Subject: Safe Neighborhood Improvement District Planning
Ordinance; Agenda Item
Attached hereto, please find a copy of the above. referenced for
your consideration. This Safe Neighborhood Improvement. District
Planning Ordinance has been recommended by both the Country Club
Drive Task Force and the Public Works Committee of the Village
Council. Florida Statutes require the adoption of such a planning
ordinance which enables the formation, of Safe Neighborhood
Improvement Districts and specifying that such districts may be
created by one or more of the methods established in State
Statutes .
The State Legislature, in adopting the Safe Neighborhoods Act
which allows for the creation of Safe Neighborhood Improvement
Districts, found that, among the many causes of deterioration in
residential neighborhoods, was the proliferation of crime,
automobile traffic flow strangled by out-moded street patterns,
unsuitable topography, faulty lot layouts, fragmentation of land
uses and parking areas necessitating frequent automobile
movement, lack of separation of vehicle traffic lanes and
railroad traffic and excessive noise levels from automobile
traffic. The Legislature further found that safe neighborhoods
are the product of planning and implementation of appropriate
environmental design concepts, comprehensive crime prevention
programs, land use recommendations and beautification techniques .
Additionally, the Legislature found that the powers granted in
the Safe Neighborhoods Act were necessary to guide and accomplish
the coordinated, balanced and harmonious development of safe
neighborhoods; to provide for the health, safety and general
welfare of these areas and their inhabitants, visitors, property
owners and workers; to establish, maintain and preserve property
values and to preserve and foster the development of attractive
neighborhood and business environments; to prevent overcrowding
and congestion; to improve or redirect automobile traffic and
provide pedestrian safety; to reduce crime rates and the
opportunities for the commission of crime; and to provide
improvements in neighborhoods so they are defensible against
crime.

There are four types of Safe Neighborhood Districts, as follows :
1. Local Government Neighborhood Improvement Districts . See
F.S. 163.506
2 . Property Owners Association Neighborhood Improvement
Districts. See F.S. 163.508.
3. Special Neighborhood Improvement Districts. See F. S.
163.511.
4. Community Redevelopment Neighborhood Improvement Districts .
See F.S. 163.512 .
A copy of each of the above referenced portions of Florida
Statutes are attached for your review to allow an understanding
of each type of Safe Neighborhood District. A short summary of
each follows :
1 . Local Government Neighborhood Improvement District - Allows
the Village Council to create Safe Neighborhood Districts .
The Village Council would serve as the Board of Directors of
the District and an advisory council to the Board of
Directors (Village Council) is required. Alternatively, the
Village Council could appoint a board of 3-7 Directors for
the District. The Village Council could dissolve the
District and shall consider rescinding the same if presented
with a petition containing the signatures of 60% of the
residents of such District.
2 . Property Owners Association Neighborhood Improvement
District - Here the District is formed by the creation of a
new property owners association or by "piggy-backing" an
existing property owners association. This Safe
Neighborhood District does not have the power to levy an ad
valorem tax of up to two mills annually. It is limited to a
special assessment of $500 per parcel of land within the
District per year.
3 . Special Neighborhood Improvement District - This District is
created by referendum either initiated by the governing body
of the municipality or by petition containing signatures of
40% of the electors within the proposed District. This
District has the power to levy an ad valorem tax of up to
two mills annually and to impose special assessments. This
District may be authorized the power of eminent domain with
prior local governing body permission.
4. Community Redevelopment Neighborhood Improvement District -
This alternative is applicable if a community redevelopment
agency exists and the community redevelopment agency
recommends the adoption of the same.

Safe Neighborhood Districts are required to engage in activities
deemed to be crime prevention through environmental design,
environmental security, and defensible space. See F.S. 163 .513
in this regard.
The powers of Neighborhood Improvement Districts are very broad
and are outlined in F.S. 163.514. These powers include the
ability to privatize, close, vacate, plan or re-plan streets,
roads, sidewalks and alleys, subject to the concurrence of the
local governing body and, if required, the State Department of
Transportation.
It is recommended that the Village Council adopt this Safe
Neighborhood Planning Ordinance which will enable the property
owners of Tequesta, subject to Village Council approval, to have
the power to deal with crime prevention as defined by the Safe
Neighborhoods Act, in innovative ways, to their mutual
satisfaction.

BEACH COUNTY, FLORIDA, AUTHORIZING
THE CREATION OF SAFE NEIGHBORHOOD
IMPROVEMENT DISTRICTS; PROVIDING FOR
SEVERABILITY; PROVIDING FOR REPEAL
OF ORDINANCES IN CONFLICT; PROVIDING
FOR CODIFICATION; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, Section 163.501 through 163 .523, Florida Statutes,
established the Safe Neighborhoods Act, hereinafter referred
to as the "Act"; and
WHEREAS, Section 163.504 of the Act provides that the
governing body may adopt an Ordinance authorizing the
formation of Safe Neighborhood Improvement Districts, in
accordance with the provisions of the Act; and
WHEREAS, the Village Council of the Village of Tequesta has
determined that the public interest will be best served by
adopting an Ordinance authorizing the formation of local
government improvement districts in accordance with Section
163.506, Florida Statutes .
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1. Districts Authorized. Safe Neighborhood
Improvement Districts, as provided in Sections 163 . 501 through
163 .522, Florida Statutes, may be established within the
Village of Tequesta.
Section 2. Method of Establishment. The method of
establishing such Safe Neighborhood Improvement Districts in
the Village of Tequesta may be by one or more of the methods
established in Sections 163 .506, 163 . 508, 163 .511 and 163 .512,
Florida Statutes, relating to Local Government Improvement
Districts .
Section 3. Severability. If any provision of this Ordinance
or the application thereof is held invalid, such invalidity
shall not affect the other provisions or applications of this
Ordinance, which can be given effect without the invalid
provisions or applications, and to this end, the provision,$' of
this Ordinance are hereby declared severable.
Section 4. Repeal of Ordinances in Conflict. All other
Ordinances of the Village of Tequesta, Florida, or parts
thereof which conflict with this or any other part of this
Ordinance are hereby repealed.

Section 5. Codification. This Ordinance shall be codified
and made a part of the official Code of Ordinances of the
Village of Tequesta.
Section 6. Effective Date. This Ordinance shall take effect
immediately upon its passage and approval, as provided by law.
