Weinand, Fire Chi . , Date: April 23, 1996 / Subject: Revised Addendum No. 1 to the N.A.M.A.C. Agreement At the March Village Council Meeting, the Village Council approved an addendum to the Northern Area Mutual Aid (Fire) Consortium (NAMAC) Interlocal Agreement. The language in that Addendum was unacceptable to two municipalities, thus creating the newly attached Addendum No. 1 to the NAMAC Agreement. This attached language is to replace the addendum No. 1 previously approved by Council. The NAMAC Fire Chiefs have been working with the NAMAC Coordinating Council on establishing this Regional Hazardous Material Team. Each member of NAMAC is contributing funds for this project, divided into equal shares. Associated startup costs for this Regional Hazardous Material Team is $96,000.00. The staffing for this regional team will be primarily from Tequesta and Palm Beach Gardens. Any municipality needing service from this specialized Team will be billed for actual expenses occurred. The attached Addendum establishes the legal basis, the ability for NAMAC to account for, a provision for funding, and means of expenditures. The majority of the equipment purchased through this funding mechanism will be stored in Tequesta, thus providing our citizens with timely access to such, when needed. Please forward this Addendum to the Northern Area Mutual Aid Consortium Agreement to the Village Council so that it can be adopted at the next Village Council Meeting. DRAFT RESOLUTION NO. 25 - 95/96 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, APPROVING AN ADDENDUM TO THE NORTHERN AREA MUTUAL AID CONSORTIUM (NAMAC) EMERGENCY SERVICES MUTUAL AID AGREEMENT, PROVIDING SPECIFICATIONS FOR THE FIRE HAZARDOUS MATERIAL PROGRAM (HAZMAT) AND AUTHORIZING THE MAYOR TO EXECUTE THE SAME ON BEHALF OF THE VILLAGE. WHEREAS, by adoption of Resolution No. 29-92/93, the Village of Tequesta entered into the Emergency Services Mutual Aid Agreement Between the Northern Area Mutual Aid Consortium and the Village of Tequesta, providing fire and emergency mutual aid service; and WHEREAS, the Village of Tequesta desires to enter into an Addendum to the Agreement, providing specifications for the Fire Hazardous Material Program (HAZMAT) . NOW,' THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1. The Provisions of Resolution No. 18-95/96 are hereby rescinded. Section 2. Addendum No. 1 to the Emergency Services Mutual Aid Agreement Between the Northern Area Mutual Aid Consortium and the Village of Tequesta, attached hereto as Exhibit "A" and incorporated by reference as a part of this Resolution, is hereby approved and the Mayor of the Village is authorized to execute the same on behalf of the Village of Tequesta. THE FOREGOING RESOLUTION WAS OFFERED by Councilmember , who moved its adoption. Mackail ATTEST: Joann Manganiello Village Clerk ADDENDUM NO. 1 TO NORTHERN AREA MUTUAL AID (FIRE) CONSORTIUM AGREEMENT THIS ADDENDUM NO. 1 is to that certain Northern Area Mutual Aid Consortium (NAMAC) Agreement (Fire) and is entered into by and among the members of the Consortium being the TOWN OF LAKE PARK, VILLAGE OF NORTH PALM BEACH, TOWN OF MANGONIA PARK, VILLAGE OF TEQUESTA, CITY OF PALM BEACH GARDENS, and TOWN OF PALM BEACH SHORES . WITNESSETH: WHEREAS, Northern Area Mutual Aid Consortium (NAMAC) (FIRE) has established a fire hazardous material program (HAZMAT) and the members of the Consortium are each contributing the total sum of SIXTEEN THOUSAND ($16, 000 . 00) DOLLARS in the manner hereinafter set forth in this Addendum; and WHEREAS, the Consortium is desirous of establishing procedures and assigning responsibility for the purchase, retention and storage of inventory and equipment and designating one member as the financial depository. NOW THEREFORE, in consideration of the sum of TEN AND NO/100 ($10 . 00) DOLLARS, and other good and valuable considerations, the parties hereto agree as follows: Section 1. The monies to be contributed by Town of Lake Park, Village of North Palm Beach, Town of Mangonia Park, Village of Tequesta and City of Palm Beach Gardens shall be paid over two (2) fiscal years in the amount of EIGHT THOUSAND ($8, 000 . 00) DOLLARS each year. The monies to be contributed by the Town of Palm Beach Shores shall be payable over four (4) fiscal years in the amount of FOUR THOUSAND ($4, 000 . 00) DOLLARS each fiscal year. Each member of the consortium shall disburse monies as provided herein thirty (30) days after a member has received an invoice. Section 2 . All monies contributed by members of the Consortium for the Hazmat program shall be maintained by the Village of Tequesta at a local banking or thrift institution and the Village shall provide accounting thereof to the members of the Consortium. Tequesta shall be responsible to purchase the inventory, equipment and supplies for the Hazmat program and pay all expenses of the program from the monies contributed by members. Tequesta shall further maintain records and provide members with an accounting of expenditures at intervals established by the Consortium. V / 3 Section 3 . All inventory, equipment and supplies for the Hazmat program shall be maintained by the City of Palm Beach Gardens and the Village of Tequesta on their respective municipal properties . Tequesta and Palm Beach Gardens shall keep and maintain records as to the tangible personal property located in their jurisdiction. The municipalities storing such equipment shall be responsible to provide ordinary maintenance at their expense . Section 4 . In consideration of the Village of Tequesta ( "Village") and the City of Palm Beach Gardens ("City") undertaking the responsibilities set forth in Section 2 and 3 of this Addendum Number 1 to the Agreement, all parties hereto hereby agree to hold the Village harmless to the extent allowed by law for the manner in which it maintains funds of the program, purchases inventory, equipment and supplies for the program, pays exp•=nses for. the program and maintains records and accounting for same so long as these activities are pursued in. a manner and within the parameters normally observed by municipal corporations of the State of Florida. Further, the parties to the Agreement agree to hold the Village and the City harmless to the extent allowed by law relating to the maintenance of inventory, equipment and supplies for the Hazmat program and for maintaining records therefor so long as these activities are pursued in a manner and within the parameters normally observed by municipal corporations of the State of Florida. However, neither the Village nor the City shall be held harmless by any of the parties to this Agreement or Addendum thereto for acts or practices which result in damages and which are due to the sole negligence of the Village or the City, its respective agents, servants, employees or officers . Section 5 . Execution of this Agreement and/or this Addendum Number 1 by the parties shall not be construed in any manner which could constitute a Waiver of Sovereign Immunity but merely indicates agreement to participate in an Interlocal Agreement for the cooperative provision of services by and among the parties.
