HomeMy WebLinkAboutOrdinance_335_2/25/1986 • ORDINANCE NO. 335 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AMENDING CHAPTER 6 OF ITS CODE OF ORDINANCES RELATING TO BUILDINGS AND BUILDING REGULATIONS SO AS TO ADOPT THE COASTAL BUILDING CODE AS RECOMMENDED BY THE STATE OF FLORIDA, DEPARTMENT OF COMMUNITY II AFFAIRS, AND SO AS TO MEET THE REQUIREMENTS OF THE STATE OF FLORIDA "COASTAL ZONE PROTECTION ACT OF 1985" ; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, as follows: Section 1. Chapter 6 of the Code of Ordinances relating to Buildings and Building Regulations is hereby amended at Article II thereof so as to provide for inclusion therein the following: "Sec. 6-23. Same - Coastal Building Code Adopted. The Coastal Building Code, as recommended by the State of Florida, Department of Community Affairs, and meeting the requirements of the State of Florida, "Coastal Zone Protection Act of 1985" , is hereby adopted and incorporated herein as fully as if set forth at length herein. In the event that a conflict exists between the Coastal Building Code and the Federal Emergency Management Agency Requirements as adopted by the Village of Tequesta, the more stringent requirements shall apply. " Section 2. The remaining sections of Chapter 6 , Article II, shall be renumbered consecutively following this a new Section 6-23. Section 3. If any provision of this Ordinance or f11 the application thereof is held invalid, such invalidity shall I not affect the other provisions or applications of this Ordinance I which can be given effect without the invalid provisions or applications and to this end the provisions of this Ordinance I are hereby declared severable. Section 4. This Ordinance shall be codified and I made a part of the official Code of Ordinances of the Village of Tequesta, Florida. a Section 5. This Ordinance shall take effect immediately upon its passage and approval, as provided by law. THE FOREGOING ORDINANCE was offered by Councilmember Murphy , who moved its adoption. The Ordinance was seconded by Councilmember Gemino , and upon being put to a vote, the vote was as follows: FOR ADOPTION AGAINST ADOPTION Gemino, Jill K. Howell. Edward C. Murphy. Arthur R. Nelson.
