Tequesta Village Center Swap of Parcel No. 1 and Parcel No.2 Our File No. 13153.1 Dear Chief Allison, Mike Couzm,before he left on vacation.passed ue to me the terms that JMZ indicated to him would be acceptable in regard to going forward withtbo swap relating to the above referenced trazrisacdon. Because JMZ failed to close pursuant to the terms of the agreement between the Village and JMZ, these proposals, if approved by the Village, would necessitate amendments to the existing agreement It is my understanding that this matter will be considered by the Village Council at its meeting of July 12,2001. These terms as they were related to me are as follows: 1. The swap will go forward and the Village will be given 18 months from the date of the swap TO build and in the event they do not build in that time JMZ buys the property back. 2_ The amount of the buyback is the purchase price less 10%. 3. The Village,at its option,during any time during the 18 month period can exercise its option for the buyback with 60 days notice to JMZ. 4.
