Bradford,Village Manager From: Joann Manganiello,Assistant Village Manager/Village Clerk?( Date: February 25, 1998 Subject: Resolution No. 19-97/98 -Approving the Village of Tequesta Urban Services Report and Authorizing the Transmittal of the Same to the Board of County Commissioners of Palm Beach County; Agenda Item Florida Statutes, Section 171.042, specifies certain prerequisites to Annexation for which the governing body of the municipality is responsible: The preparation of a report setting forth the plans to provide urban services to any area to.be annexed; and the filing of a copy of the report with the Board of County Commissioners of the county wherein the municipality is located. The Village of Tequesta Urban Services Report has been prepared and contains all the information and associated maps required by Florida Statute. It is attached to Resolution No. 19-97/98 as Exhibit "A". Adoption of Resolution 19-97/98 by the Village Council approves the Urban Services Report and authorizes the transmittal (filing)of a copy of the Report to the Board of County Commissioners of Palm Beach County as required by Florida Statute. There are three(3)areas proposed for Annexation in Calendar Years 1998 and 1999 in the Urban Services Report: Area 2 - Bermuda Terrace and Pine Tree Drive West of the Centerline of the Northfork • of the Loxahatchee River; Area 6- County Line Road Vest of and Including the Florida East Coast(FEC)Railway Right-of-Way; and Area 10-Waterway Village These proposed Annexation Areas were recommended by Staff and approved by the Village Council for future Annexation Referendums. It is my recommendation that the Village Council approve the Urban Services Report and transmittal of the same to the Palm Beach County Board of County Commissioners so that Staff may be in a position to commence annexation procedures per the direction of the Village Council. JM/mk Enclosures CIukc.Res.19-9798 -r1 RESOLUTION NO. 19 - 97/98 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, APPROVING THE VILLAGE OF TEQUESTA URBAN SERVICES REPORT REFERENCED HEREIN, WHICH REPORT SETS FORTH PLANS TO PROVIDE URBAN SERVICES TO AREAS PROPOSED TO BE ANNEXED TO THE VILLAGE OF TEQUESTA, AND AUTHORIZING THE TRANSMITTAL OF A COPY OF THE REPORT TO THE BOARD OF COUNTY COMMISSIONERS OF PALM BEACH COUNTY, FLORIDA. WHEREAS, the Village of Tequesta desires to annex certain properties to the Corporate Limits of the Village of Tequesta; and WHEREAS, Section 171. 042, Florida Statutes, sets forth certain prerequisites to annexations; and WHEREAS, one of those prerequisites is that the governing body of the municipality shall prepare a report setting forth the plans to provide urban services to any area to be annexed; and WHEREAS, said Urban Services Report has been prepared and is attached hereto as Exhibit "A" ; and WHEREAS, it is the desire of the Village Council of the Village of Tequesta to approve said report and to file a copy of the same with the Board of County Commissioners of Palm Beach County, Florida. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1. The Urban Services Report attached hereto as Exhibit "A" , prepared pursuant to Section 171. 042, Florida Statutes, and containing all of the information required by i said Statute, is hereby approved. Section 2 . Pursuant to Section 171. 042, a copy of the Urban Services Report herein approved shall be submitted to the Board of County Commissioners of Palm Beach County, Florida. Schauer ATTEST: Joann Manganiello Village Clerk • wp60\res\annex • VILLAGE OF TEQUESTA URBAN SERVICES REPORT CALENDAR YEAR 1998 - 1999 PROPOSED ANNEXATION EXHIBIT "A" b VILLAGE OF TEQUESTA URBAN SERVICES REPORT CALENDAR YEAR 1998 - 1999 PROPOSED ANNEXATION AREA 2 Bermuda Terrace-Pine Tree Drive West of the Centerline of the Northfork of the Loiahatchee River This Urban Services Report has been prepared in compliance with Florida Statutes, Chapter 171, by Village of Tequesta Staff in preparation for one Annexation Referendum Question. A set of maps are attached as Exhibit "1", showing the present and proposed municipal boundaries, the present major water mains, sewer interceptors and outfalls, the proposed extension of such mains and outfalls(if necessary), and the general land use pattern of the proposed annexation area. The proposed annexation area is identified as: Area 2_ This is to certify that the area to be annexed meets the criteria in Section 171.043 of the Florida Statutes. The area proposed for annexation(Area 2), is contiguous to the existing Village boundaries and is reasonably compact. Area 2 is almost entirely developed for urban purposes. Area 2 contains a total population of 311. and averages 4.57 persons per acre. Undeveloped portions comprise approximately 10%of the