RESOLUTION NO. 29-23, A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, FLORIDA, SUPPORTING THE 2024 FLORIDA LEAGUE OF CITIES LEGISLATIVE
PLATFORM; PRIORITIZING AGENDA LEGISLATION THAT WOULD (1) PRESERVE MUNICIPAL
AUTHORITY TO MANAGE MUNICIPAL REVENUE SOURCES INCLUDING ENTERPRISE FUNDS;
(2) RATIFY THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION'S PROPOSED
ENVIRONMENTAL RESOURCE PERMITTING RULES FOR STORMWATER DESIGN AND
OPERATION REGULATIONS; (3) PROVIDE A CLEAR AND CONCISE REGULATORY
FRAMEWORK FOR THE ADOPTION OF MOBILITY PLANS; (4) ENHANCE RECRUITMENT AND
RETENTION EFFORTS TO ATTRACT TALENT IN PUBLIC SAFETY POSITIONS AND EASE
BARRIERS FOR SWORN LAW ENFORCEMENT OFFICERS AND FIREFIGHTERS RELOCATING
INTO THE STATE OF FLORIDA AND PROVIDE STATE FUNDING FOR SAME; AND (5) MAKE

A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, FLORIDA, SUPPORTING THE 2024 FLORIDA LEAGUE
OF CITIES LEGISLATIVE PLATFORM; PRIORITIZING AGENDA
LEGISLATION THAT WOULD (1) PRESERVE MUNICIPAL AUTHORITY
TO MANAGE MUNICIPAL REVENUE SOURCES INCLUDING
ENTERPRISE FUNDS; (2) RATIFY THE FLORIDA DEPARTMENT OF
ENVIRONMENTAL PROTECTION'S PROPOSED ENVIRONMENTAL
RESOURCE PERMITTING RULES FOR STORMWATER DESIGN AND
OPERATION REGULATIONS; (3) PROVIDE A CLEAR AND CONCISE

SHORT-TERM RENTALS, AND SOVEREIGN IMMUNITY; FURTHER
SUPPORTING THE GRANT OF APPROPRIATIONS TO FUND
IMPROVEMENTS AT TEQUESTA PARK; FURTHER SUPPORTING
THE 2024 LEGISLATIVE PLATFORM ADOPTED BY THE PALM
BEACH COUNTY LEAGUE OF CITIES; PROVIDING AN EFFECTIVE
DATE; AND FOR OTHER PURPOSES
WHEREAS, the Village of Tequesta wishes to engage in productive, focused
dialogue with the Florida State Senate and House of Representatives; and
WHEREAS, the State of Florida 2024 Legislative Session will convene on
January 9, 2024; and
WHEREAS, the Village of Tequesta is an active member of the Florida League of
Cities and actively support the development of priorities for the 2024 Legislative Action
Agenda; and
WHEREAS, the Village of Tequesta supports the 2024 Florida League of Cities
legislative platform; and prioritizes legislation which would (1) preserve municipal
authority to manage municipal revenue sources including enterprise funds; (2) ratify the
Florida Department of Environmental Protection's proposed environmental resource
permitting rules for stormwater design and operation regulations; (3) provide a clear and
concise regulatory framework for the adoption of mobility plans; (4) enhance recruitment
and retention efforts to attract talent in public safety positions and ease barriers for
sworn law enforcement officers and firefighters relocating into the state of Florida and

provide state funding for same; and (5) make equitable essential investments to ensure
that transportation infrastructure can effectively serve the needs of present and future
residents and visitors; and
WHEREAS, the Village of Tequesta further supports the Florida League of Cities'
policy positions on the topics of property assessed clean energy (PACE) programs,
property tax protection, short-term rentals, and sovereign immunity; and
WHEREAS, the Village of Tequesta further supports the grant of appropriations
to fund improvements at Tequesta Park; and
WHEREAS, The Village Council further supports the formation of the 2024 Palm
Beach County League of Cities Legislative Platform.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, FLORIDA:
SECTION 1. The above recitals are declared to be true and correct and are
incorporated herein by reference.
SECTION 2. The Village Council supports the formation of the 2024 Florida
League of Cities Legislative Platform attached hereto and incorporated as "Exhibit A" as
part of the legislative priorities of the Village of Tequesta. As an active member of the
Florida League of Cities, the Village of Tequesta, through the Village Council, will also
support additional legislative priorities identified by the Florida League of Cities, unless
the Village Council determines that it is in the best interests of the Village and its
residents to take a contrary position.
SECTION 3. The Village Council hereby adopts as priorities legislation which
would (1) preserve municipal authority to manage municipal revenue sources including
enterprise funds; (2) ratify the Florida Department of Environmental Protection's
proposed environmental resource permitting rules for stormwater design and operation
regulations; (3) provide a clear and concise regulatory framework for the adoption of
mobility plans; (4) enhance recruitment and retention efforts to attract talent in public
safety positions and ease barriers for sworn law enforcement officers and firefighters
relocating into the state of Florida and provide state funding for same; and (5) make
equitable essential investments to ensure that transportation infrastructure can
effectively serve the needs of present and future residents and visitors.
SECTION 4. The Village Council supports the Florida League of Cities' policy
positions on the topics of property assessed clean energy (PACE) programs, property
tax protection, short-term rentals, and sovereign immunity as stated in Exhibit "A".
SECTION 5. The Village Council further supports the grant of appropriations to
fund improvements at Tequesta Park.

