TITLE
Consider Approval of Kimley Horn and Associates Work Authorization for RO Concentrate Main Conflict
Engineering Services Related to the FDOT US1 Bridge, Not to Exceed $32,250
SUMMARY:
The Utilities Department (UD or Utilities) recommends approval of a work authorization for engineering
concentrate main and two FDOT stormwater structures within their US1 Bridge Replacement Project.
This was an unanticipated conflict that was not identified by FDOT in the original reviews of the project,
and has to be addressed as soon as possible to avoid delays of the US1 Bridge Replacement Project.
The additional money for the project will come from the Water Fund, Renewal and Replacement budget
division, Account401-411-663.632, Architectural andEngineeringServices. Additional budget
information is immediately below:

VILLAGE OF TEQUESTA
ENGINEERING SERVICES WORK AUTHORIZATION
RO CONCENTRATE MAIN CONFLICT RESOLUTION IN US1 - 12-INCH REJECT MAIN
This Work Authorization authorizes Kimley-Horn and Associates, Inc. to perform work set forth
herein and is issued pursuant to The Professional Engineering Services Agreement, between
the Village of Tequesta (“Client” or “Village”) and Kimley-Horn and Associates, Inc. (“Kimley-
Horn” or “Consultant”), dated May 12, 2016 (“Agreement”). All terms and conditions of said
Agreement are hereby incorporated and made part of this Work Authorization.
PROJECT UNDERSTANDING
The Village owns and maintains a 12-inch PVC/HDPE reverse osmosis (RO) concentrate reject
disposal main (RO reject main) that runs from the water treatment plant (WTP) to the point of
discharge within the Jupiter Inlet. A portion of this main is located within the US1 corridor, south
of Beach Road/A1A that falls within the current Florida Department of Transportation (FDOT)
US1 bridge replacement project. The contractor for the bridge replacement project recently
identified two (2) unanticipated conflicts between the Village’s RO reject main and two 48-inch
FDOT proposed drainage pipe/structures that will be constructed on the east and west side of
US1. The reject main location within the right of way is there by a FDOT permit and is not within
an easement. The permit stipulates that any municipality infrastructure within an FDOT right of
way that will be in direct conflict with any future FDOT work, will need to be relocated at the
municipalities’ expense.
In addition to the above, the existing 12-inch concentrate reject disposal main was modified
approximately 3-years at the Jupiter Cove entrance road due upcoming drainage and elevation
conflicts. At the time, this portion of main was to be abandoned, so ductile iron fittings were
used to save construction costs at the time. Now, this main will be remaining in place, and will
need to have the ductile iron fittings replaced with HDPE fittings to prolong its life. The
Consultant will include the fittings replacement under this project.
The Consultant has met with the FDOT bridge contractors Construction Engineering & Inspector
(CEI) and Village staff to identify the conflicts and to development a plan to address the
drainage conflicts. The Village has determined that they need a design plan to address the
conflicts, assistance in identifying the material needed, a project estimate, and a contractor to
perform the work, along with observing the construction activities. The scope outlined below
addresses this need.
TASK No. 1 SCOPE – DESIGN PLAN REVISIONS
1. Consultant will attend three (3) meetings with Village staff to review the extent of the
design changes and will conduct three (3) field meetings (one with Village staff), and the
others independently to acquire field measurements and locations/orientation of the
existing reject main, proposed drainage and possible route for the new reject main
alignment.

2. Consultant will have their subconsultant, InfraMap, Inc. perform softdigs
(locates/elevations of the conflicts) of the drainage pipe conflict areas and acquire
locates and elevations of the Village’s reject main in the area.
3. Consultant will prepare design plans for the new reject main alignment required to
correct the drainage conflicts and will provide a new test port for WTP staff use.
4. Consultant will prepare design plans for the installation of new fittings at the US1/Jupiter
Cove entrance road.
5. Consultant will coordinate with, and meet with, the bridge contractor CEI regarding the
proposed reject main conflict resolution and will arrange for a joint meeting to acquire
their approval of the proposed design.
6. Consultant will coordinate with FDOT for the work proposed within the US1 right of way.
7. Consultant will prepare an updated bid quantity of material and an updated opinion of
probable construction cost.
8. Consultant will assist the Village in acquiring a contractor to perform the work and will
review the contractors proposed cost and will offer an opinion on a recommendation of
award.
9. Consultant will provide on-site construction observation services as needed to assist in
ensuring the construction is meeting the CEI’s and Consultant’s requirements.
ADDITIONAL SERVICES
Any services not specifically provided for in the above scope, as well as any changes in the
scope requested by the Village, will be considered additional services to this Work Authorization
and will be performed based on subsequent Work Authorizations approved prior to performance
of the additional services.
INFORMATION AND SERVICES PROVIDED BY THE VILLAGE
Kimley-Horn assumes that all information provided by the Village can be relied upon in the
performance of professional services. The following information shall be provided to Kimley-
Horn and/or the following services will be performed by the Village.

PUBLIC RECORDS. In accordance with Sec. 119.0701, CƌƚƩźķğ {ƷğƷǒƷĻƭ, CONTRACTOR must keep
and maintain this Agreement and any other records associated therewith and that are associated
with the performance of the work described in the Proposal or Bid. Upon request from the
requested records, or allow such records to be inspected or copied, within a reasonable time in
accordance with access and cost requirements of Chapter 119, CƌƚƩźķğ {ƷğƷǒƷĻƭ. A CONTRACTOR
who fails to provide the public records to the Village, or fails to make them available for
inspection or copying, wit
pursuant to Sec. 119.0701, CƌƚƩźķğ {ƷğƷǒƷĻƭ, and other penalties under Sec. 119.10, CƌƚƩźķğ
{ƷğƷǒƷĻƭ. Further, CONTRACTOR shall ensure that any exempt or confidential records associated
with this Agreement or associated with the performance of the work described in the Proposal
or Bid are not disclosed except as authorized by law for the duration of the Agreement term, and
following completion of the Agreement if the CONTRACTOR does not transfer the records to the
Village. Finally, upon completion of the Agreement, CONTRACTOR shall transfer, at no cost to
the Village, all public records in possession of the CONTRACTOR, or keep and maintain public
records required by the Village. If the CONTRACTOR transfers all public records to the Village
upon completion of the Agreement, the CONTRACTOR shall destroy any duplicate public records
that are exempt or confidential and exempt from public records disclosure requirements. If the
CONTRACTOR keeps and maintains public records upon completion of the Agreement, the
CONTRACTOR shall meet all applicable requirements for retaining public records. Records that
