Re: Request for Waiver from Application Fees for two (2) separate parcels. (Ref. Letter
dated November 27, 2001 to Michael Couzzo from Jeffrey Spear.
Date: December 2001
Per letter dated November 27,2001 (referenced above),Mr. Spear is requesting a waiver of
application fees for land use amendments and zoning requests for two (2) additional parcels
that will be eventually combined with an overall 15.23 acre parcel. The application fee for
comprehensive plan amendment is $5,000.00 and for zoning request is $2,000.00 or a total of
$7,000.00 / parcel. If The Village Council were so inclined to adjust the required application
fees, I feel a reasonable compromise would be to collect for the equivalent of application fees
for at least one (1) of the parcels, or $7,000.00.

Dear Mr. Couzzo:
As you know our company has sppiled to annex a portion of the Rood Nursery Into
the Village of Tequesta end to apply for zoning and site plan approval forth,purpose
of building single family homes. Adjacent to the property is an out parcel lot
(approximately 125' x 120') at the southern end without which we only have •80'
wide entrance off Riverside Drive. For that reason,we have arranged to purchase this
parcel,as well as another parcel (approximately 100'x 125') located slightly NW of
this parcel. These two lots will enable us to add several horrors to our plan,but more
importantly will creates more viable and attractive entrance way and site plan. We
were encouraged to combine these parcels by the Village Staff and the Mayor for this
reason. It*NI also generate more tax revenue to the Village.
Therefore,we wish to request the waiver of the Village fees for the applications of
land use amendment and zoning requests for these 2 additional parcels. Due to
contractual tarn,requirements,we had already processed the land use amendment
end zoning applications for the Rood Nursery including payment of the seven
thousand dollar ($7,000) in fees. While technically these two lots now have to be
processed separately,we feel they are practically part of the same project and that we
should not be required to pay these fees again. We would agree to pay any additional
out of pocket expanses incurred by the Village for this process.•It h highly Improbable
that the request would set a precedent as typically a developer must assemble his
parcels prior to having a feasible application, making this a unique situation.
