Tom, attached are 18 packets and plans for the above subject project which was reviewed by
the Community Appearance Board on April 15, 1998.
The Board reviewed the landscape plans and the requested waivers and expressed the
following concerns with the application:
O The Board discussed the waiver for the existing 28' entranceway on Tequesta Drive
and questioned why a waiver was being requested instead of reducing the size to
the required 24'. The Board agreed to the waiver request with the addition of
ground cover at the right-of-way entrance on Tequesta Drive.
O The Board discussed the waiver request for canopy trees along Tequesta Drive
every 30'. The plan calls for two trees in lieu of the required 6. The Board accepted
this waiver with an increase in the size of the two oak trees to 14' in height.
O The Board discussed the requirement for a hedge for screening the parking area
that abuts the large open area on Seabrook Road. The applicant requested a
variance for security purposes and added that the owner planned to construct a new
building on this section and any landscaping added would have to be removed.
Motion to approve the proposed landscaping and waivers with the following revisions:
1. The two oak trees on Tequesta Drive will be 14' overall instead of 12'.
2. Ground covers will be added at the right-of-way entrance on Tequesta Drive and the
exit onto Seabrook Road on the north side.
Vote on the motion: 5-0 to approve.
Staff Comments: See attached memo. Parking for business and professional services is
calculated at one parking space per three hundred square foot of gross leasable area: approx.
3100 sq. ft. / 11 parking spaces required / 18 parking spaces provided.

STAFF COMMENTS REGARDING REQUESTED WAIVERS:
Waiver Number Comments
1. There is no valid justification for the waiver,as 28'of width for the
entrance off Tequesta Drive is much more than is needed at that
location. The Plan indicates that the entrance will be an entrance
only(one-way arrow in),with the exit being proposed it Seabrook Road
(one-way arrow out). The proposed exit is appoximately 16'in width,
therefore;28'for the one-way in entrance off Tequesta Drive is not
appropriate or justifiable. Staff recommends reducing the entrance width
------ to-an-appropriate-widt -for-a-one-way-in-entrance.
2. No Comments.
3. There is room at this location to provide more than the two trees indicated
on the plan. The code requirement would dictate that at a minimum,three
more trees go in for a total of five along the front property line at Tequesta
Drive. Staff recommends adding three additional trees to the proposed
plan for a total of five trees.
4. There is no valid reason for not installing the required hedge at this
location. Staff recommends that the required 24"high hedge be added to
the plan.

After review of the plan you sent me,it looks like all of the work is going to be
done on private property. However,the water service is located in the asphalt
driveway(see plan). If the improvements change and include any type of •
asphalt overlay with the existing driveway I would like 48 hrs.notice to relocate
the meter.
The water service will need a RPZ type backflow preventor. It will have to be
located at the first available area outside of the asphalt.

WAIVER JUSTIFICATION
The Magyar property is requesting consideration of six waivers concerning Ordinance 377,
Section X (H) Landscape General Requirements, of the Tequesta Zoning Ordinance. The
waiver requests are as follows:
1. A.24'maximum drive width is required entering a site from a public right of way. A
28'dive is provided.
2. A 10' landscape buffer is required when the vehicular use area abuts a public/private
right of way. A 3.2'to 11' landscape buffer is provided along the north property line.
3. One canopy tree is required every 30'where the vehicular use area abuts the
northern property tree. Six trees are required,two are provided.
4. A 24" high hedge at time of planting is required to screen out parking area. None is -
provided.
5. One canopy tree is required every 30' on center where the vehicular use area abuts
the south property line. None are provided. Neighboring properties to the south are
heavily vegetated and screened.
6. A 4' landscape strip is required along the front of the existing building. Planters,
3'x3', are provided that are planted with Podocarpus shrubs.
Please refer to the attached landscape plan for locations of waivers.

This letter is to confirm the action of the Village of Tequesta Community Appearance Board at their
April 15, 1998, meeting approving all waivers and landscaping per your plan No. CAD01224, revision
dated 3/27/98, Sheet L.1,with the following revisions:
1. Two (2) oak trees on Tequesta Drive be 14' overall height instead of 12'.
2. Ground covers added at entrance and exit, possibly Indian Hawthorn.
As you are aware, this project must be reviewed by the Village Council for approval of the requested
landscape waivers and, will be placed on the agenda of the May 14, 1998 Council meeting. You and
/or your representative will need to be in attendance at this meeting to present your application to the
Council.

V. NEW BUSINESS
1. An application from George G. Gentile & Assoc. for review
of the landscape plans for Ordinance #377 compliance for
Magyar Property, 390 Tequesta Drive.
Jason Litterick, representing George G. Gentile &
Associates, requested approval of six waivers and
reviewed the landscape plan. Boardmember Coben
questioned why the entranceway was 28 ' wide, to which
George Gentile responded that the entranceway already
existed and was one-way, and that the extra width was
needed to accommodate delivery trucks and to give them a
little extra room turning radius just inside the
entrance. Mr. Gentile explained that asphalt was being
removed and would be replaced with a landscape hedge.
Boardmember Coben questioned whether the Board should
grant a waiver for a 28' driveway since other precedents
were off U.S. Highway One, and this entrance could be
tapered. Mr. Gentile explained that nine feet of asphalt
in the drive would be removed for the hedge. Mr. Gentile
suggested pulling the hedge back and adding groundcover
in the corner, possibly Indian Hawthorne, to look like a
tiered landscape area at the corner. After discussion
regarding what could or could not be placed within the
right-of-way, it was agreed to do a landscape grouping on
both sides and to keep the 28 ' width. waiver requests
were discussed. A change to waiver number 3 was made to
increase the size of the two oaks on Tequesta Drive to
14 ' . Mr. Gentile explained that the large open space
requested in waiver number 4 was for security purposes
since the owner had had break-ins, and since the owner
planned to construct a new building on this section of
the property, any landscaping added at this time would
have to be removed.
Boardmember Coben made a motion to accept the application

The motion was therefore approved and adopted.
Chair Cook commented that the staff comments provided
were very good. Mr. Gentile requested that staff
comments be provided to the applicant before the meeting
in the future so that responses could be ready.
2. An application from Parker-Yannette Design Group,
Landscape Architects, for review of landscape plans for
Ordinance 377 compliance for 209 Tequesta Drive, Judith
Fagan, property owner.
Steve Parker, Landscape Architect with Parker-Yannette
Design Group, presented the project and noted that
property owner Judith Fagan was present. Mr. Parker
explained that one of the waiver requests was that the
gross parking area landscaped was under by 4%, but that
the front was heavily landscaped. Perimeter trees were
proposed, and removing one landscape island in the center
of the parking lot was proposed. Boardmember Coben
questioned the use for this property, which Mr. Parker
explained was to be determined, and at this point the
only approval sought was for Ordinance 377 compliance.
