BACKGROUND In 1979, the Tequesta Fashion Mall constructed its plaza at 150 N. US Highway 1. Currently, the plaza includes various commercial uses such as Oceana Coffee, Tide & Table Furniture Store, Evo Italian, Puritan Dry Cleaners, Diabetic Health Agency, and others. In July 2023, the current property owner (Tequesta Mall LLC) submitted a site plan modification to change the aesthetics of the plaza including building colors, roof materials (of covered walkways), and replacing the existing covered walkway. Subsequently, in August 2023, the Village received an application for a Special Exception Use for the proposed modifications at the Fashion Mall. On August 17,2023, the Planning & Zoning Board recommended approval of the site plan review application by 5-0 vote, with the following condition: 1. The Applicant shall receive special exception use approval by the Village Council prior to the final approval of the site plan modification application. STAFF ANALYSIS Section 78-361 of the Village Code states that certain uses because their unique characteristics cannot be classified or regulated in a particular zoning district without consideration in each case of the impact of such uses upon neighboring uses and the surrounding area, compared with the public need for them at particular locations. Such uses and features are treated as special exceptions, and the application needs to comply with a set of criteria and standards. 2 Page 593 of 675 Agenda Item #20. The Applicant is requesting to special exception use approval for a Shopping Center in the M-U Zoning District. Per Village Code Sec. 78-180, Shopping Centers are a special exception use in the M-U Zoning District. The subject property was constructed in 1979. In addition, in July 2023, the applicant submitted a site plan modification to change the exterior building colors to Sherwin Williams SW-6385 and Sherwin Williams SW-7030 Anew Gray. The application also includes the replacement of the existing covered walkways (columns, beams, joists, decking & roof finish). The existing concrete tile roof of the covered walkways will be replaced with a seam metal roof in Metal Alliance Dark Bronze. The building's existing flat roof will remain. The Applicant is proposing the following colors and material changes: • Sherwin Williams SW-6385 Dove White (Field Color) • Sherwin Williams SW-7030 Anew Gray (Trim Color) • Metal Alliance Dark Bronze (Seam Metal Roof Color) The proposed modifications will not alter the aesthetics of the existing building in the outparcel (130 N US Highway 1), it will be solely for the three (3) attached buildings on the subject site. There are no changes to the footprint of the building, open space, or building height. All the existine site reauirements will remain. On August 17,2023, the Planning & Zoning Board recommended approval of the site plan review application by 5-0 vote, with the following condition: 1. The Applicant shall receive special exception use approval by the Village Council prior to the final approval of the site plan modification application. Per the Village Code, once the Special Exception Use is approved by the Village Council; then, the subject application is required to be reviewed under the Site Plan Review process. The Site Plan Review process includes compliance with Article IX, Division 2, Site Plan Review. In addition, the subject application will be heard by the Planning and Zoning Board and Village Council. The Site Plan Review process includes compliance with zoning code, aesthetics considerations, and overall compatibility with the surrounding. CRITERIA FOR GRANTING SPECIAL EXCEPTION Per Section 78-362 of Village Code, special exception use shall be permitted only upon authorization of the Village Council if such uses comply with the following requirements: 1. The proposed use is a permitted special exception use. In compliance with Section 78-180 (i) (17) Shopping Centers are permitted in Mixed Use (M-U) of the Village of Tequesta Code of Ordinances. 2. The use is so designated, located and proposed to be operated so that the public health, safety, welfare and morals will be protected. The subject property (Fashion Mall) was constructed in 1979. The Applicant is proposing to make modifications to the building aesthetics and improve the existing walkway on the property. The proposed changes will not impact the safety of the property, and it will improve the aesthetics of the plaza. 3 Page 594 of 675 Agenda Item #20. 3. The use will not cause substantial injury to the value of other property in the neighborhood where it is to be located. The existing use of "Shopping Center" will not cause substantial injury to property values in the neighborhood. The subject property (Fashion Mall) was constructed in 1979. The subject application includes changes to the building aesthetics and replacing the walkway. 4. The use will be compatible with adjoining development and the proposed character of the district where it is to be located. The existing use of "Shopping Center" is compatible with the surrounding uses within the district and the corridor. The Fashion Mall Shopping Center is one of four (4) major shopping centers in the Village of Tequesta, which are all located on the US Highway 1 Corridor. 5. Adequate landscaping and screening is provided as required in this chapter. The special exception request for Fashion Mall includes aesthetic modifications to the existing building. The Shopping Center was constructed in 1979 and is not altering the existing landscaping or screening of the plaza. 