NOW,. THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1. The Bid with Airtouch Incorporated for the Emergency Paging System for the Police and Fire-Rescue Departments, in the Amount of $5, 765 .40, Attached Hereto as Exhibit "A" and Incorporated by Reference as Part of this Resolution, is Hereby Approved Subject to Funds Being Appropriated for the Next Fiscal Year, and the Village Manager of the Village Tequesta is Authorized to Execute the Applicable Contract on Behalf of the Village of Tequesta. Weinand, Fire Chie , Date: September 16, 1998 Subject: Annual Contract for Emerge cy Paging System for Police and Fire Departments Attached, you will find a contract that needs to be executed by yourself to continue the annual contract for the emergency paging system for the Police Department and the Fire Department. Also attached, you will find the results of the Request for Quotations in accordance with the purchasing procedure guidelines of the Village of Tequesta. Last year's contract was with Pagenet Incorporated out of West Palm Beach for this paging service. Our rate was $10.95 per pager. The current contract recommended for signature is with Airtouch Incorporated for $8.95 per month per pager. The contract with Airtouch will save us $1,224.00 annually versus using our existing contract with Pagenet. Due to the increase in the number of pagers, it has brought this annual contract over the $5,000 threshold and, therefore, must be forwarded to the Village Council for consideration. Therefore, if you see appropriate, please forward this to the next Village Council Meeting for approval to assure that this service continues commencing on October 1, 1998, and for the budget year of FY 98/99. PURPOSE: The purpose of this document is to provide minimum specifications and test parameters for the installation of this paging system that meets the needs and desires of the Village of Tequesta, Department of Fire Rescue. It establishes essential criteria for certain features, design, performance, and data integrity- The nhjertivci is to provide a 24 hour a day emergency paging system that interconnects into the existing computer network, so that off duty personnel can be notified of unusual circumstances that require their immediate response. • GENERAL REQUIREMENTS:: 3.1_ This is an engineer, design, construct, deliver type specification and it is not the intention of this Department to write out any vendor or manufacturer of similar or equal equipment of the type specified. It should be noted, however that these specifications aro written to describe an emergency paging system for the Village of fequesta, and around its specific needs. • 3.2 Because of this fact, price may not be the major consideration in awarding- this contract. Contract award will be given to the vendor whose quote comes closest to meeting these specifications, or to the vendor who•shows proof to this Agency that their exceptions are deemed equal to or superior to these specifications, at the most competitive price- This Agency will solely • determine which products are equal to or superior to the specifications. Any vendor taking exception to the specifications must comply with requirements of this quotation request. Any vendor making measureless statements such as 'total exception" to the specification will result in immediate rejection of quote. 3.3. This Agency reserves the right to increase equipment quantities that are specified by these specifications. The pagers, software and any*of its accessories shon be delivered F.O.B. to the Village of Tequesta. Prices shall be quoted on the complete system requirements, including delivery charges, complete installation of hardware and/or software, and training as specified in this document, and will be accepted on a complete installation. 3.5. Lech bidder is required, before submitting their Quotation, to be thoroughly familiar with the specifications contained herein and the site(s) upon which the paging system is to be installed. No additional allowances will be made because of lack of knowledge of these conditions. It is the responsibility of the successful Bidder to ascertain if any components of this specification are unsafe, or do not meet the required standards of applicable State law or those of Federal specification. Should there be any unsafe or poorly designed criteria contained herein, the Bidder shall thoroughly explain the item to the purchaser in the Quote Proposal. 3.6. PURCHASER DEFINED:The end user of the equipment specified or the applicable purchasing agency. 3.7. CONTRACTOR DEFINED. The individual, firm, .partnership, manufacturer or corporation to Whom the contract is awarded by the Purchaser and who is subject to the terms thereof. For bidding purposes, the Contralto, Vendor, and Bidder are synonymous. 3.6. EQUAL DEFINED Shall be taken in its general sense and shall not mean identical. These specifications are for the sole purpose of establishing minimum requirements of level of quality, standards of performance and design, and is in no way intended to prohibit the bidding of any manufacturer's item of equal material • 3.9. The Purchaser shall bo the sole judge of equality and this decision shalt be final. SPECIAL CONDITIONS: 40, No bid shall be considered unless the bidder can meet the special conditions stated herein; 4.1. BIDDERS RESPONSIBILITY AND QUALIFICATIONS_ The contractors of this paging system network bid shall have in operation. a network and facility of adequate size and devoted to the Installation and support of the equipment herein specified. The intent of this section is to ensure single source responsibility for all equipment proposed by the contractors. • 4.2. It is not the intent of these specifications to call for an unusual or experimental paging system. Such proposals are not acceptable_ Therefore, as proof of the ability to furnish, install and support this paging system as defined in these specifications, the contractors must be able to show that the contractor of this paging network has ihstalled and supported at least 10 paging systems of the type specified herein. 