Subject: Ordinance Adopting 1994 Codes; Agenda Item.
Attached hereto, please find an Ordinance prepared by the
Building Official which he considers to be a housekeeping item to
bring the Village ' s building, gas, mechanical, plumbing, and
swimming 'pool codes to comply with the 1994 additions of the
same. . The Building Official can answer any questions that you
may have relative to this routine business matter.

AN ORDINANCE OF THE VILLAGE
CODE�OF ORDINANCES,
UESTA, FLORIDA,
AMENDING CHAPTER 6 OF THE
BUILDINGS AND BUILDING REGULATIONS, AT SECTIONS
6-21, 6-22, 6-61, 6-62, 6-101, 6-102, 6-121, 6-122, AND 6-151,
TO PROVIDE FOR THE ADOPTION
OF THE� STANDARD
BUILDING, GAS, MECHANICAL,EDITIONS OF THE UNIFORM
COUNTYWIDE AMENDMENTS
CODES, AND THE
TO THE STANDARD BUILDING,
GAS, MECHANICAL, AND PLUMBING CODES; PROVIDING
FOR PREVAILING STANDARDS IN THE
CONFLICT;
OF
PROVIDING FOR REPEAL OF ORDINANCES OR
ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR
SEVERABILTTY; PROVIDING FOR CODIFICATION;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Village of Tequesta, Florida has adopted uniform building codes
together with certain amendments to the codes which are intended to address specific local
conditions within Palm Beach County,Florida; and,
WHEREAS, new model codes have now been published in the several categories
relating to building and construction, and the same have been updated and revised, including
administrative changes, as recommended by the Palm Beach County Building Code Advisory
Board; and,
WHEREAS, the Village Council of the Village of Tequesta has determined that the
1994 editions of the Standard Codes and the Uniform Countywide Amendments thereto, are
consistent with the adopted Comprehensive Development Plan of the Village of Tequesta,
Florida as required by Section 163.3194(2),Florida Statutes; and,
WHEREAS, the Village Council of the Village of Tequesta, Florida deems it
necessary and advisable to amend its building and construction codes by adopting the 1994
codes and amendments as set forth herein,
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF
THE VILLAGE OF TEQUESTA,FLORIDA,AS FOLLOWS:
Section 1. Section 6-21 of the Code of Ordinances of the Village of Tequesta is
hereby amended by adopting and incorporating into the Code the Standard Building Code, 1994
Edition as fully as if set forth•at length herein as the Building Code of the Village of Tequesta.

Section 2. Section 6-22 of the Code of Ordinances of the Village of Tequesta is
hereby amended by adopting and incorporating into the Code the Uniform, Minimum
Countywide Amendment to the Standard Building Code, 1994 Edition as fully as set forth at
length herein.
Section 3. Section 6-61 of the Code of Ordinances of the Village of Tequesta is
hereby amended by adopting and incorporating into the Code the Standard Gas Code, 1994
Edition as fully as if set forth at length herein as the Gas Code of the Village of Tequesta.
Section 4. Section 6-62 of the Code of Ordinances of the Village of Tequesta is
hereby amended by adopting and incorporating into the Code the Uniform, Minimum
Countywide Amendment to the Standard Gas Code, 1994 Edition as fully as if set forth at length
herein.
Section S. Section 6-101 of the Code of Ordinances of the Village of Tequesta is
hereby amended by adopting and incorporating into the Code the Standard Mechanical Code,
1994 Edition as fully as if set forth at length herein as the Mechanical Code of the Village of
Tequesta.

Section 6. Section 6-102 of the Code of Ordinances of the Village of Tequesta is
hereby amended by adopting and incorporating into the Code the Uniform, Minimum
Countywide Amendment to the Standard Mechanical Code, 1994 Edition, as fully as if set forth
at length herein.
Section 7. Section 6-121 of the Code of Ordinances of the Village of Tequesta is
hereby amended by adopting and incorporating into the Code the Standard Plumbing Code, 1994
Edition, as fully as if set forth at length herein as the Plumbing code of the Village of Tequesta.
Section 8. Section 6-122 of the Code of Ordinances of the Village of Tequesta is
hereby amended by adopting and incorporating into the Code the Uniform, Minimum
Countywide Amendment to the Standard Plumbing code, 1994 Edition, as fully as set forth at
length herein.
Section 9. Section 6-151 of the Code of Ordinances of the Village of Tequesta is
hereby amended by adopting and incorporating into the Code the Standard Swimming Pool
Code, 1994 Edition, as fully as if set forth at length herein as the Swimming Pool Code of the
Village of Tequesta.
Section 10. Prevailing standards in the Event of Conflict. It is the intent of this
Ordinance to maintain the highest standards for Building and Construction in the Village of
Tequesta. Therefore, in the event of a conflict between the standards and requirements of the
several codes hereby adopted,the more stringent provisions shall prevail.
Section 11. Repeal of Ordinances in Conflict. All other Ordinances of the Village of
Tequesta,Florida,or parts thereof which conflict with this or any other part of this Ordinance are
hereby repealed.
Section 12. Severability. If any provision of this Ordinance or the application
thereof is held invalid, such invalidity shall not affect the other provisions or applications of this
Ordinance, which can be given effect without the invalid provisions or applications, and to this
end,the provisions of this Ordinance are hereby declared severable.
Section 13. Codification. This Ordinance shall be codified and made a part of the
official Code of Ordinances of the Village of Tequesta.
Section 14. Effective Date. This Ordinance shall take effect immediately upon its
passage and approval, as provided by law, except those Amended provisions pertaining to
impacts from wind borne debris in Chapters 16 and 17 of the Standard Building Code, which
shall become effective on October 1, 1996.
