The Special Magistrate appointed by the Village Council to hear code compliance cases
for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard testimony
at the Code Compliance Special Magistrate Hearing held on the 1 lth day of July 2023, and based
on the evidence and testimony presented, enters this Order Resetting Hearing. The following
Findings of Fact, Conclusions of Law, and Order are hereby entered:
FINDINGS OF FACT
1. The Respondents are the owners of the above -described property.
2. The Respondents were present at the hearing; there was a finding
of proper notice.

Code Officer Latoya Thompson provided testimony and evidence of the violation,
as contained in the Village's evidentiary case file which was accepted into evidence
without objection.
4. By the "Order Finding Violation" dated March 141h, 2023, the Special Magistrate
ordered the Respondents to comply with Chapter 14, Article II, Section 14-31,
Chapter 14, Article I, Section 14-6, of the Code of Ordinances of the Village of
Tequesta and Section 105.1 of the Florida Building Code (Seventh Edition) by May
9th, 2023.
4. Based upon the evidence, pictures, and testimony presented at the hearing on May
9th, 2023, the property remained in non-compliance with sections 14-31, 14-6, and
105.1 of the Tequesta Code of Ordinances and Florida Building Code.
CONCLUSIONS OF LAW
The above -stated facts constitute a continuing violation of Sections 14-31, 14-6, and 78-
795 of the Code of Ordinances of the Village of Tequesta and Section 105.1 of the Florida Building
Code (Seventh Edition).
ORDER
This fine violation/status hearing is hereby reset to the September fine assessment/status
hearing which will be held September 13th, 2023, at 10:00 a m. at Village Hall, Council
Chambers, 345 Tequesta Drive, Tequesta, Florida 33469.
Administrative costs incurred by the Village for the May 9th, 2023, hearing, and July 1 lth,
2023 hearing are hereby reserved.
Note that the property remains in non-compliance. The Village reserves the right to impose
fines for each day the violation remains in non-compliance of the original March 14th, 2023, order
finding violation.
Should you violate the same Section of the Code again, you may be subject to a fine of up
to Five Hundred Dollars ($500.00) per day for such repeat violation. Additionally, the Code
Inspector is not required to give a reasonable time to correct the repeat violation and the case may
be presented to the Special Magistrate even if the repeat violation has been corrected prior to the
Special Magistrate hearing.
Upon complying with any code compliance matter, it is always the responsibility of
the Respondents to contact the Code Compliance Division at (561) 768-0519 to request a
reinspection of the property.
