Bradford, Village Manager /';077 DATE: January 25, 1996 SUBJECT: Code Enforcement Ordinances; Special Master and Minimum Property Standards Attached hereto, please find, for your review, a copy of the revised Special Master and Minimum Property Standards Ordinances . These Ordinances have been amended based upon the comments of the public and the members of the Village Council . Appearing below, please find an outline of the changes made and/or comments relative to these revised Ordinances, for your consideration. 1. "Special Master Ordinance" • This Ordinance has not been changed except for the inclusion of the specific Code Sections that are proposed to be provided with each class of offense, which begin to appear on Page 10 of the Ordinance. The offenses applicable to each class are being fine-tuned at this time. Additional changes are forthcoming, including the provision of code violations that will become a Class IV offense. • The Village Attorney's Office advises that Section 2-101, entitled Alternate Code Enforcement Procedures (Power to Issue Citations) can be done in the event that the Village Council wishes to forego the special master and keep the Code Enforcement Board. This would be another option for your consideration that would allow for an incremental increase in Village code enforcement authority without abolishing the Code Enforcement Board. 2 . "Minimum Property Standards Ordinance" • Section 6-32(A) (2) has been amended so that it states that "painted surfaces shall be maintained free of graffiti and with uniform and consistent colors, void of any evidence of deterioration. " This means that the paint on the structure must be uniform and consistent and does not mean that the houses within the neighborhood must be uniform and consistent. I Page 2- • The previous Section of the Ordinance dealing with Color has been deleted in its entirety. Therefore, there is no longer any requirement for a building to be consistent with "community character" or "excessively dissimilar to the color of other buildings . . . .within two-hundred ( 200 ) feet in all directions . " Additionally, there is no requirement for principal building color or trim color. • The Section relative to responsibility of owners and operators has been amended to make it so that property owners may not stop or damage a sewer system, drainage system, or the environment. • The previous Section allowing for Village internal inspection of premises has been deleted. Essentially, the Minimum Property Standards Ordinance now has been amended to focus on exterior appearance. In this regard, I am still not satisfied with that Section pertaining to landscaping. There is still no requirement for landscaping to be provided in a neat, orderly fashion in keeping with good landscaping design principles . I will address this issue with the Village Attorney's Office. Assuming that the Village Council is ready to proceed with these Ordinances, I need your feedback as to the process you wish to take. Do you want a synopsis of the Ordinances placed in the Village Newsletter? If so, then the Ordinances should not be brought forward for Village Council review until the latter part of February, after the February Newsletter has been received by the public. Please review the following provisions and contact me to discuss at your earliest convenience: Section Installation. All landscape shall be installed in a sound workmanlike manner and according to sound nursery practices in a manner which will encourage vigorous growth. Section Maintenance. The owner, tenant or their agent, if any, shall be jointly and severally responsible for the maintenance of all landscaping which shall be maintained in good condition so as to present a healthy, neat and orderly appearance and shall be kept free from refuse and debris. This language is designed to address your concern that the present ordinance has no requirement for a properly designed landscape scheme on residential property. Mr. Thomas G.