SECTION 6. The Village Council further supports the formation of the 2024 Palm
Beach County League of Cities Legislative Platform attached hereto and incorporated
as "Exhibit B" as part of the legislative priorities of the Village of Tequesta.
SECTION 7. The Village Manager is directed to forward a copy of this resolution
to the members of the Florida League of Cities and all local representatives.
SECTION 8. This resolution shall take effective immediately upon its adoption.

PRIORITIES:
Enterprise Fund Transfers
The Florida League of Cities SUPPORTS the preservation of municipal authority to manage municipal
revenue sources and realize a reasonable rate of return on their proprietary assets, investments and
services.
Legislative Ratification of Statewide Stormwater Rule
The Florida League of Cities SUPPORTS legislation to ratify the Department of Environmental Protection's
proposed Environmental Resource Permitting Rules for Stormwater Design and Operation Regulations,
Ch. 62-330, F.A.C.
Mobility Plans
The Florida League of Cities SUPPORTS legislation that defines and clarifies mobility plans in order to
provide a clear and concise framework for Florida cities to acquire, construct, and implement both
traditional and alternative modes of transportation.
Public Safety Recruitment and Retention
The Florida League of Cities SUPPORTS legislation and state funding to enhance the recruitment and
retention efforts to attract talent in public safety positions.The Florida League of Cities SUPPORTS
legislation that eases certification barriers for sworn law enforcement officers and firefighters relocating
to the state of Florida.
Transportation Infrastructure
The Florida League of Cities SUPPORTS legislation to make equitable essential investments to ensure that
transportation infrastructure can effectively serve the needs of present and future residents and visitors.
This includes identifying new revenue sources for statewide, regional and local transportation
requirements while promoting and leveraging existing funding channels. We SUPPORT the introduction
of a fee for alternative fuel vehicles to ensure they fairly contribute to transportation infrastructure
costs. We also SUPPORT the inflationary indexing of the Municipal Motor Vehicle Fuel Tax. A well-
preserved transportation network not only inspires businesses to invest in our cities but also fuels job
creation and economic development.
POLICY POSITIONS:
Property Assessed Clean Energy(PACE)
The Florida League of Cities SUPPORTS legislation to clarify the term "local government" under the
Property Assessed Clean Energy(PACE) program means a county, a municipality, a dependent special
district or an intergovernmental entity that has jurisdiction only within the boundaries of the
participating members of an interlocal agreement.

Property Tax Protection
The Florida League of Cities SUPPORTS legislation that maintains an equitable property tax system while
preserving a municipality's ability to fund public infrastructure, police,fire, emergency services and
other essential services. Any further erosions or exemptions on the current property tax structure will
unfairly shift the tax burden to the business community, renters and others.
Short-Term Rentals
The Florida League of Cities SUPPORTS legislation that restores authority to local governments for the
regulation of short-term rental properties as necessary for quality of life, public safety and the creation
of fair lodging standards.The Florida League of Cities SUPPORTS legislation clarifying existing
grandfathered municipal short-term rental ordinances can be amended without penalty.The Florida
League of Cities OPPOSES legislation that preempts municipal authority as it relates to the regulation of
short-term rental properties.
Sovereign Immunity
The Florida League of Cities SUPPORTS protecting Florida taxpayers by limiting the waiver of sovereign
immunity on monetary damages recoverable in tort claims against government entities.

2024 Priorities& Issues
Short-Term Rentals The Palm Beach County League of Cities SUPPORTS legislation that restores
authority to local governments for the regulation of short-term rental properties as necessary for quality of life,
public safety and the creation of fair lodging standards.The Palm Beach County League of Cities SUPPORTS
legislation clarifying that existing,grandfathered municipal short-term rental ordinances can be amended
without penalty.The Palm Beach County League of Cities OPPOSES legislation that preempts municipal
authority as it relates to the regulation of short-term rental properties.
Affordable Housing The Palm Beach County League of Cities SUPPORTS legislation that requires all
monies from the Sadowski State and Local Housing Trust Fund be used only for Florida's affordable housing
programs targeted to meet the needs of workforce housing,including low income,very low income and
disabled persons,for both home ownership and rental unit availability.
Mobility The Palm Beach County League of Cities SUPPORTS legislation that defines and clarifies mobility
plans in order to provide a clear and concise regulatory framework for Florida cities to acquire,construct and
implement both traditional and alternative modes of transportation.
Water Resources Planning and Comprehensive Watershed Management The Palm Beach County
League of Cities SUPPORTS legislation establishing a statewide coordinated planning and prioritization
approach for water resource investments that funds Florida's current and projected water needs in an equitable
manner and authorizing Comprehensive Watershed Management projects to qualify for funding under the state
Water Protection and Sustainability Trust Fund.
Enterprise Fund Transfer The Palm Beach County League of Cities SUPPORTS the preservation of
municipal authority to manage municipal revenue sources and realize a reasonable rate of return on their

