential:
• An initial deposit for the project for water and stormwater utilities (as applicable) will
be made against which all related activities will be charged for the project against the
deposit made in order to recover the costs by the Village to process development
reviews, permits, inspections, and associated costs
• These activities include (but are not limited to, except they must relate to the project
or how it fits into the community/ infrastructure system): review, permitting, field
visit(s), related meetings and communication, billing, and construction inspection
activities, plus 10% in administrative costs
• For residential reviews, the deposit of $300 will typically cover the cost of a small
modification assuming a plan review, one request for information (RFI), a
resubmittal, field meeting, permit issuance, inspection (1 cycle)
• If the deposit is not sufficient to cover all related activities, then the applicant will be
required to provide an additional deposit to cover the cost of the remaining
anticipated plan/ permit/ field visit(s)/ meetings and communication/ inspection/
administrative activities based on project status
• Review and approval activities may be suspended until a deposit or additional
deposit is provided
• Any portion of the total amount of all deposits that exceed the total cost of the billed
services will be refunded to the applicant, upon receipt of a written request, when
closing out the project
• Any amount due for the total cost of the billed services that exceeds the total amount
of all deposits shall be due and payable prior to the final acceptance of the facilities
constructed pursuant to any and all utilities construction permit(s) by the utilities
system

expertise, as needed, to support the modification or development within the

service and utility billing manager, finance director, and legal assistance for any
developer agreements; or other related activities for the project leading up to the

10. Capital Improvement Charge
The capital improvement (CIC) is to be used to fund specifically identified capital projects for the
water utility infrastructure. Funds collected from the application of the CRC will be accounted for
separately by the Village and shall only be used for the financing capital infrastructure projects,
including the payment of debt issued to finance such projects. It will also be used for
infrastructure repair and replacement projects on a pay-as-you-go basis for items where debt is
not issued.
The charge is to remain in effect for 20 years and shall terminate on September 30, 2043. A
utilities financial rate consultant, at a minimum of at least once every three years, will evaluate
the financial sustainability of the water utility, including the application of the capital recovery
charge account and the status of the capital needs / projects. They will determine the general
financial condition of the utility and any adjustments considered necessary associated with the
imposition of the capital replacement charge.

11. Excessive Variance Step Adjustment
The Utilities Director may approve an excessive usage credit (EUC) to a water bill, which,
due to circumstances beyond the customer's control (e.g. leaks on the customer's side of the
meter) , reflects consumption in an amount that is at least two times the customer's average
monthly usage over the previous three (3) month period
• No customer shall be eligible for such an adjustment more than once per two (2) calendar
year period
• No such adjustment shall be granted in the event that the adjustment would cause a
violation of Village Code Section 74-78 regarding prohibited free service, or Village Code
Section 74-81 regarding the provision of adequate revenue to cover all costs of
operation, maintenance, and debt service
• Any downward adjustment shall be made based on the Village's then -current step rates
• The lowest step rate that results in an adjusted water bill commensurate with the
customer's average water bill over the previous three (3) months of billing shall be applied
• In the event that application of the lowest step rate results in an adjustment that continues
to exceed an amount that is double the customer's average water bill over the previous
three (3) months of billing, then an adjustment equal to an amount equivalent to double
the customer's average water bill over the previous three (3) months of billing shall be
made
• The Utilities Director shall determine that the customer meets each of the following
criteria prior to approving any EUC:
o Customer notifies the Village of Tequesta's Customer Service Department of an
excessive water bill that may be related to a leak or other circumstance beyond
the customer's control
o Water consumption exceeds two times the customer's average monthly usage
over the previous three (3) month period
o Customer acted promptly to remediate excessive water use (e.g. had a leak on
Customer's side of the meter repaired as soon as practicable) as documented by
repair receipts or other acceptable methods
o The request for EUC was made within 1-month of the remedial action. No EUC
may be approved where any of the following circumstances exist
o Excessive consumption is due to seasonal usages such as watering of sod,
gardening, or usage from filling swimming pools and hot tubs whirlpools, washing
vehicles, etc.
o A leak resulting in excessive consumption was caused by a third party from whom
the customer is able to recover their costs. Examples include. but are not limited
to, theft, vandalism, negligence, and construction damage, including unoccupied
or vacant properties.

o When excessive consumption continues for three (3) or more months, there will be
no adjustment for the third or subsequent months
o The meter has been accessed, tampered with, or turned on/off by anyone other
than a Village of Tequesta Utility employee and that action results in excessive
consumption
o The EUC would violate Village Code Sections 74-78 or 74-81
o A EUC was approved within the past two (2) calendar years at the same property
Notwithstanding the above provisions of this "Excessive Variance Step Adjustment' policy,
the Village Manager may, from time to time, allow for step adjustments in excess of once per
two (2) calendar years at the same property when extenuating circumstances exist that
warrant the granting of relief. All such requests shall be reviewed on a case -by -case basis.
Any relief granted by the Village Manager pursuant to this provision shall be limited to the
same relief that would otherwise be available pursuant to the above EUC policy.

