OBJECTIONS 1. 9J-5. 005 (1) (d) 1. a) A list of tables has not been included in the Table of Contents; b) Pages are not numbered sequentially in the Capital Improvements Element; and c) Some of the tables and figures in each element do not include a title, source or date. Recommendation Revise the plan to include the required information. Response A List of Tables has been added to the revised document; both Support Document and Plan document. The Capital Improvements Support Document and Plan Document have been re-numbered appropriately. All Tables and Figures have been revised to include titles, sources and dates. 2 B. COMMENTS None GOALS, OBJECTIVES AND POLICIES A. OBJECTIONS 1. 9J-5. 005 (6) . 9J-5. 003 (32) . 9J-5. 003 (57) 9J-5. 003 (64) (a) Goals which do not state a long-term end towards which programs or activities are directed are not acceptable. (b) Objectives which are not measurable, not supported by the data and analysis and are stated in an unspecific, tentative and/or conditional manner are unacceptable. (c) Policies which are tentative or conditional, or do not describe the activities, programs and land development regulations which will implement the plan, are unacceptable. (d) Requirements identified in Chapter 9J-5, F.A.C. , which are required to be addressed by objectives and policies must be based upon relevant and appropriate data. (e) Land development regulations to be adopted pursuant to s. 163. 3 2 02, F.S. must be adopted and implemented within one year after the due date for submission of the revised comprehensive plan. 3 Recommendation A goal must be written to state the long-term desired result (Rule 9J-5.003 (32) , F.A.C. ) . Objectives must be written in a way that provides specific measurable intermediate ends that mark progress toward a goal (Rule 9J-5. 003 (57) , F.A.C. ) . A measure such as a quantity, percentage, etc. and a definite time period for its accomplishment must be included in the objectives. Policies answer the question of "how" by specifying the clearly defined actions (programs and activities) local governments will take to achieve each objective and ultimately the identified goal (Rule 9J5. 003 (64) , F.A.C. ) . If desired, local governments may choose to assign the measurability to a policy; however, it must be clearly linked to the pertinent objective and the final combination must provide a clear basis for assessing the effectiveness of the plan. It is also incumbent upon the local government to establish that it has met the intent of the Rule when it deviates from the requirement related to measurable objectives. The Department is primarily concerned that local governments provide the basis for assessing the effectiveness of their plan. Objectives and policies may be written using the word "should" instead of "shall" provided that the local government does not view the use of "should" to mean "may" or to imply discretion. Regardless of which word is used, the local government should make efforts to achieve the stated goals and objectives. For the comprehensive plan elements, objectives and policies must be written for each of the requirements identified in Chapter 9J-5, F.A.C. , unless there is a valid explanation why the requirement does not apply. These requirements, by themselves, are not objectives or policies and cannot be used as such in the elements. All goals, objectives and policies within the plan shall be based upon relevant and appropriate data. Objectives and policies need to be supported by the data and analysis in order to have validity within the plan. Objectives and policies related to land development regulations pursuant to s. 163.3202, F.S. , must reflect that the regulations will be adopted and implemented consistent with the requirements of s.163 . 3202, F.S. 4 Response See revised Goals, Objectives and Policies in individual elements of the Comprehensive Plan. B. COMMENTS 1. See individual elements. PLANNING TIMEFRAMES A. OBJECTIONS 1. 9J-5. 005 (4) The plan does not indicate the correct minimum five-year planning time period. Page 223 of the Future Land Use Element indicates 5 year intervals (1995, 2000) beginning subsequent to the plans adoption in 1990 which is incorrect. The expected plan adoption date will occur in 1989 which will make the minimum fiveyear date 1994 . Recommendation Revise the minimum five-year planning period to indicate 1994 and utilize this date consistency throughout the plan. Response The Population Projections have been revised to indicate 1994 and 1999 planning timegrames. All elements have been revised, where necessary, to reflect these five (5) and ten (10) year planning timeframes. B. COMMENTS None LEVEL OF SERVICE STANDARDS A. OBJECTIONS 1. 9J-5. 005 (3) The following requirements relating to level of service standards required by 9J-5, F.A.C. , have not been addressed because level of service (LOS) standards to meet the following requirements are not included: (a) 9J-5. 008 (3) (c) 1. (Traffic Circulation) ; (b) 9J-5. 