Governor Secretary February 14 , 1986 MEMORANDUM TO: Local Government Officials FROM: Department of Community Affairs Office of Coastal Programs SUBJECT: Address for Submitting Coastal Construction Code for Review The Coastal Zone Protection Act of 1985 mandated new rigorous construction requirements along Florida ' s coastline. Each local government or licensing board is required by the Act to amend its building code to reflect these new construction standards. Florida statutes Chapter 161. 56 (2) states, "Each local government shall provide evidence to the state land planning agency that they have adopted a building code pursuant to this section. Ladd, Building Official DATE: January 22, 1986 SUBJECT: Adoption of Model Coastal Construction Code and Creation of Coastal Building Zone. 1 . In the Tequesta Code of Ordinances, Chapter 6, Buildings and Building Regulations, Article II . Buildings, add new Sec. 6-23 as follows: Sec. 6-23. Same - Coastal Building Code Adopted. The Coastal Building Code, as recommended by the State of Florida, Department of Community Affairs, and meeting the requirements of the State of Florida, "Coastal Zone Protection Act of 7.985" , is hereby adopted and incorporated herein as fully as if set forth at length herein. (Ord. No. , Date) 2. Change existing Sec. 6-23. Fire limits designated to Sec. 6-24. Fire limits designated. 3. Renumber remaining sections to track these changes. 4. Create an ordinance adopting a coastal building code and creating a coastal building zone. A. Coastal building code to be as submitted by the Department of Community Affairs but adding a notation that when a conflict exists between the Federal Emergency Management Agency requirements as adopted by the Village of Tequesta and the Coastal Building Code requirements, the more stringent requirements will apply. B. For creation of a Coastal Building Zone, see item 5 below. 5. In the Tequesta Comprehensive Zoning Code, Ord. No. 319, Section XV. Flood Hazard Areas, (B) , Flood Hazard Areas Created, add new paragraph (2) as follows: (B) Flood Hazard Areas Created. (1) No change. (2) There is hereby created within the Village of Tequesta, Florida, a Coastal Building Zone, as defined in Sec. 161.54(1) , Florida Statutes. Such Coastal Building Zone shall encompass all lands within the Village of Tequesta designated as "coastal barrier island" , as defined in Sec. 161.54(2) , Florida Statutes, and as shown on the official compre- hensive zoning map of the Village of Tequesta, Florida. Drawer M West Palm Beach, Florida 33402 Dear Skip: Re: Coastal Building Zone and Building Code Requirements Enclosed for your information and further necessary action is a copy of the January 10, 1986 Memorandum from the State of Florida, Department of Community Affairs, including a copy of a Model Coastal Construction Code. You will note the Memorandum again reiterates that the adoption of the Code and Coastal Building Zone must be made prior to March 1, 1986. As you are aware, sanctions can be imposed by the Administration Commission pursuant to Section 163.3184 (8) F.S. if the State Land Planning Agency has not been advisedlof such adoption. As you are aware, the Village Election is Tuesday, March 11, 1986 and therefore, there are only three more meetings, January 28, February 11 and February 25, 1986 for the present Councilmembers, We presume this Coastal Construction Code would become a part of Chapter 6 - Buildings and Building Regulations of the Village Code. We must also delineate the geographic boundary of the Coastal Building Zone for the Village. Scott Ladd will be in touch with you in regard to this matter and we trust you will have an Ordinance prepared for first reading at the January 28, 1986 Council Meeting. Governor Secretary January 10 , 1986 cb MEMORANDUM /TO: Local Government FROM: Tom Lewis, Jr , ecretar y rr SUBJECT: Model Coastal Construction Code \� In November I distributed a memorandum to all coastal local governments explaining the provisions of the "Coastal Zone Protection Act of 1985 . " At that time I indicated that the Department was attempting to develop language to implement those provisions and to subsequently adopt such language by rule. The Department has developed a model coastal construction code which fulfills the requirements of the new law, a copy of which is enclosed. However, given the length of time required for rulemaking procedures, the Department is unable to adopt the code as a rule before the statutory March 1, 1986 deadline. For that reason, the Department is not proceeding with rulemaking activities. Accordingly, each affected local government must adopt its own coastal building code prior to March 1, 1986 . I recommend that you adopt the enclosed model code and the Coastal Building Zone defined therein as it applies to your geographic location. The enclosed model code is the product of a working group comprised of engineering, architectural , and construction interests, local government interests, commercial interests, state agencies, environmental interests, and others. A copy of the working group membership list is attached hereto. The language in the code represents considerable deliberation by the working group in arriving at a mutually acceptable and realistic final version. EMERGENCY MANAGEMENT • HOUSING AND COMMUNITY DEVELOPMENT • RESOURCE PLANNING AND MANAGEMENT . r Memorandum Page Two Although the Coastal Zone Protection Act of 1985 may undergo some slight revision in the upcoming Legislative session, the enclosed model code is the embodiment of the best implementation of the Act at this time for all concerned interests.
