Village of Tequesta 345 Tequesta Drive 561-768-0700 Tequesta, FL 33469 www.tequesta.org r� To: Mayor Molly Young and Village Council From: Lynne Britt, Building Support Administrator Date: September 11, 2023 Re: Discussion of Use of Village Property by Outside Agency for Police/Fire Training The purpose of the attached draft ordinance language, regarding the use of Village property by any outside agency for police and/or fire training, is to ensure the welfare and safety of Village residents and limit the liability of the Village. The draft language provides requirements for any outside agency wishing to utilize available property within the Village for police and/or fire training, similar to the requirements for special event permits. A separate ordinance is required because such training events would not fall under the definition of special event permit (i.e., (h)Definition. For purposes of this section, a "special event"is any outdoor activity, gathering or group of persons, vehicles or both, organized and having a common purpose, upon public or private property, which is likely to inhibit the usual flow of vehicular or pedestrian traffic, which is likely to creates noise in excess of that typically associated with the areas upon which the event is to occur, or which is likely to preempt or restrict use of property typically accessible by the general public. Examples of special events include, but are not limited to block parties, parades, races or walks, grand opening events, charity fundraisers, and other similar events not specifically permitted by the village's zoning ordinance). CHAPTER 78.—ZONING ARTICLE IX.SUPPLEMENTAL REGULATIONS SEC. 78-562 USE OF PROPERTY WITHIN THE VILLAGE FOR OUTSIDE AGENCY POLICE AND FIRE TRAINING ARTICLE IX. SEC. 78-562. TEMPORARY USE OF PROPERTY WITHIN THE VILLAGE FOR OUTSIDE AGENCY POLICE AND FIRE TRAINING Sec. 78-562. Temporary Use Permit Application. (a) When a government agency other than a Village of Tequesta department desires to utilize an available property for law enforcement and/or fire rescue training, prior to demolition or otherwise, a temporary use permit application shall be submitted and must be approved by the Village of Tequesta prior to mobilization for or commencement of any such training activities. (b) Written application. The temporary use permit application shall be in writing and shall be submitted to the Village Building Department. The written application must contain the following information: (1) The training activity proposed. (2) The person responsible for the training activity/point of contact with the Village of Tequesta. (3) The qualifications held by the person responsible for the training activity. (4) The address,and written consent of the property owner where the training activity will occur. (5) The requested date, commencement time and duration of the training activity. (6) The approximate number of people who will participate in the training activity. (7) Proof of liability insurance in the amount of$1 million naming the Village of Tequesta as an additional insured for the training activity. (8) Any expected traffic, fire-rescue, and utilities impact that will be caused by the training activity, and the proposed mitigation plans. (9) Copies of all required state and county permits if the training activity will occur on,or otherwise utilize, state and/or county-controlled property. (c) Submittal deadline. In order to provide sufficient time for full administrative review,complete temporary use permit applications shall be submitted to the Village Building Department no less than fifteen (15) business days prior to the date for which the temporary training activity is proposed. (d) Minimum impact. All training activities applied for as required by this section shall be coordinated with the Village in order to mitigate adverse impacts and allow for continuous protection of the health,safety and welfare of all. In order to provide such protections, application review shall be required from the Village of Tequesta Building Official, Police Chief, and Fire Chief. Review by other Village of Tequesta department heads may be required on a case-by-case basis. (e) Final action. (1) Following review from the Village of Tequesta Building Official, Police Chief, and Fire Chief, the application, along with review comments and recommendations, if any, shall be provided to the Village Manager for final action. The Village Manager shall approve the application, deny the application in whole or in part; or approve the application with conditions. (2) Denial of a temporary training use permit application, or the imposition of conditions by the Village Manager may be based,among other reasons and at the sole discretion of the Village,upon violations of the terms and conditions of a previously approved temporary training use permit application for the same applicant.