Residential Zoning The Palm Beach County League of Cities SUPPORTS legislation that maintains,
advances and encourages the fundamental ability for cities to tailor unique land development solutions through
local decision-making,preserving the ability for cities to decide how they look and grow.Cities are strong
supporters of affordable housing efforts and are best positioned to identify appropriate areas that can support
high-density infill redevelopment.
Transportation Funding The Palm Beach County League of Cities SUPPORTS legislation directing the
Florida Department of Transportation to provide financial assistance and incentives to develop and implement
multimodal transportation plans that optimize different modes of combined transport and are tailored to municipal
transportation demands.The Palm Beach County League of Cities SUPPORTS identifying additional or
replacement transportation revenue to fund innovative infrastructure(e.g.,electric vehicles)and transit projects to
meet the

Sovereign Immunity The Palm Beach County League of Cities OPPOSES,the increase statutory limits on
liability for tort the state and its agencies and subdivisions(which includes municipalities).
Septic Tanks The Palm Beach County League of Cities SUPPORTS,regulatory initiatives and financial
initiatives,including matching grants,that prioritize and encourage properties with septic tanks to connect to
centralized sewer systems,especially in areas that adversely impact rivers,estuaries,first magnitude springs,water
bodies and water supply sources.
Economic Development The Palm Beach County League of Cities SUPPORTS legislation advancing economic
incentives for distressed areas and providing increased flexibility for municipalities to enter into public-private
partnership agreements with collaboration between the state and cities on offering incentives that maximize
economic development opportunities for retention,expansion,and attraction,and building sustainable economic
resiliency.
Resilient and Sustainable Florida The Palm Beach County League of Cities SUPPORTS legislation that
promotes a resilient and sustainable Florida,including:funding for water quality improvements;establishing
policies and funding for alternative water supply development;providing for intergovernmental coordination and
planning on strategies to address climate challenges such as drought,coastal flooding and inland flooding;and
enabling local authority to implement natural resource protection strategies.
Beach Management The Palm Beach County League of Cities SUPPORTS legislation increasing the beach
management allocations to at least$50 million for the Ecosystem Management and Restoration Trust Fund for
beach preservation and repair.
OpioidlSubstance Use The Palm Beach County League of Cities SUPPORTS policies that provide state
appropriations for life saving interventions and medically-assisted detoxification programs for those suffering from
opioid addiction.
Mental Health Understanding the cause of homelessness in many cases is related to mental health illness,the
Palm Beach County League of Cities SUPPORTS funding efforts for beds,treatment program,and youth-related
initiatives to advance prevention.
Sober Homes The Palm Beach County League of Cities SUPPORTS the State Attorney Addiction Recovery
Task Force,created in 2016,and their recommended statutory changes for the 2024 session.
Community Redevelopment Agencies The Palm Beach County League of Cities SUPPORTS legislation to
protect and improve municipalities'use of community redevelopment agencies to effectively carry out
redevelopment and community revitalization in accordance with Home Rule.
Communications Service Tax The Palm Beach County League of Cities SUPPORTS legislation that protects
the general revenues collected from the Communications Service Tax in a manner that is revenue neutral.
Pension Plans& Benefits The League of Cities SUPPORTS legislation that affirms the home rule powers of
municipalities to establish and fund municipal employee benefit levels,and specifically provides comprehensive
pension reform,disability presumption reform,and a mechanism for municipalities to revoke their election to
participate in the Florida Retirement System.
State Funding for Educational Initiatives The Palm Beach County League of Cities SUPPORTS revisions to
zoning requirements so that local jurisdictions have greater authority over the location and construction
of educational facilities for local universities,state colleges,and Palm Beach County schools(including charter
schools).The League also supports adequate funding for all state education mandates,including those related to
student safety,mental health,and school security.
Local Business Tax The Palm Beach County League of Cities SUPPORTS legislation that protects local
government rights to use local business tax revenue to provide services that our citizens want and need, including
public infrastructure,public safety services and public transportation infrastructure.
Annexation The Palm Beach County League of Cities SUPPORTS legislation that facilitates the municipal
annexation of unincorporated areas while protecting private property rights and respecting municipal boundaries.