1=' 4.3. The bidder shall submit a list of ten (10) customers who have purchased similar size paging ,s systems within the last five years. This list will have contact names and phone numbers. Y-. Each Bidder shall disclose any pending or anticipated litigation between the Bidder and any other party or parties that might effect this contract. fr 4.5, PRICES AND PAYMENTS: All quotations must be on the complete paging system specified, Including equipment, delivery charges, installation of hardware and/or software, and training as specified in this document, to Village of Tequesta, located at 357 Tequesta Drive, Tequesta, Florida. These prices shall be complete, and include warranty, if offered. 4.6. Payment will be made on a monthly basis after the paging system has successfully passed test requirements, received final approval, demonstrated compliance with the specifications by the Village of Tequesta, and after all additional equipment has been received by the Purchaser, and shall continue per the terms and cnnd ition of said contract. Payment cannot be made immediately upon installation and may be delayed as much as twenty (20)working days_ • 4.7. Quotation Evaluation: Quotations received shall be evaluated by the Purchaser. This evaluation will be based as a minimum on the following criteria; 4.8. Completeness of the proposal, i.e.,.the degree to which it responds to all requirements,and requests for information contained heroin. 4.9. Installation and delivery schedule. 4.10. Contractor's demonstrated capabilities and qualifications. 4.11. Contractor's past performance on similar Proposals. 4.12. Contractors design and engineering reliability factors. 4.13. Contractor's maintainability considerations and recommendations. 4.14. Bidder's logistical and service support_ 4.15. Proposals taking total exception to these specifications will not be considered for acceptance_ 4.16. Bid Proposals that do not comply with this prescribed method for taking exception, may be rejected without further consideration. Vendors shall provide all necessary information requested by these specifications Any exceptions taken shall be listed on a separate piece of letter heed paper. The Vendor, when listing exceptions or clarification's, shall reference these specifications by the proper paragraph number. 4.17. CONTRACT AWARD: The Purchaser reserves the right to increase or decrease the number of components or equipment specified for this paging system under this contract. If awarded, the Bidder agrees that additional public governmental agencies may purchase under the same terms and prices afforded by any contract that may arise frum the bid award. The Purchaser has the right to waive. any informalities, Irregularities, and technicalities in procedure. 4.19. The Purchaser reserves the right, before awarding this contract, to require a vendor to submit evidence of qualifications as it may deem necessary, and may consider any evidence available to it of the financial, technical, and other qualifications and abilities of said contractor, including past performance on contracts of this type with other agencies. The Purchaser shall be the final authority in the award of this bid. 4.20. AWARD CHALLENGE: All costs accruing from a bid or an award challongod as to quality, tests, etc_, shall be assumed by the challenger. • 4.21, WARRANTY: Purchaser requests that the bidder submit any extended warranty or Insurance coverage options available from the vendor for consideration. 4.22. Within two (2)hours after receipt of a verbal or written notification that service work is required, the successful vendor shall respond verbally, end immediately send an authorized repairman to complete service work as required. 4.23. MATERIALS AND WORKMANSHIP: At the time of delivery, all equipment furnished shall be guaranteed to be in an operable condition, meeting the requirements as specified herein. 4.25. All workmanship shall be of quality and performed in a professional manner so as to ensure a functional pager system and the pager shell be aesthetically appealing. 4.26_ DELIVERY DATE! Since delivery proposals by the Vendor will weigh heavily in the determination of award of contract, the delivery schedules that are submitted by the Vendor and agreed upon by the Purchaser shall automatically become binding upon the successful Vendor The delivery date specified by the bidder must be actual, and may be the determining factor In awarding this contract. 4.27. FAMILIARITY WITH LAWS:The*Bidder is presumed to be familiar with all Federal, State, and Local Laws, Ordinances, Code Rules, and regulaiiuris that may in any way affect the work. OPERATIONS: Contractor to provide a complete state of the art emergency paging system to be integrated into the Tequesta Fire Rescue Computer Network and to work Independently. This computer network is operated from two separate buildings which are to be linked together by means of Fiber Optic cable to minimize the conduction of electrical charge from lightning. Pagers shall be operational from any computer terminal on the network that is equipped with a modem. The pagers shall also be operable by any telephone, on or off this property. 5.2 COVERAGE: The pagers, at minimum shall have an operational coveraw lunge as specified; North coverage to Vero Beach, FL, South coverage to Miami, FL, Eastern coverage to the Atlantic Ocean, and Western coverage, shall be to the western edge of all the counties residing between the north and south boundaries as listed above. Several pagers will need state wide coverage, quantities will be listed below. • • 5.3 FEATURES: 5.3.1 The pagers shall capable of being initiated independently, or by user programmable grouping. 5.3.2 Vendor shell provide an independent access terminal for alphanumeric•messages to be broadcasted by dispatch personnel, this shall be in addition to the existing computer workstation. 5.3.3 The rental price for pagers shall include an unlimited number of activation's. 5.3.4 Pager shall be portable and operational with disposable batteries. 5.3.5 Paging system shall be In place and operational prior to commencement of contract, as specified in section 5.4. 5.4 DURATION OF CONTRACT Purchaser requests a twelve month contract, with automatic renewal clause, unless modified by purchaser or vendor. commencing on 10/119E1 through f19/: /99 5_6 QUANTITY: Purchaser requests rental pricing on a per pager basis, the number of local coverage pagers as specified in 5.2 Coverage, equals forty three (43).