Where a single meter is installed in a water connection serving a multi -family structure, the
minimum monthly service charge shall be the greater of4yan:
i. An amount equal to the number of dwelling units multiplied by the minimum charge for a
3/4-inch meter, or io4lie
ii. The base facilities charge for the installed meter size.
In the event there is a single meter measuring quantities of water for two (2) or more residential
units, the gallons measured and charged pursuant to the terms of this section shall be prorated
by dividing the total number of gallons metered by the number of units included on the single
meter.

entity, each business or entity therein shall be metered individually. _Monthly minimum service

4. Development Fees & Charges
Development reviews, permitting, inspection — both residential and non-residential:
• An initial deposit for the project for water and stormwater utilities (as applicable) will be made
against which all related activities will be charged for the project against the deposit made in
order to recover the costs by the Village to process development reviews, permits,
inspections, and associated costs
• These activities include (but are not limited to, except they must relate to the project or how it
fits into the community/ infrastructure system): review, permitting, field visit(s), related
meetings and communication, billing, and construction inspection activities, plus 10% in
administrative costs
• For residential reviews, the deposit of $300 will typically cover the cost of a small modification
assuming a plan review, one request for information (RFI), a resubmittal, field meeting,
permit issuance, inspection (1 cycle)
• If the deposit is not sufficient to cover all related activities, then the applicant will be required
to provide an additional deposit to cover the cost of the remaining anticipated plan/ permit/
field visit(s)/ meetings and communication/ inspection/ administrative activities based on
project status

• Review and approval activities may be suspended until a deposit or additional deposit is
provided
• Any portion of the total amount of all deposits that exceed the total cost of the billed services

A 25% surcharge shall be applied to those customers in unincorporated Martin and Palm
Beach Counties unless otherwise prohibited by the agreement or law.

10. Capital Improvement Charge
The capital improvement (CIC) is to be used to fund specifically identified capital proiects for the
water utility infrastructure. Funds collected from the application of the CRC will be accounted for
separately by the Village and shall only be used for the financing capital infrastructure projects,
including the payment of debt issued to finance such projects. It will also be used for
infrastructure repair and replacement oroiects on a pav-as-you-ao basis for items where debt is
not issued.
The charae is to remain in effect for 20 vears and shall terminate on September 30. 2043. A
utilities financial rate consultant, at a minimum of at least once every three years, will evaluate
the financial sustainability of the water utility, including the application of the capital recovery
charge account and the status of the capital needs / projects. They will determine the general
financial condition of the utilitv and anv adiustments considered necessary associated with the
imposition of the capital replacement charge.

11. Excessive Variance Step Adjustment
The Utilities Director may approve an excessive usage credit (EUC) to a water bill, which,
due to circumstances beyond the customer's control (e.g. leaks on the customer's side of the
meter) , reflects consumption in an amount that is at least two times the customer's average
monthly usage over the previous three (3) month period
• No customer shall be eligible for such an adjustment more than once per two (2) calendar
year period
• No such adjustment shall be granted in the event that the adjustment would cause a
violation of Village Code Section 74-78 regarding prohibited free service, or Village Code
Section 74-81 regarding the provision of adequate revenue to cover all costs of
operation, maintenance, and debt service
• Any downward adjustment shall be made based on the Village's then -current step rates
• The lowest step rate that results in an adjusted water bill commensurate with the
customer's average water bill over the previous three (3) months of billing shall be applied
• In the event that application of the lowest step rate results in an adjustment that continues
to exceed an amount that is double the customer's average water bill over the previous
three (3) months of billing, then an adjustment equal to an amount equivalent to double
the customer's average water bill over the previous three (3) months of billing shall be
made
• The Utilities Director shall determine that the customer meets each of the following
criteria prior to approving any EUC:
o Customer notifies the Village of Tequesta's Customer Service Department of an
excessive water bill that may be related to a leak or other circumstance beyond the
customer's control.
o Water consumption exceeds two times the customer's average monthly usage over
the previous three (3) month period.
o Customer acted promptly to remediate excessive water use (e.g. had a leak on
Customer's side of the meter repaired as soon as practicable) as documented by
repair receipts or other acceptable methods.
o The request for EUC was made within 1-month of the remedial
action. No EUC may be approved where any of the following
circumstances exist:
o Excessive consumption is due to seasonal usages such as watering of sod,
gardening, or usage from filling swimming pools and hot tubs whirlpools, washing
vehicles, etc.
o A leak resulting in excessive consumption was caused by a third party from whom
the customer is able to recover their costs. Examples include. but are not limited to,
theft, vandalism, negligence, and construction damage, including unoccupied or
vacant properties.
o When excessive consumption continues for three (3) or more months, there will be
no adjustment for the third or subsequent months.
o The meter has been accessed, tampered with, or turned on/off by anyone other than

a Village of Tequesta Utility employee and that action results in excessive
consumption.
o The EUC would violate Village Code Sections 74-78 or 74-81.
o A EUC was approved within the past two (2) calendar years at the same property.
Notwithstanding the above provisions of this "Excessive Variance Step Adjustment' policy,
the Village Manager may, from time to time, allow for step adjustments in excess of once per
two (2) calendar years at the same property when extenuating circumstances exist that
warrant the granting of relief. All such requests shall be reviewed on a case -by -case basis.
Any relief granted by the Village Manager pursuant to this provision shall be limited to the
same relief that would otherwise be available pursuant to the above EUC policy.