land area to be annexed. The Village of Tequesta is a full service municipality providing a complete range of urban services. The current residential population of the Village of Tequesta is 4,686, with an average of 3.14 persons per acre. The services provided to current Village residents will be extended to residents and properties in the proposed annexation area. Police Services: The Village of Tequesta currently operates a full service Police Department, which also includes a Level 2 Certified Code Enforcement Officer. The average response time to an emergency call by Tequesta Police is 1.5 minutes. The Village is presently divided.into two patrol zones. Upon the effective date of annexation, Police Services will be extended in the same manner and to the same level of service as provided within current corporate limits. There would not be a need for increased Police service if Area 2 were to be annexed into the Village. Fire-Rescue Services: The Village of Tequesta currently operates a full service Fire-Rescue Department, which includes ambulance transport. The average response time to an emergency call by Tequesta Fire-Rescue is 3.17 minutes. Upon the effective date of annexation,Fire-Rescue Services will be extended in the same manner and to the same level of service as provided within current corporate limits. There would not be a need for increased Fire-Rescue service if Area 2 were to be annexed into the Village. Water Service: The Village currently operates a water utility with service area inclusive of the Village, certain unincorporated Palm Beach County, part of the Town of Jupiter, south Martin County unincorporated, and all of Jupiter Inlet Colony. All of the areas within current Village boundaries are provided with water utility service. The area to be annexed is within the existing water service boundaries of the Village. System improvements'would be necessary to provide the same level of service to annexed residents as provided to current Village residents which consist of the following: 1) Along Pine Tree Drive within Area 2, Capital Expenditure expenses estimated at$25,000 would be required to extend service mains to an estimated seventeen(17)single-family homes. Potential Sources of these funds are various: 1. Village.of Tequesta Fiscal Year 97/98 Capital Improvement Budget. These improvements are currently unbudgeted expenditures in FY 98 or beyond. 2. Residents could pay funds sufficient to provide the service. 3. ' The Village,Palm Beach County, and the Residents could enter into agreement pursuant to the "Annexation Incentive Program," as administered by the County Engineering Department. The agreement would provide for cost sharing by the parties of all expenses. 4. The Village could create a special district or a special assessment to provide the necessary improvements. 5. Certain combinations of the above referenced sources. Construction of each system improvement is contemplated to commence during the Fiscal Year 1998/1999. Sewer Service: Sanitary sewer service is provided by the Loxahatchee River Environmental Control District (ENCON) throughout the Village and surrounding areas. With the exception of two lots in Bermuda Terrace, Area 2 is not currently serviced by ENCON. Since there is currently no Village-wide requirement that existing septic systems be disallowed and property owners forced to hook up to sewer, there would be no requirement by the Village of Tequesta in a newly annexed area that the use of septic systems be discontinued. The Village's development codes require that all new subdivisions be served by sanitary sewer. This requirement would apply only to new development of platted subdivisions in the annexed area. Streets and Drainage: The Village of Tequesta currently maintains all Village-owned streets within the corporate boundaries, which includes all public roadways with the exception of U.S. Highway One, County Road 707 (Beach Road), Bay Harbor Road, portions of County Line Road, and Old Dixie Highway. Streets in Area 2 are currently owned and maintained by Palm Beach County. These streets are anticipated to be maintained by the Village with minimal additional operating expenditures estimated at less than $200.00 per year. An initial improvement expense would be incurred for provision of stop signs, stop bars,and street signs,the cost of which is estimated to be $900.00. Adding street lights to the same level of service as provided in the remainder of the Village is estimated to cost an additional $75.00 per light per year for a total yearly cost of$300.00. Required drainage improvements would be a one time only cost of$8,500.00. Area 2 includes an estimated 0.8 lane miles of essentially unimproved roadway owned and maintained by Palm Beach County. Upon annexation, this substandard street will require improvements estimated at $230,000 in order to construct a new roadway and install drainage. Potential sources of these funds are various: 1. Village of Tequesta Fiscal Year 97/98 Capital Improvement Budget. These improvements are currently unbudgeted expenditures in FY 98 or beyond. 