Public Notice is hereby given that the Village Council of the Village of Tequesta will hold a
Public Hearing during the Village Council meeting Thursday;November 13, 1997, beginning at
7:00 P.M., in the Village Hall,357 Tequesta Drive,Tequesta,Florida,to consider:
An application from K-Mart Corporation, Sign Craft as agent, owner of the property
located at 500 U.S. One North, Property Control No. 60-43-40-30-00-001-0190,
requesting a variance to the terms of the Official Comprehensive Zoning Ordinance of
the Village of Tequesta,Ordinance No. 355, as amended, Section XII. Sign Regulations,
(K) Technical Requirements, (2)(a).Signs on buildings in zoned commercial districts, to
allow the installation of a 132 square foot wall sign in lieu of a maximum of sixty (60)
square feet in area per establishment,as required by the Zoning Ordinance..
At such time and place,the Village Council will hear all evidence in support of or in opposition
to this application. PLEASE TAKE NOTICE AND BE ADVISED, "If any person decides to
appeal any decision made by the Village Council with respect to any matter considered at this
public hearing, he/she will need a record of the proceedings, and that, for such purpose, he/she
may need to insure that a verbatim record of the proceedings is made, which record includes the
testimony and evidence upon which the appeal is to be based". PLEASE GOVERN
YOURSELVES ACCORDINGLY.

VARIANCE JUSTIFICATION
TO: Tequesta Building Department
RE: Kmart #3684, 500 US Hwy 1, North, Tequesta, FL
•
1. The codes are not made flexible enough to deal with
today's large shopping' center complexes with their
extreme setbacks. This Kmart storefront is approximately
550' from US Hwy 1. In addition, together with
outparcels and the heavy landscaping, this further
obstructs vision of the Kmart storefront.
2. None of the conditions that exist are as a result of the
actions of the applicant.
• 3 & 4. The codes do not address or allow for circumstances which
affect properties, such as the overall building size.
The current code of 60 eq. ft. does not allow Kmart to
properly identify the store as "Big Kmart". The
storefront of Kmart is 360' long. We are requesting a
• total sign area of 132 sq. ft. which represents less than
• 21 of the total front elevation of the store.
5. The variance requested would allow Kmart to change to
their new logo •Big Kmart" which is now standard
throughout the country. •
• 6. Granting of this variance would not be injurious to the
area or otherwise detrimental to the public welfare.
• Granting acceptance of this variance does not have to set
• precedent, but reflects the county's ability to be
flexible witin reason and maintain and preserve its'
commitment to the overall welfare of the public it
serves.

Sec.XII TEQUESTA CODE Sec.XII
A composite sign for all tenants not to exceed
sixty (60) square feet or a design for display of
individual signs not to exceed three(3)square feet
each and not more than sixty (60) square feet in
aggregate.
(e) In commercial districts C-1, C-2, and C-3,corner struc-
tures of buildings with direct exposures to two (2) or
more public streets or to a shopping center and a street
shall be allowed a sign on each side of said building
•
exposed to a street or shopping center.
(I) Signs in any commercial district which advertise the'
sale, rental or lease of real estate shall not exceed a
dimension of four (4) feet by eight (8) feet. Said signs
shall be removed no later than three (3) days subse-
quent to the sale,rental or lease of the property adver-
tised. Sale, rental or lease shall be deemed to be the •
date from which a contract for such sale, rental or
) lease is fully executed.
(K) Technical Requirements.
The following technical requirements shall apply as set forth
in this subsection:
(1) Signs in residential districts zoned R-1A, R-1,R-2, and R-3
shall follow the provisions of subsection J(2) above.
(2) Signs in zoned commercial districts C-1, C-2, and C-3.

1. One(1) sign per establishment shall be permitted
• on the building or structure not to exceed sixty
(60) square feet in area.

2. Multiple wall signs on a building frontage or ten-
ant area may be permitted upon approval by the
building official and the community appearance
board that do not exceed the maximum square
foot area allowed and have uniformity.with re-
spect to color, style and type of sign material.
(b) Free-standing signs:
1. Shopping centers within the C-1 neighborhood com-
mercial district shall be allowed one(1)free-standing
sign, not,to exceed sixty (60) square feet in area,
nor. exceed sixteen (16) feet in height from fin-
ished grade and have a minimum setback of ten
(10)feet in.accordance with subsection (I) of this
section. Landscaping and irrigation at the base of
any such signage may be required by the commu-
nity appearance*board and/or the village council
whenever the same is considered desirable by ei-
ther body.
2. Shopping centers within the C-2 community com-

) mercial district and the C-3 general commercial
district shall be allowed one(1)free-standing sign,
not to exceed sixty.(60) square feet in area, nor

exceed twenty(20)feet in height from the finished
grade and have a.minimum setback of ten (10)
feet in accordance with subsection (I) of this sec
tion. Landscaping. and irrigation at the.base of
any such signage may be required by the eommu
nity appearance board and/or the village council
whenever the same•is considered desirable by ei-
ther body. .
3. Shopping center$,not utilizing additional free-
standing signage or having approved out-parcels with
approved free-standing signage, within the C-2
community commercial district having frontage
along U.S. Highway One shall be allowed one (1)
free-standing sign, not to exceed one hundred(100)
square feet in area, nor exceed twenty(20)feet in
height from finished grade and have a. ten-foot
minimum setback in accordance with subsection
(I) of this section. Landscaping and irrigation at