011(2) (c) 2 .a. (Sanitary Sewer) ; 5 (c) 9J-5. 011(2) (c) 2 .b. (Solid Waste) ; (d) 9J-5.011(2) (c) 2.c. (Drainage) ; (e) 9J-5. 011(2) (c) 2 .d. (Potable Water) ; (f) 9J-5. 012 (3) (b) 11. (Infrastructure in the Coastal Area) ; (g) 9J-5.014 (3) (c) 4. (Recreation and Open Space) ; (h) 9J-5.016 (3) (b) 3. (Capital Improvements) ; and. (i) 9J-5.016 (3) (c) 4. (Public facilities) . Recommendation Objectives and policies addressing these level of service requirements must be included. Response Level of Service Standards have been developed and incorporated into the appropriate elements and sub- elements of the Comprehensive Plan and Support Documentation. B. COMMENTS None 6 FUTURE LAND USE ELEMENT A. OBJECTIONS Data 1. 9J-5. 006 (1) (a) a) The existing land use map (Figure 1) has been reproduced at such a small scale that is difficult to identify certain features within the Village, including adjacent municipalities and unincorporated enclaves of Palm Beach County. Recommendation Include a larger map in order to identify adjacent municipalities and unincorporated enclaves of Palm Beach County on Figure 3-5. Response See revised Figure 3-5. b) The existing land use map or map series does not depict conservation as a generalized land use although Table 2- 1 indicates approximately 120 acres are in this category. Recommendation Revise the existing land use map or map series to depict conservation land uses within the Village. Response The Conservation land use category has been limited to beaches and shores on the Existing Land Use Table because of inconsistencies between the Table and Existing Land Use Map. The Open Space (Water) cate or is listed as a separate land use in the revised Exi- ing Land Use Table, as Water Bodies. The Open Space (Land) sub-category has been included under the Recreation/Open Space land use category in the revised Existing Land Use Table. Figure- 5 has been revised to reflect these changes. 2 . 9J-5. 006 (1) (b) 3 . The text on page 204 . and in other portions of the plan refers to the Loxahatchee River but does not indicate the river's status as an Outstanding Florida Water (DER) . 7 Recommendation Revise the text on page 204. to indicate that the Loxahatchee River is an Outstanding Florida Water. Response Discussion of the Loxahatchee River as an Outstanding Florida Water is discussed in the revised CONSERVATION element. The text has been revised to reference the Section 7 . 2 . 1 . 1 in the CONSERVATION element . 3 . 9J-5.006 (1) (b) 4. The text on page 202 and in other portions of the plan refers to marsh and mangrove areas within the Village. These wetland areas are not depicted on the existing land use map or map series. Recommendation Revise the existing land use map to depict wetland (marsh and mangrove) areas within the Village. Response The reference to marsh areas has been deleted as there are none within the Village. Mangrove areas are mapped on Figure 3-4. Marine wetlands have been added to replace references to marsh areas. 4. 9J-5. 006 (1) (c) The general range of density or intensity of use is not provided for the gross land area included in the residential and commercial land use categories shown on the existing land use map or in Table 2-1. Recommendation The ranges of density or intensity of use for each applicable existing land use category must be provided in tabular form. Revise Table 2-1 to include this information. Response See added Tables 3-4 and 3-5 of the Support Documentation. 8 5. 9J-5. 006 (1) (g) The methology for estimating resident and seasonal population for the five and 10 years time frames has not been included. The population projections in Table 2-3 for the years 1990 and 2000 are not based on a projection of historical trends. The data used to protect these values is not provided. In addition the methodology used to prepare Table 2-3 has not been approved by the Department nor is the methodology included for review. Recommendation Revise the discussion of the population estimates and projections and Table 2-3 to include the expected number of dwelling units for the 5 and 10 year planning time frames based on extrapolating the historic trends. Multiply these values by the expected number of individuals per dwelling unit projected for the 5 and 10 year time frames, also extrapolated from the historical trends. Include a description of the methodology, explanation of any assumption and multipliers used to estuarate and project the resident and seasonal population for the 5 and 10 year time frames. Response See revised Population Projection Section 3 . 3 . 4 of the FUTURE LAND USE element of the Support Documentation. 6. 9J-5. 006 (2) (a) An analysis of facilities and services to serve existing land uses and land for which development orders have been issued was not included. Recommendation Include the required analysis of facilities and services needed to support development for which development orders have been issued. Response See new Availability of Facilities and Services Sub- section 3 .3 . 