HomeMy WebLinkAboutMinutes_Local Planning Agency_6/15/2023 MINUTES LOCAL PLANNING AGENCY MEETING VILLAGE OF TEQUESTA, FL June 15, 2023 5:30 PM COUNCIL CHAMBERS CALL TO ORDER AND ROLL CALL The meeting was called to order by Board Chair, Janet Strand at 5:30 p.m. A roll call was taken by Associate Planner, McKenna Page. Present were: Board Chair Janet Strand, Vice-Chair Steven Eagen, Board Members, Leslee Dasher, Theresa Maggio, Sherry Ambrose, Jeanne McEldowney, and Marie Sapirie. Absent was: Elizabeth Schauer. Also present were Village Attorney, Dylan Brandenburg; and Senior Planner, Lance Lilly. APPROVAL OF AGENDA MOTION: Member Dasher made a motion to approve the agenda. Vice-Chair Eagen seconded the motion. Carried unanimously 5-0. APPROVAL OF MINUTES MOTION:Vice-Chair Eagen made a motion to approve the previous meeting minutes from March 16, 2023. Member Maggio seconded the motion. Carried unanimously 5-0. AGENDA ITEMS ORDINANCE NO. 04-23:AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING THE VILLAGE CODE OF ORDINANCES AT CHAPTER 10. ANIMALS., ARTICLE Ill. SEA TURTLE PROTECTION., BY REPEALING THIS ARTICLE IN ITS ENTIRETY AND ADOPTING A NEW ARTICLE III. SEA TURTLE PROTECTION. WITH FINDINGS OF FACT, DEFINITIONS, REGULATIONS, AND ENFORCEMENT PROVISIONS THAT ARE CONSISTENT WITH THE STATE OF FLORIDA MODEL SEA TURTLE PROTECTION ORDINANCE AND THE PALM BEACH COUNTY SEA TURTLE PROTECTION ORDINANCE; PROVIDING THAT EACH AND EVERY OTHER SECTION AND SUBSECTION OF CHAPTER 10. ANIMALS. SHALL REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ADOPTED; PROVIDING A CONFLICTS CLAUSE, SEVERABILITY CLAUSE, AND AUTHORITY TO CODIFY, PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. Senior Planner Lance Lilly provided a brief background of the proposed sea turtle protection ordinance. Mr. Lilly introduced Ms. Lynne Britt, Building Support Administrator, who showed the Board a four- minute video about sea turtles and artificial light. After the video, Vice-Chair Eagen requested that Ms. Britt provide a brief explanation for the subject Ordinance. Ms. Britt explained the Florida Fish and Wildlife Conservation (FWC) established lighting guidelines for residents living near sea turtle nesting beaches. She continued that the proposed ordinance provided regulations for sea turtle lighting within the R-3 district. Marie Sapirie, Village resident, commented on the importance of the Ordinance. She believed that the Ordinance required additional consideration and voiced her concerns about various provisions in the proposal. Thomas Bradford, Village resident, expressed the need for the proposed Ordinance. However, Mr. Bradford commented on the location of the definitions section of the ordinance, the name of the Zoning District, and the hiring of a permanent employee rather than contracting the enforcement. Member Dasher commented that she believed the ordinance needed to be revised based on the previous comments from the public. Ms. Britt explained that mechanical beach cleaning is not conducted by the Village, rather it is done and reviewed by the Florida Department of Environmental Protection (FDEP). She also explained that the Village's Code Enforcement Department would be tasked with inspecting beach lighting and that it would not be a new position. Member Ambrose questioned whether the Village would need to abide by the County's Ordinance if the proposed Ordinance is not approved. Ms. Britt responded that the Village would be subject to the County if the Ordinance was not approved. Member Ambrose stated that she did not believe Tequesta residents should be subject to the County's Ordinance. Vice-Chair Eagen requested clarification on whether the Town of Palm Beach has enforcement on their beaches. Mr. Bradford explained that the enforcement is contracted rather than a permanent Village employee. Mr. Bradford continued that the applicability of the Ordinance should be tailored to the R-3 district not village wide. Member Dasher commented that a special event not located in the R-3 district with large flashing lights that could be seen from the beach is why the description of the ordinance includes lighting within the entire village. Ms. Britt confirmed that any proposed lighting for a special event would be reviewed by the Village. MOTION: Member Ambrose made a motion to recommend the approval of Ordinance 04-23, with conditions to specify that the Ordinance pertains to only the R-3 zoning district and to have the definitions moved to the front. Member Dasher seconded the motion. Carried unanimously 5-0. ORDINANCE NO. 08-23:AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING THE VILLAGE CODE OF ORDINANCES AT CHAPTER 78. ZONING. AT SECTION 78-4. DEFINITIONS. TO REVISE THE DEFINITION OF THE TERM "VETERINARY OFFICE", PROVIDING THAT EACH AND EVERY OTHER SECTION AND SUB-SECTION OF CHAPTER 78. ZONING. SHALL REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ADOPTED; PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY CLAUSE AND AUTHORITY TO CODIFY, PROVIDING AN EFFECTIVE DATE, AND FOR OTHER PURPOSES. Senior Planner Lance Lilly provided a brief explanation of the proposed Ordinance 08-23. Mr. Lilly explained that at the May 15t Village Council Workshop, it was discussed that the existing definitions for veterinary offices be revised to address post-surgical treatment. Ms. Sapirie commented that she believed the outdoor area should be required for veterinary offices. Mr. Lilly explained to the Board that the Village Council discussed whether the proposed definition should require a post-medical treatment area. He mentioned that the Council preferred keeping the word may rather than making it a requirement. MOTION: Board Member Dasher made a motion to recommend approval of ordinance number 08-23. Board Member Maggio seconded the motion. Carried unanimously 5-0. STAFF COMMENTS There was no Staff comment. PUBLIC COMMENTS There was no Public comment. BOARD COMMENTS There was no Board comment. ADJOURNMENT MOTION: Member Ambrose made a motion to adjourn at 6:00 pm. Member Maggio seconded the motion. Carried unanimously 5-0.