2. Residents could pay funds sufficient to provide the improvements. 3. Local recreational needs are also provided through Coral Cove Park, a 6.25 acre ocean- front park operated by Palm Beach County and located within the corporate limits of the Village. Annexation of Area 2 will require no additional expense as all of these facilities are currently used by Village and Palm Beach County residents alike_ Community Development: The Village currently provides community development services through the Department of Community Development which issues building permits, reviews site plans, issues certificates of occupancy, ensures that development complies with the Village's Comprehensive Development Plan and handles other issues relating to the development of the Village. The Department of Community Development also provides for zoning regulation and rezoning of Village land areas_ The zoning of the area proposed for annexation may be redesignated within one to two years of the date of annexation. Particular care will be exercised in redesignation,in order to assure that full development rights will be preserved for newly annexed areas. Further information on the proposed annexation may be obtained through the Department of Community Development. A set of maps are attached as Exhibit "1", showing the present and proposed municipal boundaries, the present major water mains, sewer interceptors and outfalls, the proposed extension of such mains and outfalls (if necessary), and the general land use pattern of the proposed annexation area. There is one proposed annexation area identified as: Area 6. This is to certify that the area to be annexed meets the criteria in Section 171.043 of the Florida Statutes. The area proposed for annexation(Area 6), is contiguous to the existing Village boundaries and is reasonably compact. Area 6 is almost entirely developed for urban purposes. Area 6. contains a total population of 393, and averages 17.21 persons per acre. Undeveloped portions comprise approximately 2%of the land area to be annexed. The Village of Tequesta is a full service municipality providing a complete range of urban services. The current residential population of the Village of Tequesta is 4,686, with an average of 3.14 persons per acre. The services provided to current Village residents will be extended to residents and properties in the proposed annexation area. Area 10 includes an estimated 2.4 lane miles of streets owned and maintained by the Waterway Village Property Owners' Association. If, upon annexation, these streets were dedicated to the Village, approximately 10 to 15 hours per month would be required in general maintenance. An initial outlay of$1,200.00 would be required to improve and/or add stop bars, stop signs, and street signs. Resurfacing of Waterway Village roads is anticipated to cost $55,000 in the next 3 to 5 years. Adding street lights to the same level of service as provided in the remainder of the Village is estimated to cost an additional $75.00 per light per year for a total yearly cost of $450.00. Drainage improvements will be required in Area 10. The Public Works Department estimates the repairing of cracked structures at $10,000. Other drainage system improvements could cost up to $150,000 in the next 2 to 4 years. This estimate includes $120,000 in drainage improvements to Waterway Road and $30,000 in repairs to existing drainage infrastructure. The Village of Tequesta Urban Services Report has been prepared and contains all the information and associated maps required by Florida Statute. It is attached to Resolution No. 19-97/98 as Exhibit "A". Adoption of Resolution 19-97/98 by the Village Council approves the Urban Services Report and authorizes the transmittal(filing)of a copy of the Report to the Board of County Commissioners of Palm Beach County as required by Florida Statute. There are three (3)areas proposed for Annexation in Calendar Years 1998 and 1999 in the Urban Services Report: Area 2 - Bermuda Terrace and Pine Tree Drive West of the Centerline of the Northfork • of the Loxahatchee River; Area 6- County Line Road West of and Including the Florida East Coast(FEC)Railway Right-of-Way; and Area 10-Waterway Village These proposed Annexation Areas were recommended by Staff and approved by the Village Council for future Annexation Referendums. Schauer ATTEST: Joann Manganiello Village Clerk wp60\res\annex VILLAGE OF TEQUESTA