6. Adequate off-street parking and loading is provided and ingress and egress is so designed as to cause minimum interference with traffic on abutting streets. The subject property currently has 172 parking spaces and is proposing no change to the existing number of parking spaces. The Shopping Center is requesting aesthetic modifications to the existing building. FINDINGS REQUIRED FOR APPROVAL Per Section 78-364 of Village Code, before any special exception is granted, the Village Council shall apply the standards set forth in this division and shall determine that satisfactory provision and arrangement of the following factors have been met with the Applicant, where applicable: 1. Compliance with all elements of the Village Comprehensive Plan The subject property is located in the mixed -use future land use district. The special exception use (Shopping Center) complies with Policy 1.1.2 "The Village's Land Development Regulations shall conform to, and implement, the use, density, and intensity standards as outlined in Table FLU-1" 2. Ingress and egress to property and proposed structures thereon with particular reference to automotive and pedestrian safety and convenience, traffic flow and control, and access in case of fire or catastrophe. The subject property has been in the Village of Tequesta since 1979. The proposed modification to the existing special exception use (Shopping Center) does not include any changes to the ingress or egress of the property. 3. Off-street parking and loading area, where required, with particular attention to the items in subsection (2) of this section. 4 Page 595 of 675 Agenda Item #20. The subject property currently has 172 parking spaces and is proposing no change to the existing number of parking spaces. The Shopping Center is requesting aesthetic modifications to the existing building. 4. Nuisance factors detrimental to adjacent and nearby properties and the village as a whole. Nuisance factors shall include but necessarily be limited to noise, odor, smoke, glare, electrical interference and/or mechanical vibrations. The Fashion Mall has been in the Village of Tequesta since 1979. The proposed modifications to the existing special exception use (Shopping Center) will not create nuisance factors detrimental adjacent and nearby properties and the village as a whole. S. Utilities, with reference to location, availability and compatibility. The Fashion Mall has been in the Village of Tequesta since 1979. The proposed modifications to the existing special exception use (Shopping Center) will not affect the existing availability or compatibility of utilities. 6. Screening and buffering, with reference, to type, dimensions and character. The special exception request for Fashion Mall includes aesthetic modifications to the existing building. The Shopping Center was constructed in 1979, and the current application is not altering the existing landscaping or screening of the plaza. 7. General compatibility with adjacent properties and other property in the district. The subject property has been located in the Village since 1979. The existing use of "Shopping Center" is compatible with the surrounding uses within the district and the corridor. The Fashion Mall Shopping Center is one of four (4) major shopping centers in the Village of Tequesta, which are all located on the US Highway 1 Corridor. 8. Whether the change subjected is out of scale with the needs for the neighborhood or Village. The subject property has been in the Village since 1979. The existing use of "Shopping Center" is not out of scale with the needs for the neighborhood or the Village. 9. Any special requirements set out in the schedule of site regulations in 78-143 for the particular use involved. The subject application will comply with the site regulations of Section 78-143. 4. FINAL REMARKS This subject Special Exception Use application met the requirements set on Section 78-368 notice of hearing. The notice of hearing was be advertised in the Palm Beach Post on September 1, 2023. The notice of hearing was mailed to all property owners located within a 300-foot radius of the subject property (see attached). Per Code Section 78-367, a special exception shall commence within 12 months from approval date and only one extension shall be permitted by the Village Council up to six months. 5 Page 596 of 675 Agenda Item #20. The Village Council meeting will be held in the Village Council Chambers at Village Hall located at 345 Tequesta Drive, Tequesta, FL 33469. Residents will also be able to watch the meeting live via the Village's YouTube Channel (https://bit.ly/VOTYoutube). AND DUE TO POORLY MAINTAINED WOOD MATERIALS USED TO CONSTRUCT THE EXISTING COVERED WALKWAYS, UPDATING THE WALKWAY ROOFING MATERIAL WILL INVOLVE RECONSTRUCTION OF THE EXISTING COVERED WALKWAYS (FURTHER DESCRIPTION BELOW). THE FASHION MALL WAS PURCHASED BY THE FERREIRA GROUP IN 2018, AND THEIR FOCUS HAS BEEN ON HOW BEST TO UPDATE THE EXTERIOR AESTHETICS WITHIN A REALISTIC BUDGET, AND WITH MINIMUM DISRUPTION TO THEIR TENANTS. THE BUILDINGS AND ATTACHED COVERED WALKWAYS ARE CLEAN RECTALINEAR SHAPES WHOSE MASSING LENDS TO UPDATING THE EXTERIOR LOOK VIA A NEW COLOR SCHEME. AND IN LOOKING AT AN UPDATED COLOR SCHEME THE DECISION WAS MADE TO UPGRADE THE PITCHED ROOFS OF THE COVERED WALKWAYS WITH A PREFINISHED METAL ROOF. IN ANALYZING THE OVERALL CONDITION OF THE BUILDINGS, IT WAS DETERMINED THAT THE ROOFS OF THE WOOD CONSTRUCTED COVERED WALKWAYS, WHICH HAD LEAKED AND HAD BEEN POORLY PATCHED OVER THE YEARS, WOULD NEED SIGNIFICANT REPAIRS AS PART OF THE RE- ROOFING. ESTIMATES INDICATED THAT THE COST TO REPAIR THE COVERED WALKWAYS TO RECEIVE THE NEW METAL ROOF WOULD NOT BE SIGNIFICANTLY LESS THAN TO REMOVE THE WOOD DECKING & JOISTS AND STUCCO COVERED WOOD BEAMS & COLUMNS, AND REPLACING THESE WITH NEW CONSTRUCTION (USING TRUSSES & STUCCO IN LIEU OF THE MORE VULNURABLE OPEN WOOD JOISTS & DECKING). FOR THIS REASON THE REPLACEMENT OF THE WALKWAYS WITH NEW MATERALS OF SIMILAR OUTWARD APPEARANCE IS PROPOSED. (2) The use is so designed, located and proposed to be operated so that the public health, safety, welfare and morals will be protected. Response: The reconstruction of the covered walkway will result in increased public health, safety and welfare. (3) The use will not cause substantial injury to the value of other property in the neighborhood where it is to be located. Response: The new color scheme and materials of the reconstructed covered walkways will increase the value of other properties in the neighborhood. (4) The use will be compatible with adjoining development and the proposed character of the district where it is to be located. Response: The existinq Shopping Center was previously approved and the updated materials and color scheme of the reconstructed covered walkways will harmonize with adjoining and new development in the area.
