Dear Tom:
For your information I am providing you with a copy of Section
101. 161, Florida Statutes, which describes the manner in which a
referenda question should be included on the ballot. Although this
language does not necessarily apply to "straw ballot questions", I
believe it is advisable to follow the guidelines of this statute to
the extent possible.
Pursuant to the statute, you will note that the question should be
worded in a manner that can be voted on by a "yes" or "no" vote.
The substance of the straw ballot question shall be an explanatory
• statement not exceeding seventy-five (75) words in length. The .
ballot title shall consist of a caption, not exceeding fifteen (15)
words in length.
Once the Council has approved the wording which would be placed on
the ballot, a resolution should be prepared which would be adopted
by the Council and submitted to the Supervisor of Elections.