URBAN SERVICES REPORT CALENDAR YEAR 1998 - 1999 PROPOSED ANNEXATION EXHIBIT "A" • VILLAGE OF TEQUESTA URBAN SERVICES REPORT CALENDAR YEAR 1998 - 1999 PROPOSED ANNEXATION AREA 2 Bermuda Terrace-Pine Tree Drive West of the Centerline of the Northfork of the Loxahatchee River This Urban Services Report has been prepared in compliance with Florida Statutes, Chapter 171, by Village of Tequesta Staff in preparation for one Annexation Referendum Question. A set of maps are attached as Exhibit "1", showing the present and proposed municipal boundaries, the present major water mains, sewer interceptors and outfalls, the proposed extension of such mains and outfalls(if necessary), and the general land use pattern of the proposed annexation area. The proposed annexation area is identified as: Area 2. This is to certify that the area to be annexed meets the criteria in Section 171.043 of the Florida Statutes. The area proposed for annexation(Area 2), is contiguous to the existing Village boundaries and is reasonably compact. Area 2 is almost entirely developed for urban purposes. Area 2 contains a total population of 311. and averages 4.57 persons per acre. Undeveloped portions comprise approximately 10%of the land area to be annexed. The Village of Tequesta is a full service municipality providing a complete range of urban services. The current residential population of the Village of Tequesta is 4,686, with an average of 3.14 persons per acre. The services provided to current Village residents will be extended to residents and properties in the proposed annexation area. Police Services: The Village of Tequesta currently operates a full service Police Department, which also includes a Level 2 Certified Code Enforcement Officer. The average response time to an emergency call by Tequesta Police is 1.5 minutes. The Village is presently divided into two patrol zones. Upon the effective date of annexation,Police Services will be extended in the same manner and to the same level of service as provided within current corporate limits. There would not be a need for increased Police service if Area 2 were to be annexed into the Village. Fire-Rescue Services: The Village of Tequesta currently operates a full service Fire-Rescue Department, which • includes ambulance transport. The average response time to an emergency call by Tequesta Fire-Rescue is 3.17 minutes. Upon the effective date of annexation, Fire-Rescue Services will be extended in the same manner and to the same level of service as provided within current corporate limits. There would not be a need for increased Fire-Rescue service if Area 2 were to be annexed into the Village. Water Service: The Village currently operates a water utility with service area inclusive of the Village, certain unincorporated Palm Beach County, part of the Town of Jupiter, south Martin County unincorporated, and all of Jupiter Inlet Colony. All of the areas within current Village boundaries are provided with water utility service. The area to be annexed is within the existing water service boundaries of the Village. System improvements would be necessary to provide the same level of service to annexed residents as provided to current Village residents which consist of the following: 1) Along Pine Tree Drive within Area 2, Capital Expenditure expenses estimated at$25,000 would be required to extend service mains to an estimated seventeen(17) single-family homes. Potential Sources of these funds are various: 1. Village of Tequesta Fiscal Year 97/98 Capital Improvement Budget. These improvements are currently unbudgeted expenditures in FY 98 or beyond. . 2. Residents could pay funds sufficient to provide the service. 3. The Village,Palm Beach County, and the Residents could enter into agreement pursuant to the "Annexation Incentive Program," as administered by the County Engineering Department. The agreement would provide for cost sharing by the parties of all expenses. 4. The Village could create a special district or a special assessment to provide the necessary improvements. 5. Certain combinations of the above referenced sources. Construction of each system improvement is contemplated to commence during the Fiscal Year 1998/1999. Sewer Service: Sanitary sewer service is provided by the Loxahatchee River Environmental Control District (ENCON) throughout the Village and surrounding areas. With the exception of two lots in Bermuda Terrace, Area 2 is not currently serviced by ENCON. Since there is currently no Village-wide requirement that existing septic systems be disallowed and property owners forced to hook up to sewer, there would be no requirement by the Village of Tequesta in a newly annexed area that the use of septic systems be discontinued. The Village's development codes