1 of the Land Use Analysis section of the FUTURE LAND USE element of the Support Documentation. 7. 9J-5. 006 (2) (b) 1. . 2. . 3 . . 4 . . and 5. The analysis of vacant or undeveloped land is not included. The inventory provided in Table 2-1 and the text on page 202 do not include the required analysis to determine the suitability of vacant land for use. 9 Recommendation Include the required analysis of vacant or undeveloped land based upon soils, topography and natural resources within the Village. Response See new Vacant Land Analysis sub-section of the Land Use Analysis section of the FUTURE LAND USE element in the Support Documentation. 8 . 9J-5. 006 (2) (c) 1. . 2. . and 3 . An analysis of the amount of land needed to accommodate the projected population is not included for five and ten-year planning time frames. The estimate of gross acreage needed by each land use category is not included for the five and ten-year planning time frames. A description of the methodology used to calculate the amount of land needed to accommodate the projected population was not included. Recommendation Include the analysis of the amount of land needed to accommodate the projected population for the five and ten-year planning time frame. Response See new Land Use Projections sub-section of the Land Use Analysis in the Support Documentation. 9 . 9J-5. 006 (2) (d) 1. and 2 . An analysis of the need for redevelopment, including renewal of blighted areas and elimination or reduction of uses inconsistent with the community, s character and proposed future land uses, was not included. Recommendation Include the analysis of the need for redevelopment and elimination of uses inconsistent with the community's character and proposed future land uses. Response See new Redevelopment Needs sub-section of the Land Use Analysis section of the FUTURE LAND USE element in the Support Documentation. 10 10. 9J-5. 006(2) (e) An analysis of the proposed development and redevelopment of flood prone areas, based on a suitability determination from the most recent Flood Insurance Rate Maps, Flood Hazard Boundary Maps or other accurant information is not included. Recommendation Include the required analysis of development and redevelopment of flood prone areas. Response See new Vacant Land Analysis Section 3 . 3 . 5 and Development of Flood Prone Areas Sub-section 3 . 3 . 8 of the Land Use Analysis of the FUTURE LAND USE element in the Support Documentation. Goals, Objectives and Policies 11. 9J-5. 006 (3) (b) The following objectives do not include a specific, measurable intermediate end result that is achievable and marks progress toward the goal: a) Objective A, page 237, regarding development in the storm flood zone; b) Objective B, page 237, regarding appropriate land use controls; c) Objective D, page 237, regarding residents within flood areas; and d) Objective E, page 238, regarding hurricane flood waters. Recommendation Revise the objectives to be specific and measurable. Include a specific end result to be achieved by the Village. To be measurable, an objective must include a percentage or absolute number of items to be increased or decreased or identify a specific standard to be applied to assess the achievement of the objective. Response Objectives A. , B. , C. and D have been re-designated to Objectives 1.7.0, 1.8 . 0, 1.9. 0 and 1. 10. 0 to provide a consecutive numbering system in the FUTURE LAND USE 11 element. Objective E (and its Policy) has been deleted in the new FUTURE LAND USE element of the Comprehensive Plan document. See new and revised Objectives 1.7 . 0 and 1. 8. 0 which incorporate more specificity and measurability. Objective 1. 10.0 has not been revised because measurability is assigned to the Policies under this Objective (new Policies 1. 10.1 and 1. 10.2) . 12 . 9J-5. 006 (3) (b) 1. Objective 1. 1.0, page 234, regarding coordination of future land uses, is neither measurable nor specific as it does not include a specific, measurable intermediate end that is achievable and marks progress toward the goal. Recommendation Revise Objective 1. 1.0 to be specific and measurable. Include a specific accomplishment to be achieved by the Village. To be measurable, the objective must include a percentage or absolute number of items to be increased or decreased or identify a standard to be applied to assess the achievement of the objective. Response See revised Objective 1. 1.0, and Policy 1. 1. 1 has also been revised to add more specificity and measurability toward attainment of the Objective. 13 . 9J-5. 006 (3) (b) 2 . Objective 1.2 . 0. , page 234, regarding the development and renewal of blighted areas, is neither measurable nor specific as it does not include a specific, measurable intermediate end that is achievable and marks progress toward the goal. Objective 1.4 . 