July 17, 1998 Subject: Resolution Urging Modification of Country Club Drive from an Eighty Foot Right-of-Way to a Fifty Foot Right-of-Way; Agenda Item •As you can see from the attached correspondence, Palm Beach `County is moving forward with its promise to amend its Comprehensive Plan to reduce the right-of-way on Country Club Drive. In response to my letter of June 29, 1998, to Charles Walker, Director of the Traffic Division at Palm Beach County, he requested that his office be provided with a formal Resolution of support for the effort to indicate the right-of-way on Country Club Drive to be fifty feet versus the current eighty feet indicated on the Palm Beach County Thoroughfare Protection Map. In this regard, I have prepared the attached Resolution for your consideration at your meeting on July 23rd. If you approve the Resolution, it will be forwarded to Palm Beach County for their records in pursuing the right-of-way reduction in the first round of Comprehensive Plan amendments scheduled in calendar year 1999 . Box 1989-1989 West Palm Beach, FL 33402 RE: Country Club Drive Right-of-Way • Dear Cindy: This is in furtherance of our conversation on April 3, 1998, regarding the above referenced subject. • As you know, Country Club Drive was previously designated as having 80 feet of right-of-way available. A few years ago, Tequesta took steps to place irrevocable easements along the perimeter of each side of the Country Club Drive right-of-way which ..effectively grants only '50 feet of right-of-way for roadway purposes . Country Club Drive is listed in the Palm Beach County Thoroughfare Plan and/or Thoroughfare Identification Map (TIM) as still having an 80 foot right-of-way. Accordingly, if possible, Tequesta would appreciate any efforts by Palm Beach County to acknowledge the 50 foot status within Palm Beach County's Thoroughfare Plan and/or TIM. If Palm Beach County were to recognize the 50 foot right-of-way status of Country Club Drive, this would do much to allay the fears many residents have concerning future four-laning 'of Country Club Drive. Any steps that Commissioner Marcus, yourself or others with Palm Beach County can take to cause the 50 foot right-of-way on Country Club Drive to be recognized by Palm Beach County in its Thoroughfare Plan and/or TIM, will be greatly appreciated. Burt Aaronson,Chairman In this letter you requested that the Palm Beach County Thoroughfare Maude Ford Lee,Vice Chair Right of Way Identification Map be modified to show a 50 ft right-of-way Karen T.Marcus for Country Club Drive. The reason for this modification would be to document the intent that Country Club Drive would not be widened Carol A.Roberts beyond its existing two lanes. Similar restrictions have previously been • Warren H.Newell made on Northfork Drive 'and Loxahatchee River Road restricting this right-of-way to 60 ft. WHEREAS, the Palm Beach County Comprehensive Plan in the Traffic Element contains the Thoroughfare Identification Map which indicates Country Club Drive right-of-way to be eighty feet; and WHEREAS, the Country Club Drive right-of-way is maintained by the Village of Tequesta; and WHEREAS, the Village of Tequesta through its Comprehensive Plan and other actions has taken appropriate steps to indicate the right-of-way for Country Club Drive to be fifty feet and has placed irrevocable easements totaling thirty feet in width to effectively minimize the right-of-way available for roadway purposes on Country Club Drive to be fifty feet; and WHEREAS, Country Club Drive is bounded by single-family homes on each side of the roadway; and -WHEREAS, traffic traversing on Country Club Drive has increased over the years and is anticipated to increase in the future with new development primarily external to the Village of Tequesta; and WHEREAS, residents of the Village of Tequesta are concerned that anticipated increases in traffic may give rise to Palm Beach County proceeding with four-laning. Country Club Drive despite the intentions of the Village to the contrary, since said roadway appears on Palm Beach County' s Thoroughfare Identification Map as having eighty feet of right-of-way which can facilitate the provision of five lanes within such right-of-way. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1. The foregoing recitals are hereby ratified and confirmed. Section 2 . The Village Council of the Village of Tequesta hereby requests that the Palm Beach County Board of County Commissioners take the necessary steps to reduce the available right-of-way pertaining to Country Club Drive from the current listed eighty feet to fifty feet to be indicated upon the Thoroughfare Identification Map. Section 3 . The Palm Beach County Board of County Commissioners are requested to make said change in the anticipated Comprehensive Plan Amendments scheduled with round 99-1 in calendar year 1999 . .;, Section 4. The Village Manager or his designee is hereby requested to forward copies of this Resolution to the Palm Beach County Board of County Commissioners, the County Administrator for Palm Beach County, and Traffic Engineer Charles Walker, Palm Beach County, the Tequesta Country Club Community Association, and the ' Tequesta Country Club Point Property Owners ' Association. THE FOREGOING RESOLUTION WAS OFFERED by Councilmember , who moved its adoption. The motion was seconded by Councilmember , and upon being put to a vote, the vote was as follows : FOR ADOPTION AGAINST ADOPTION The Mayor thereupon declared the Resolution duly passed and adopted this 23rd day of July, A.D. , 1998 .