require that all new subdivisions be served by sanitary sewer. This requirement would apply only to new development of platted subdivisions in the annexed area. Streets and Drainage: The Village of Tequesta currently maintains all Village-owned streets within the corporate boundaries, which includes all public roadways with the exception of U.S. Highway One, County Road 707 (Beach Road), Bay Harbor Road, portions of County Line Road, and Old Dixie Highway. Streets in Area 2 are currently owned and maintained by Palm Beach County. These streets are anticipated to be maintained by the Village with minimal additional operating expenditures estimated at less than $200.00 per year. An initial improvement expense would be incurred for provision of stop signs, stop bars,and street signs,the cost of which is estimated to be$900.00. Adding street lights to the same level of service as provided in the remainder of the Village is estimated to cost an additional$75.00 per light per year for a total yearly cost of$300.00. Required drainage improvements would be a one time only cost of$8,500.00. Area 2 includes an estimated 0.8 lane miles of essentially unimproved roadway owned and maintained by Palm Beach County. Upon annexation, this substandard street will require improvements estimated at $230,000 in order to construct a new roadway and install drainage. Potential sources of these funds are various: 1. Village of Tequesta Fiscal Year 97/98 Capital Improvement Budget. These improvements are currently unbudgeted expenditures in FY 98 or beyond. 2. Residents could pay funds sufficient to provide the improvements. 3. The Village,Palm Beach County, and the Residents could enter into agreement pursuant to the "Annexation Incentive Program," as administered by the County Engineering Department. The agreement would provide for cost sharing by the parties of all expenses. 4. The Village could create a special district or a special assessment to provide the necessary improvements. 5. Certain combinations of the above referenced sources. Construction of each system improvement is contemplated to commence during the Fiscal Year 1998/1999. Recreation: The Village currently operates Tequesta Park, a 42 acre, active park located in Martin County on County Line Road; Constitution Park, a 4 acre neighborhood park located on Seabrook Road;and Village Green Park, a 1 acre passive park located on Tequesta Drive. Local recreational needs are also provided through Coral Cove Park, a 6.25 acre ocean- front park operated by Palm Beach County and located within the corporate limits of the Village. Annexation of Area 2 will require no additional expense as all of these facilities. are currently used by Village and Palm Beach County residents alike. Community Development: The Village currently provides community development services through the Department of Community Development which issues building permits, reviews site plans, issues certificates of occupancy, ensures that development complies with the Village's Comprehensive Development Plan and handles other issues relating to the development of the Village. The Department of Community Development also provides for zoning regulation and rezoning of Village land areas. VILLAGE OF TEQUESTA URBAN SERVICES REPORT CALENDER YEAR 1998 - 1999 PROPOSED ANNEXATION AREA 6 County Line Road East of and Including F.E.C.Railway Right-of-Way This Urban Services Report has been prepared in compliance with Florida Statutes, Chapter 171, by Village of Tequesta Staff in preparation for one Annexation Referendum Question. A set of maps are attached as Exhibit "1", showing the present and proposed municipal boundaries, the present major water mains, sewer interceptors and outfalls, the proposed extension of such mains and outfalls(if necessary), and the general land use pattern of the proposed annexation area. There is one proposed annexation area identified as: Area 6. This is to certify that the area to be annexed meets the criteria in Section 171.043 of the Florida Statutes. The area proposed for annexation(Area 6), is contiguous to the existing Village boundaries and is reasonably compact. Area 6 is almost entirely developed for urban purposes. Area 6 contains a total population of 393, and averages 17.21 persons per acre. Undeveloped portions comprise approximately 2%of the land area to be annexed. The Village of Tequesta is a full service municipality providing a complete range of urban services. The current residential population of the Village of Tequesta is 4,686, with an average of 3.14 persons per acre. The services provided to current Village residents will be extended to residents and properties in the proposed annexation area Police Services: The Village of Tequesta currently operates a full