Ladd, Director of Community Development Date: February 2, 1998 Subject: Ordinance No. 377 Landscape Waiver Request • Community Appearance Board Project Recommendation PROJECT: Ocean Towers North Condominium 200 Beach Road, Tequesta Emily O'Mahoney, O'Mahoney Design.Group, Landscape Architect Tom, attached are 18 packets and plans for the above subject project which was reviewed by the Community Appearance Board on December 3, 1997. The Board reviewed the landscape plans and the requested waivers and expressed the following concerns with the application: O The Board was advised that they were proposing to plant three Noronhia trees on the north property line by cutting out spaces on the parking stripes. O The Board was advised that this plan had been drawn to coordinate with the landscape plan drawn for the Regency Condominium, which was adjacent to the north, but that the Regency had withdrawn their plan. O The Board discussed planting more and different trees and suggested five coconut palms. O This condominium has 30 units which requires 60 parking spaces by Code, but provides for only 52 parking spaces. Motion to approve the proposed landscaping and waivers as submitted, except for the following amendments: 1. Five coconut palms with 3' clear trunk and 16' overall height shall be substituted for the three proposed Noronhia trees. 2. This plan shall be implemented within one year of Village Council approval. Vote on the motion: 5-0 to approve. Additional Comments: The attached letter dated January 30, 1998 from Emily O'Mahoney states that the Condominium Board of Ocean Towers strongly disagrees with the above CAB changes. The CAB approved the submitted plan with modifications. Currently,the plan • was resubmitted for Village Council and we await a February 12 presentation date. rThe Condominium Board of Ocean Towers North was unable to have a representative present at the CAB meeting other than Steve Inglis from Bristol Management. The CAB riequested that the 3 Noronia trees be replaced by 5 Coconut palms. The changes were made and resubmitted. Unfortunately,the Board strongly disagrees with the change. They do not want coconuts dropping on their cars. They would prefer the original plant selection of Noronhias of which there are beautiful examples along their south property line. They feel that the shade trees will more effectively block the sight of The Regency. As to the difference in tree quantities,the Board wishes to point out that The Regency tpexty to the north)recently planted a Coconut palm between the two parking lots feet onto Ocean Tower's property to avoid utility lines). An application from Ocean Towers North Condominium, 200 Beach Road, O'Mahoney Design Group, Landscape Architects, for review of landscape plans for Ordinance #377 compliance. Emily O'Mahoney, Landscape Architect, introduced Steve English of Bristol Management Company, who maintained several properties on Beach Road. Chair Cook discussed the "hatchet job" that had been done on trees on Point Drive by Florida Power and Light, which she feared would kill the trees, and stated that she planned to write them a letter. . Ms. O'Mahoney reviewed the existing landscaping and the proposed planting plan, and recommended that three Noronhia trees be added by cutting out spaces on the parking stripes. Ms. O'Mahoney explained that the adjacent property had originally planned to submit plans • along with this plan, and that she had developed landscaping along the property line on their side which would help Ocean Towers North; however, the adjacent Regency Condominium had withdrawn. It was recommended Community Appearance Board Meeting Minutes December 3, 1997 Page 6 that when they did submit plans that they be required to fill in the spaces along the property line with trees which could not be done on the Ocean Towers North side. Ms. O'Mahoney explained that the existing landscaping on this parcel was well maintained, and reviewed the proposed waivers for the new plan. Boardmember Coben suggested that more trees be installed. Ms. O'Mahoney recommended that trees be installed at 6' height to allow them more time to get used to the wind as they grew. Discussion ensued regarding using palm trees. Vice Chair Strahan suggested that five coconut palms be installed. Boardmember Coben made a motion to accept the application from Ocean Towers North Condominium, 200 Beach Road, for landscape plans and waivers for Ordinance #377 compliance as submitted, except for the following amendments: 1. Five coconut palms with 3' clear trunk and 16' overall height shall be substituted for the three proposed Noronhia trees. 2. Chair Cook commented that she wanted to make sure these properties were being followed by the Code Enforcement Officer. Vice Chair Strahan inquired as to what was being done on the Cypress Drive properties, to which Clerk of the Board Scott D. Ladd responded that the Village had placed those on hold because of drainage work that must be done. VII. ANY OTHER MATTERS Vice Chair Strahan commented that Lord Chumley' s had a sign on a vehicle reading, Lord Chumley's is Here. During ensuing discussion, Clerk of the Board Scott D. Ladd explained that the Police Department had thoroughly researched that type of sign and that they were allowed; and that shopping centers could prevent those types of signs by modifying tenant leases when they became due.
