ORDINANCE NO. 08-23, SECOND READING: AN ORDINANCE OF THE VILLAGE COUNCIL OF
THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING THE VILLAGE CODE OF ORDINANCES AT
CHAPTER 78. ZONING. AT SECTION 78-4. DEFINITIONS. TO REVISE THE DEFINITION OF THE
TERM "VETERINARY OFFICE"; PROVIDING THAT EACH AND EVERY OTHER SECTION AND
SUBSECTION OF CHAPTER 78. ZONING. SHALL REMAIN IN FULL FORCE AND EFFECT AS
PREVIOUSLY ADOPTED; PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY CLAUSE AND
AUTHORITY TO CODIFY; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES.
In 2013, the Village adopted Ordinance 15-13, which made veterinary offices a permitted use in the C3
General Commercial Zoning District and added a definition to the Village Code.
On April 13, 2023, the Village Council approved Ordinance 05-23 to allow veterinary offices as a special
exception use in the C-2 Community Commercial Zoning District. At the meeting, Council discussed
revising the existing veterinary office definition to require an outdoor area for post -medical treatment
and potentially removing 24-hour emergency care.
At the May 1, 2023, Village Council Workshop, Council further discussed changing the definition for
veterinary offices to address the outdoor area requirement for post -medical treatment.
On June 15, 2023, the subject ordinance was heard by the Local Planning Agency, which was
recommended for approval by a 5-0 vote.

TEQUESTA, FLORIDA, AMENDING THE VILLAGE CODE OF
ORDINANCES AT CHAPTER 78. ZONING. AT SECTION 78-4.
DEFINITIONS. TO REVISE THE DEFINITION OF THE TERM
"VETERINARY OFFICE"; PROVIDING THAT EACH AND EVERY
OTHER SECTION AND SUB -SECTION OF CHAPTER 78. ZONING.
SHALL REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY
ADOPTED; PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY
CLAUSE AND AUTHORITY TO CODIFY; PROVIDING AN EFFECTIVE
DATE; AND FOR OTHER PURPOSES.
WHEREAS, the current definition of the term "veterinary office" allows for 24-
hour emergency care and further provides that outdoor areas may be provided to the
rear of the facility for walking animals receiving treatment at the facility; and
WHEREAS, the Village Council desires to revise the definition by requiring the
outdoor area to be adjacent to the building and on the same lot but not necessarily to
the rear of the building, and eliminate the provision for 24-hour emergency care; and
WHEREAS, the Village Council believes the code amendment contained in this
ordinance will be in the best interests of the citizens of the Village of Tequesta.
NOW THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1: Chapter 78. Zoning. of the Code of Ordinances of the Village of
Tequesta is hereby amended at Article I. In General. by amending Section 78-4.
Definitions. to revise the definition for the term "Veterinary office"; providing that Section
78-4 shall hereafter read as follows:
Sec. 78-4. Definitions.
The following words, terms and phrases, when used in this chapter, unless
otherwise specified, shall have the meanings ascribed to them in this section, except
where the context clearly indicates a different meaning. All words used in the present
tense include the future; all words in the singular number include the plural and the

plural the singular. The word "building" includes the word "structure." The word "shall" is
mandatory. The word "person" includes a firm, corporation or municipal corporation as
well as a natural person. The word "map" shall mean the official zoning map of the
village. The term "council" shall mean the Council of the Village of Tequesta and the
word "village" shall mean the Village of Tequesta, a municipal corporation of the State
of Florida. The word "used" shall be deemed to include the words "arranged, designed
or intended to be used," and the word "occupied" shall be deemed to include the words
"arranged, designed or intended to be occupied." Any word or term not interpreted or
defined by this section shall be used with a meaning of common or standard utilization.
Veterinary office means a state licensed facility for the medical and/or surgical
treatment and care of animals. Such facilities may include 24-heur emeFgeRn" nano
and/er animal boarding associated with medical or surgical treatment; however, any
such boarding must occur inside the facility. General boarding that is not associated
with medical or surgical treatment is prohibited. Veterinary offices may include an
outdoor area to the of the faGility for the walking of dogs or other animals receiving
medical or surgical treatment at the facility. Any such outdoor area must be located on
the same lot or parcel as the veterinary office and adjacent to the buildina.
[All other definitions shall remain the same as previously adopted.]
Section 2: Each and every other section and subsection of Chapter 78.
Zoning. shall remain in full force and effect as previously adopted.
Section 3: All ordinances or parts of ordinances in conflict be and the same
are hereby repealed.
Section 4: Should any section or provision of this Ordinance or any portion
thereof, any paragraph, sentence or word be declared by a court of competent
jurisdiction to be invalid, such decision shall not affect the validity of the remainder of
this Ordinance.
Section 5: Specific authority is hereby granted to codify this Ordinance.
Section 6: This Ordinance shall take effect immediately upon adoption.
