Address: 1 Pine Hill Trail W Tequesta, Florida 33469-0273 Legal Description: TEQUESTA PINES LT 86 (LESS NELY TRGLE PAR IN OR7868P892 PCN: 60-42-40-25-25-000-0861 The Special Magistrate appointed by the Village Council to hear code compliance cases for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard testimony at the Code Compliance Special Magistrate Hearing held on the 1311 day of September 2023, and based on the evidence and testimony presented, enters this Order Assessing Fine. The following Findings of Fact, Conclusions of Law, and Order are hereby entered: FINDINGS OF FACT The Respondents are the owners of the above -described property. 2. The Respondents were present at the hearing; there was a finding of proper notice. Page 1 of 3 3. Code Officer Latoya Thompson provided testimony and evidence of the violation, as contained in the Village's evidentiary case file which was accepted into evidence without objection. 4. By the "Order Finding Violation" dated March 1411, 2023, the Special Magistrate ordered the Respondents to comply with Chapter 14, Article II, Section 14-31, Chapter 14, Article 1, Section 14-6, of the Code of Ordinances of the Village of Tequesta and Section 105.1 of the Florida Building Code (Seventh Edition) by May 91h, 2023. 5. This case was reset during the May 9", 2023, and .July 11", 2023, special magistrate hearings to ultimately appear at the September 13", 2023, hearing. 4. Based upon the evidence, pictures, and testimony presented at the hearing on September 131h, 2023, the property has obtained compliance with Chapter 14, Article II, Section 14-31, Chapter 14, Article I, Section 14-6, of the Code of Ordinances of the Village of Tequesta and Section 105.1 of the Florida Building Code (Seventh Edition). CONCLUSIONS OF LAW The property is now in compliance with Chapter 14, Article II, Section 14-31, Chapter 14, Article I, Section 14-6, of the Code of Ordinances of the Village of Tequesta and Section 105.1 of the Florida Building Code (Seventh Edition). ORDER The respondent's outstanding fine is hereby reduced and assessed as a one-time cost of five hundred dollars ($500.00). Should you violate the same Section of the Code again, you may be subject to a fine of up to Five Hundred Dollars ($500.00) per day for such repeat violation. Additionally, the Code Inspector is not required to give a reasonable time to correct the repeat violation and the case may be presented to the Special Magistrate even if the repeat violation has been corrected prior to the Special Magistrate hearing. Upon complying with any code compliance matter, it is always the responsibility of the Respondents to contact the Code Compliance Division at (561) 768-0519 to request a reinspection of the property.
