Memorandum
To: Villag& Council
From: Thomas G. Bradford, Village Manager 1.
Date: February 4, 1998
Subject: Interlocal Agreement Between Jupiter. and Tequesta for
Joint Funding of Maintenance of the Dover Ditch; Agenda
Item
The attached Interlocal Agreement has been worked out between the
. staffs of Jupiter and Tequesta, as well as the Attorneys for each
municipality. The Agreement was conceptually approved by the
Town Council of Jupiter at their Meeting on January 20, 1998.
The Agreement is fairly straightforward, setting forth the
percentage contributions to future maintenance to be paid by each
municipality, 40% to Jupiter, and 60% to Tequesta, based on the
parties current respective shares of total permitted discharge to
the Dover Ditch. Currently, third-party maintenance costs
associated with the Dover Ditch maintenance is running $800 per
month, to be divided pursuant to the 60/40 split upon execution
of the Agreement.
Upon formal adoption of the Agreement, Tequesta will withdraw its
Petition for an Administrative Hearing, entered on December 19,
1997, over our concern with this very issue.
It is recommended that the Village Council adopt the Resolution
approving .the Interlocal Agreement and authorizing the Mayor to
sign the same on behalf of the Village.
