Subject : Tequesta Oaks Residential Development; Clarification
of On-street Parking Restrictions; Agenda Item
In regard to the Tequesta Oaks Residential Project approved by
the Village Council at your Special Meeting on July 2, I have
discovered a misunderstanding relative to parking which, in my
opinion, warrants attention by the Village Council . As you know,
I have felt that parking, within the residential portion of the
mixed-use proposal, would become problematic when people try to
conduct their activities with a no parking ban imposed upon the
residential streets directly in front of the entrance to their
townhome.
I have discovered that Village staff requested DiVosta officials
to delete all on-street parking from in front of the townhomes in
order to allow for adequate ingress and egress of public safety
vehicles, particularly fire trucks in the residential areas .
Unfortunately, DiVosta officials took this to mean that Village
staff desired no on-street parking throughout the residential
development . This was not the case . In fact, on the afternoon
prior to your July 2 Special Meeting to review the project, the
Building Official assured me that on-street parking was being
provided on the main north-south roadway known as Tequesta Oaks
Drive since he was of the belief that DiVosta officials had only
eliminated the same directly on the residential streets .
Subsequent to the July 2 meeting wherein the Village Council
approved the project, I discovered this misunderstanding by
questioning staff about what I perceived to be a parking problem
that is greater than merely a shortage of spaces , but also places
the Tequesta Police Department in the unenviable position of
being the "bad guy" by ticketing and/or towing vehicles
throughout this new community on a regular basis . The answer to
the problem is additional parking spaces being provided as a
"relief valve" within the residential project .
Bill Shannon, General Counsel for the DiVosta Corporation, called
me on July 12 to inquire about my concerns expressed at the
Special Meeting relative to parking. It was in this conversation
that we both discovered that each organization (Village and
DiVosta) was desirous of having additional parking. DiVosta
officials simply followed Village staff directions as they
understood them, to delete on-street parking throughout the
community.

Therefore, to solve this problem, on-street parking is being
proposed for Tequesta Oaks Drive, the main north-south street
within the community, to enable visitors to have an adequate
place to park when visiting residents of Tequesta Oaks . DiVosta
officials desire this parking to be provided and I concur with
the same.
On-street parking on Tequesta Oaks Drive will provide
approximately 30-40 additional parking spaces within the
community, provide a buffer between pedestrians and vehicular
traffic on Tequesta Oaks Drive and provide a calming effect on
north-south traffic traversing on Tequesta Oaks Drive where the
heavily landscaped canopy being proposed by DiVosta will be
maintained.
A sketch of the on-street parking proposal for your review and
approval, pursuant to Section VIIIA, (8) of the Zoning Ordinance
which allows on-street parking upon review and approval by the
Village Council, will be provided to you by separate cover prior
to the Village Council meeting on August 8 .
It is recommended that the Village Council approve this parking
scheme for the reasons stated herein enabling this issue to be
put to rest allowing DiVosta officials to complete engineering
plans necessary for the construction of Tequesta Oaks .

Site Plan Revision
Dear Scott:
Pursuant to our telephone conference of earlier today, enclosed are fifteen (15) copies
of revised Site Development plans, Landscape plans and Preliminary Engineering plans
for the Tequesta Oaks residential development. The revised plans include the addition
of parallel parking spaces along the main entrance road within the residential portion of
the development. Additionally, a minor modification to the location of the restaurant
building located on the south portion of the site has been made to accomodate height
engineering as well as operational considerations.
One set of reduced 11" X 17" site and landscape plans are included for your
convenience. Should there be any additional information required by the Village, please
do not hesitate to contact me.
