Subject: Ordinance Restricting Parking on Tequesta ks Drive;
Agenda Item
As you can see from the attached correspondence, the residents of
Tequesta Oaks have requested the Village to give consideration to
restricting parking on the public streets within Tequesta Oaks
between the hours of 1 : 00 A.M. and 00 A.M. The attached
ordinance pertains only to Tequesta Oa s Drive since parking on
the remainder of the public streets within Tequesta Oaks is
prohibited twenty-four hours a day. •
The request of the Tequesta Oaks homeowners has been drafted to
dovetail with the existing restrictions on parking on public
streets on Seabrook Road and Country Club Drive.
The residents of Tequesta Oaks feel that the requested
restrictions will serve as a crime deterrent because typically
there is no valid purpose for anyone to park on Tequesta Oaks
Drive from the hours of 1: 00 A.M. tor00 A.M.
It is recommended that the Village Council adopt this ordinance
prohibiting parking of vehicles, etc . on Tequesta Oaks Drive
between the hours of 1 : 00 A.M. and ,5:00 A.M.

Dear Mr. Ladd:
By way of introduction,our Homeowners Association represents 158 owners of Town
Homes located in downtown Tequesta. Our homeowners are very happy to be part of
the Tequesta Community and are anxious to have our area assimilated into the greater
Tequesta Community. Having spoken with the board and many of the homeowners,
know they are happy residing in Tequesta for many reasons. One of the most
important reasons, is the feeling of safety our homeowners feel for themselves and for
their families.
In furtherance of the security issue, I hereby request, on behalf of the Tequesta
Homeowners Association, the Town of Tequesta consider and adopt a change in such
ordinance, law and or statute which would accomplish a prohibition of on street parking
on all public streets located in a mixed use zoning area in the Town between the hours
of 1:00A.M. and 5:00A.M. Such a change in law and/or ordinance would provide
homeowners in our community and property owners living or working in any mixed use
area with additional security by virtue of having vehicles which are parked on street
between the restricted hours ticketed by the Tequesta Police Department. Such
ticketing would give us and the police an accounting of whom is using our streets to
park their autos. Since our community and other mixed use communities are located in
very transient areas, said accounting of vehicles. would result in additional security for
our community.
I have taken the liberty of discussing this issue with the Police Chief of Tequesta. He
suggested support of this concept saying his department would be better able to keep
track of traffic into and out of our community during the morning hours. My proposal
•
would permit owners of vehicles to get temporary permission on a case by case basis
from the Tequesta Police Department to park over night by advising the Police, in
advance of such intent.
Unfortunately we have experienced our first burglary recently. The crime may have
been implemented with the aid of a van which may have been parked on our streets
before being used as part of the burglary.
Since this issue is of vital importance to our community, I would like the opportunity to
sit down with you and or your staff to discuss the details of this proposal so that we may
accomplish this change.

Re: Proposed Change to the Tequesta Code of Ordinances .
Dear Mr. Ladd:
Reference is made to your letter to Vincent J. Sama, dated April 28, 1998, in which you stated in
part that the village staff is in support of the subject code change. In your letter, you also asked
the Board of Tequesta Oaks Homeowners Association to poll the owners of Tequesta Oaks to see
if there is any support for the change in Ordinance above referred to.
For your information and the record, at a meeting of the Board on May 6, 1998 the Board
unanimously supported the proposed change and,all owners present at the meeting were also
unanimous in their support for the change. All the homeowners feel the change will result in a
much safer community because vehicles which don't belong in the community will be monitored
by the Tequesta Police.
We hope this letter satisfies your office that our community and Board are in full support of the
proposed change. In the event your office needs additional documentation, please feel free to
contact Vincent J. Sama,President of our Board.

Pursuant to your request, I have revised the above ordinance to reflect Chapter 11.5, rather than
Chapter 11. I have also changed the hours of restriction to 1:00 a.m. and 6:00 a.m.

SUBJECT: Proposed Draft Ordinance for Tequesta Oaks Drive Regulations.
Tom, attached is the final version of the Ordinance to place restrictions on parking on
Tequesta Oaks Drive as requested by the Tequesta Oaks HOA. I drafted the language using
current parking restrictions as a guide,Skip reviewed the language and then put together the
draft ordinance.
Please place this ordinance for first reading on the agenda of an upcoming Council Meeting.

AN ORDINANCE OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA,PALM BEACH COUNTY,FLORIDA,
AMENDING CHAPTER 11.5 OF THE CODE OF ORDINANCES
RELATING TO MOTOR VEHICLES. AND TRAFFIC, AT
ARTICLE III, PARKING, STOPPING OR STANDING, BY
INCLUDING THEREIN A NEW SECTION 11.5-22
RESTRICTING PARKING OF VEHICLES, BOATS, TRAILERS
OR MACHINERY ON TEQUESTA OAKS DRIVE; PROVIDING
FOR SEVERABILITY; PROVIDING FOR REPEAL OF
ORDINANCES IN ' CONFLICT; . PROVIDING FOR
CODIFICATION; PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA,
PALM BEACH COUNTY,FLORIDA, AS FOLLOWS:
Section 1. Chapter 11.5, of the Code of Ordinances of the Village of Tequesta relating
to Motor Vehicles and Traffic, is hereby amended at Article III,Parking Stopping.or Standing,by
including a new Section 11.5-22 to read as follows:
"Sec. 11.5-22. Parking of vehicles,,boats, machinery, etc., on Tequesta Oaks
Drive.
(a) It shall be unlawful to stand, stop or park any motor vehicle, boat, trailer or
machinery upon any portion of Tequesta Oaks Drive within the Village of Tequesta
between the hours of 1:00 a.m. and 6:00 a.m.
(b) The owner of any such vehicle found guilty of violating the provisions of this
section shall be subject to the general penalty provision of the Code of Ordinances
and the parking violations fines as set forth in Section 11.5-20 herein."
Section 2. Severability. If any provision of this Ordinance or the application thereof is
held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance
which can be given effect without the invalid provisions or applications, and to this end, the
provisions of this Ordinance are hereby declared severable.
Section 3. Repeal of Ordinances in Conflict. All other ordinances of the Village of
Tequesta,Florida,or parts thereof which conflict with this or any part of this Ordinance are hereby
repealed.
Section 4. Codification. This Ordinance shall be codified and made a part of the official
Code of Ordinances of the Village of Tequesta.
Section 5. Effective Date. This Ordinance shall take effect immediately upon its passage
and approval, as provided by law.
THE FOREGOING ORDINANCE was offered by Councilmember
, who moved its adoption. The Ordinance was seconded by
Councilmember and upon being put to a vote, the vote was as
follows:
