MINUTES LOCAL PLANNING AGENCY MEETING VILLAGE OF TEQUESTA, FL September 21, 20235:31 PMEmergency Operations Center (EOC) CALL TO ORDER AND ROLL CALL The meeting was called to order by Board Chair, Janet Strand at 5:31 p.m. A roll call was taken by Associate Planner, McKenna Page. Present were: Board Chair Janet Strand, Board Members Elizabeth Schauer, Leslee Dasher, Sherry Ambrose, Jeanne McEldowney, Marie Sapirie, and Marco Valdez. Absent was: Board Member Teresa Maggio. Also present were Village Attorney, Keith Davis; and Senior Planner, Lance Lilly. APPROVAL OF AGENDA MOTION: Member Schauer made a motion to approve the agenda. Member Dasher seconded the motion. Carried unanimously 5-0. 1.APPROVAL OF MINUTES MOTION: Member Schauer made a motion to approve the previous meeting minutes from July 20, 2023. Member Ambrose seconded the motion. Carried unanimously 5-0. AGENDA ITEMS 2.ORDINANCE NO. 11-23: AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING THE VILLAGE CODE OF ORDINANCES AT CHAPTER 78. ZONING. ARTICLE IX. SUPPLEMENTAL REGULATIONS. DIVISION 4. LANDSCAPING. TO PROVIDE NEW REGULATIONS FOR THE USE, INSTALLATION AND MAINTENANCE OF ARTIFICIAL TURF; PROVIDING THAT EACH AND EVERY OTHER SECTION AND SUBSETION OF CHAPTER 78. ZONING. SHALL REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ADOPTED; PROVIDING A CONFLICTS CAUSE, A SEVERABILITY CLAUSE AND AUTHORITY TO CODIFY; PROVIDING AN EFFECTIVE DATE, AND FOR OTHER PURPOSES. Board Chair Janet Strand introduced Ordinance 11-23. Village Attorney Keith Davis provided a brief background for Ordinance 11-23. He noted that the Ordinance included a definition for artificial turf, a new section for regulations regarding the location of turf, and technical standards for the quality of turf and installation. Page 5 of 40 Agenda Item #1. The Board engaged in discussion on the subject Ordinance and mentioned that inspections on artificial turf should be conducted prior to and after installation. The Board also discussed the difference in artificial turf in residential neighborhoods compared to commercial areas. Member Marie Sapirie provided the Board with her comments regarding the Ordinance. Member Marco Valdez suggested that the Board limit the installation of artificial turf to putting greens and add a stricter limit to using artificial turf as a decorative material. MOTION: Member Schauer made a motion to recommend approval with the modification to limit the use of artificial turf to putting greens and require annual site inspections by local building official or code enforcement officers. Member Dasher seconded the motion. Motion was approved 4-1. 3.ORDINANCE NO. 12-23: AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING THE VILLAGE CODE OF ORDINANCES AT CHAPTER 78. ZONING. ARTICLE VI. IN GENERAL. AT SECTION 78- 4. DEFINITIONS. TO CREATE AN ENTIRELY NEW DEFINITION FOR THE TERM PRIVATE MUSEUM, AT ARTICLE VI. SCHEDULE OF DISTRICT REGULATIONS. AT SECTION 78-178. C-3 GENERAL COMMERCIAL DISTRICT., TO ADD PRIVATE MUSEUM AS A SPECIAL EXCEPTION USE, AND AT ARTICLE X. OFF-STREET AND ON-STREET PARKING AND LOADING REGULATIONS. AT SECTION 78-705. REQUIRED NUMBER OF PARKING SPACES. TO PROVIDE THE NUMBER OF PARKING SPACES REQUIRED FOR THESE ESTABLISHMENTS; PROVIDING THAT EACH AND EVERY OTHER SECTION AND SUBSECTION OF CHAPTER 78. ZONING. SHALL REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ADOPTED; PROVIDING A CONFLICTS CLAUSE; A SEVERABILITY CLAUSE, AND AUTHORITY TO CODIFY; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. Board Chair Strand introduced Ordinance 12-23. Mr. Lilly gave a brief description of the proposed zoning text amendment and introduced the Applicant. The Applicant, Nicole Plunkett from Cotleur and Hearing, presented a PowerPoint for the subject Ordinance. Ms. Plunkett’s presentation discussed the proposed code text amendment to include a Private Museum and the proposed code regulations such as the inclusion of definitions, parking, and other requirements. The Board engaged in discussion on the subject Ordinance. Marie Sapirie commented on the subject Ordinance. MOTION: Member Dasher made a motion to recommend approval of Ordinance 12-23. Member McEldowney seconded the motion. Motion was approved 5-0. STAFF COMMENTS Mr. Lilly thanked the Board for their time and participation. Community Development Director Jeremy Hubsch introduced himself to the Board and shared his excitement to be a part of the staff. Page 6 of 40 Agenda Item #1.
