Preston.Agenda.8.13.98 1 LAWN AND LANDSCAPE MAINTENANCE VILLAGE OF TEQUESTA ADVERTISEMENT FOR BID Sealed bids will be received by the Village of Tequesta, at the Office of the Village Engineer, Gee & Jenson Engineers-Architects-Planners, Inc., One Harvard Circle, West Palm Beach, FL 33409, until 2:00 p.m., Tuesday, July 21, 1998, at which time they will be opened and read. Bids received after the designated time will not be considered. Such bids are to provide for "COMPLETE LAWN AND LANDSCAPE MAINTENANCE FOR AREA 'A' AND/OR AREA 'B', TEQUESTA,FLORIDA". • All work performed shall be in accordance with conditions, requirements, and specifications pertaining thereto, which may be obtained, free of charge, at the Office of the Village Engineer, Gee & Jenson, at the aforementioned address. Inquiries should be directed to Harry Benoit, P.E., Gee & Jenson Engineers-Architects-Planners, Inc., 561/683-3301, hereinafter referred to as Village Engineer. Bids shall be submitted on blank Bid Quotation forms provided and shall be enclosed in a sealed envelope bearing the name and address of the bidder and marked "LAWN AND LANDSCAPE MAINTENANCE FOR AREA ' ' (specify either 'A' or 'B' or both). The words "BID ENCLOSED" shall be indicated. Bids shall be accompanied by a satisfactory bid bond or cashier's check, drawn upon any State or National bank in Florida, made payable to the Village of Tequesta, in the amount of five percent (5%) of the highest total bid for either Area, or both, as a guarantee that the Bidder will enter into written contract with the Village to perform the contract bid upon. The deposit will be retained by the Village to ensure performance of the contract bid upon. The deposit will be retained by the Village as liquidated damages in the event the successful bidder fails to enter into the contract. The deposits of unsuccessful bidders will be returned promptly following execution of the contract for the work and the deposit of the successful bidder will be returned upon execution of the contract and delivery of proper certificates of insurance. As early as practicable and within sixty (60) days after receiving the bids, the Village shall advise as to the successful bidder. The Village of Tequesta reserves the right to reject any or all bids, with or without cause, to waive technical errors and informalities, or to accept the bid which, in its judgment, best serves the Village of Tequesta. It is my suggestion that that paragraph 2 read as follows: 2. CONTRACT PERIOD The initial contract period shall be for two(2)years, commencing on October 1, 1998. The Village reserves the right to exercise the option to: (a)terminate the contract after a 1-year period with forty-five (45) days notice by the Village if funds are not appropriated by the Village Council for the second year of the project; or (b) to continue the contract for the remainder of the two year period and to renew for successive one year periods,pursuant to the terms provided herein,subject,however,to funds being appropriated for each successive year. Bid is accompanied by all required documentation, including: o Bid amount for Area "B" only (including breakdown by site), with owner's signature. • Bid bond amount of 5% of Bid. o At least three references listed for similar work. © Two subcontractors were listed with support documentation as follows: TruGreen Chemlawn(pesticides) Rood Nursery (pruning/arborist) • o List of power equipment; number of personnel (12); supervisors/technical (5). o Number of years in business (1-1/2—contractor; 22, 51 —subcontractors). ♦ Verification of availability of certified arborist. o Copies of all required licenses, including Florida Certified Pesticide Applicator 2. Bidder has provided proof of insurance in accordance with specifications. 3. No exceptions or variations requested to bid specifications. Rood Landscape Co., Inc. 1. Bid is not accompanied by most required documentation; not included are: • Bid Bond. • Verification of availability of certified arborist. • Copies of any required licenses. 3. Bidder has not provided proof of insurance as required, in accordance with specifications. Analysis The Bid Advertisement resulted in seven (7) bid packages being picked up by interested contractors or their representatives. Of these, only three (3) submitted bids. One of the three bidders (Sod Unlimited) did not submit a Bid Bond or various other required documents as clearly stated in the Instruction to Bidders contained in the Bid Package, as distributed. The Bid Advertisement states that the Village "reserves the right to reject any and all bids, with or without cause, to waive technical errors and informalities, or to accept the bid which, in its judgement, best serves the Village of Tequesta". Sod Unlimited has been advised of the options available to the Village and that the Village Council will need to make a final determination on waiving the deadline requirement for the Bid Bond and documentation items not provided. Although two days have passed since the bid opening, we have not received any of the missing items. Furthermore, there have been no communications received from Sod Unlimited even though I placed one call and left a request for information on the Company's recorder at 4:45 p.m. on the day of the opening. Given our findings that the firm's bid meets specifications and documentation provided offers evidence that the company possesses the capabilities to perform the required services,the Village should consider awarding a contract to Terracon Services for Area "B" for a 2-year period. There being only one valid bid for Area "A" (assuming rejection of Sod Unlimited Bid) that complies with specifications and, with ample evidence that Rood Landscape Co., Inc. possesses the capabilities to perform the required services, the Village should consider awarding a contract to Rood Landscape Co., Inc. for Area "A" for a 2-year period.
