Hall, Water System Manager Date: February 27, 1998 Subject: Engineering Services Proposal for Water Treatment Plant Construction Please find attached, an engineering services proposal from the firm of Reese, Macon & Associates, Inc. , of Lake Worth, Florida, in the total amount of $410, 000 . • This Proposal is for engineering services relative to the construction of the Reverse Osmosis Treatment Facility, more specifically, Phase III. Services provided under this Proposal will encompass contract administration, provision of a full-time on-site representative, and upon completion of construction, administration services relative to start-up and running of the new facility. Funding will be provided by the Water Enterprise Fund, Capital Projects Account, with funds provided by the bond proceeds. Please place this item on the Village Council Agenda of March 5, 1998, for approval. Also, you will find attached, a summary sheet indicating the initial budget concept for the RO Plant construction. Hall RE: Reverse Osmosis Treatment Plant Engineering/Construction Services,Phase III-Construction Services Gentlemen: We are pleased to submit this authorization for engineering services in connection with the Village's reverse osmosis treatment plant. These services cover the third and final phase of the treatment facility including construction, start-up and initial operating assistance. REESE,MACON and ASSOCIATES, INC.,hereinafter referred to as the Engineer,shall perform the services as documented below for the Village of Tequesta,hereinafter referred to as the Client. SCOPE The Engineer and Client understand that this work shall be for and construction related engineering services for the ultimate 3.6/4.8 MGD R/O facility,initially sized for 1.2 MGD. This work includes providing full time, onsite,project representation during the plant construction and engineering services related to contract administration such as,weekly status meetings, shop drawing review,pay request reviews,project schedules,regulatory certifications, equipment testings,project close-out and staff training/supervision after construction completion. The following specific tasks will be performed by the Engineer as authorized: Phase III-Construction Services 1. Perform construction contract administration services to include all engineering duties set forth in the General Conditions and Supplementary General Conditions. 2. Provide a full time, on-site resident project representative. 3. Provide start-up administration services to the Village upon completion of construction to assist personnel in the daily running of the new facility. The following specific information and/or items shall be furnished at no cost to the Engineer: 1. All permit application and government inspection fees. • TIME OF PERFORMANCE(Phase III) The Engineer will complete Phase III(Scope Items 1 and 2), commensurate with the construction contract which is 540 days(18 months)from Notice to Proceed to final completion. Scope Item 3 will continue for 90 days after final completion date of the plant. FEES(Phase III-Construction Services) For Scope Item 1 under Phase III,the Engineer shall be paid a lump sum fee of One Hundred Seventy Five Thousand Dollars($175,000). For Scope Item 2 under Phase III,the Engineer shall be paid a lump sum fee of Two Hundred Five Thousand Dollars ($205,000). For Scope Item 3 under Phase III,the Engineer shall be paid a lump sum fee of Thirty Thousand Dollars ($30,000). The fees established herein are based upon completion of the construction contract within the time prescribed"in the contract. Any increase in the construction contract duration will result in an increase in the fee. In the event this should occur,the Engineer will notify the Client in writing and secure approval of any increase prior to performing the work. Invoices for services rendered are issued on a monthly basis and are due within thirty(30) days of the invoice date. Interest at a compound rate of one and one-half percent per month shall be charged to any past due statements. Interest shall be computed on past due statements from the date of the invoice. COST ESTIMATES Construction cost estimates are developed from knowledge of market conditions and based on the experience of the Engineer. However,the Engineer exercises no control over the competitive bidding process and,therefore,makes no guarantee of the accuracy of the estimate when compared to previous estimates or actual bids. TERMINATION This agreement may be terminated by either party by giving thirty(30)days written notice. The Engineer shall be paid for all services rendered prior to the termination date. ACCEPTANCE • Acceptance of this proposal may be indicated by executing this document in the space provided below. The Engineer shall proceed with work on only the specific phase(s)authorized by the Owner. The Engineer understands the Owner's intent to issue separate authorizations for each phase. This contract shall be considered void if not executed within thirty(30)days from the above date. Upon execution of this agreement the Client shall return one copy to the Engineer.