service Police Department, which also includes a Level 2 Certified Code Enforcement Officer. The average response time to an emergency call by Tequesta Police is 1.5 minutes. The Village is presently divided into two patrol zones. Upon the effective date of annexation, Police Services will be extended in the same manner and to the same level of service as provided within current corporate limits. There would not be a need for increased Police service if Area 6 were to be annexed into the Village. Fire-Rescue Services: The Village of Tequesta currently operates a full service Fire-Rescue Department, which includes ambulance transport. The average response time to an emergency call by Tequesta Fire-Rescue is 3.17 minutes. Upon the effective date of annexation,Fire-Rescue Services will be extended in the same manner and to the same level of service as provided within current corporate limits. There would not be a need for increased Fire-Rescue service if Area 6 were to be annexed into the Village. Water Service: The Village currently operates a water utility with service area inclusive of the Village, certain unincorporated Palm Beach County, part of the Town of Jupiter, south Martin County unincorporated, and all of Jupiter Inlet Colony. All of the areas within current Village boundaries are provided with water utility service. The area to be annexed is within the existing water service boundaries of the Village. No system improvements would be necessary. Sewer Service: Sanitary sewer service is provided by the Loxahatchee River Environmental Control District (ENCON) throughout the Village and surrounding areas. Currently, Tequesta I Its and Cypress Manor, which are included in Area 6, are connected to ENCON sewer service_ As for the remainder of Area 6, it is not currently serviced by ENCON. Since there is currently no Village-wide requirement that existing septic systems be disallowed and property owners forced to hook up to sewer, there would be no requirement by the Village of Tequesta in a newly annexed area that the use of septic systems be discontinued. The Village's development codes require that all new subdivisions be served by sanitary sewer. This requirement would apply only to new development of platted subdivisions in the annexed area. Streets and Drainage: The Village of Tequesta currently maintains all Village-owned streets within the corporate boundaries, which includes all public roadways with the exception of U.S. Highway One, County Road 707 (Beach Road), Bay Harbor Road, portions of County Line Road, and Old Dixie Hiighway. No additional costs are anticipated for this area. Recreation: The Village currently operates Tequesta Park, a 42 acre, active park located in Martin County on County Line Road; Constitution Park, a 4 acre neighborhood park located on Seabrook Road; and Village Green Park, a 1 acre passive park located on Tequesta Drive. Local recreational needs are also provided through Coral Cove Park, a 6.25 acre ocean- front park operated by Palm Beach County and located within the corporate limits of the Village. If, upon annexation, these streets were dedicated to the Village, approximately 10 to 15 hours per month would be required in general maintenance. An initial outlay of$1,200.00 would be required to improve and/or add stop bars, stop signs, and street signs. Resurfacing of Waterway Village roads is anticipated to cost $55,000 in the next 3 to 5 years. Adding street lights to the same level of service as provided in the remainder of the Village is estimated to cost an additional $75.00 per light per year for a total yearly cost of $450.00. Drainage improvements will be required in Area 10. The Public Works Department estimates the repairing of cracked structures at $10,000. Other drainage system improvements could cost up to $150,000 in the next 2 to 4 years. This estimate includes $120,000 in drainage improvements to Waterway Road and $30,000 in repairs to existing drainage infrastructure. Potential sources of these funds are various: 1. Village of Tequesta Fiscal Year 97/98 Capital Improvement Budget. These improvements are currently unbudgeted expenditures in FY 98 or beyond. 2. Residents could pay funds sufficient to provide the improvements. 3. The Village,Palm Beach County, and the Residents could enter into agreement pursuant to the "Annexation Incentive Program," as administered by the County Engineering Department. The agreement would provide for cost sharing by the parties of all expenses. 4. The Village could create a special district or a special assessment to provide the necessary improvements. 5. Certain combinations of the above referenced sources. Construction of each system improvement is contemplated to commence during the Fiscal Year 1998/1999.