0. , page 235, regarding protection of natural and historic resources, is neither measurable nor specific as it does not include a specific, measurable intermediate end that is achievable and marks progress toward the goal. Recommendation Revise Objective 1.4. 0. , to be specific and measurable. Include a specific accomplishment to be achieved by the. Village. To be measurable, the objective must include a percentage or absolute number of items to be increased or decreased or identify. a standard to be applied to assess the achievement of the objective. Response Specificity and measurability are assigned to the Policies under this Objective. See revised Policy 1.4.2 and new Policies 1.4 .4 and 1.4.5. 16. 9J-5. 006 (3) (b) 5. Objective 1.5.0. , page 236, regarding coordinating coastal area population densities, is neither measurable nor specific as it does not include a specific, measurable intermediate end that is achievable and marks progress toward the goal. 13 Recommendation Revise Objective 1.5.0. , to be specific and measurable. An objective that addresses the requirement to discourage urban sprawl was not included. Recommendation Include a specific and measurable objective, along with implementing policies, to address the requirement to discourage urban sprawl: Response Due to the fact that future growth within the existing corporate limits of Tequesta will be in-fill development with urban services currently available, an Objective discouraging the proliferation of urban sprawl is not applicable. 14 19. 9J-5.006 (3) (b) 8. Objective 1.5.0. , page 236, regarding suitable land for utility facilities, is neither measurable nor specific as it does not include a specific, measurable intermediate end that is achievable and marks progress toward the goal. Recommendation Revise Objective 1.5.0. , to be specific and measurable. Include a specific accomplishment to be achieved by the Village. To be measurable, the objective must include a percentage or absolute number of items to be increased or decreased or identify a standard to be applied to assess the achievement of the objective. Response See revised Objective 1. 5.0 and new Policy 1. 5.8. 20. 9J-5. 006 (3) (b) 9 . An objective that addresses the requirement to encourage innovative land development regulations which may include provisions for planned unit developments and other mixed land use development techniques was not included. Recommendation Include a specific and measurable objective along with implementing policies to address encouraging innovative land development regulations. Response See new Objective 1. 11.0 and new Policy 1. 11. 1. 21. 9J-5. 006 (3) (c) The following policies do not address the implementation programs and activities which the Village will undertake to achieve the objective with which it is associated: a) Policy 1. 1.2 . , page 234, regarding future development review; b) Policy 1.3.1. , page 234, regarding the development of housing types; c) Policy 1.3.2. , page 234, regarding existing deed restrictions; 15 d) Policy 1.3.3. , page 234, regarding maintaining high quality single family development; e) Policy 1.3 .4. , page 235, regarding continuing development of multi-family residences; f) Policy 1.3.5. , page 235, regarding maintaining architectural control; g) Policy 1. 3 . 6. , page 235, regarding continuing low- level profile of buildings; h) Policy 1.3 .7. , page 235, regarding maintaining high quality multi-family development; and i) Policy 1.4. 1. , page 235, regarding orientations to water. Recommendation Revise the above policies to state the specific actions (programs or activities) to be undertaken by the Village to achieve the relevant objectives. Response Policy 1. 1. 2 has been deleted because the issue addressed in this Policy is adequately covered in Policies 1. 1. 1, 1. 1.3, 1.4 .4, 1.4. 5 and 1.6. 1. Due to this deletion (old) Policy 1. 1.3 is changed to (new) Policy 1. 1.2 . A new Policy 1. 1. 2 has been added addressing comment #28. See revised Policy 1.3 . 1. Policies 1. 3 .2, 1. 3 .4 and 1. 3 .7 have been deleted. THese deletions have created a re-numbering of Policies under this Objective. Reverences to old policy numbers and new policy numbers are made where necessary to aid in cross-referencing. 22 . 9J-5. 006 (3) (c) 1. Policy 1.3. 12. , page 235, does not include the implementation program or activities which the Village will use to promote (regulate) signage. Recommendation Revise Policy 1.3 . 12. , to include the specific programs or activities the Village will utilize to promote (regulate) signage. Response See revised Policy 1. 3 .9 (previously 1.3 . 12) . 16 23 . 9J-5. 006 (3) (c) 2 . a) Policy 1. 3 . 10. , page 235, regarding promoting compatible commercial development, does not include the implementation programs or activities which the Village will use to promote compatibility of development with the community's need. In addition, the policy is not supported by data and analysis. Recommendation Revise Policy 1. 3 . 10. , to include the specific programs or activities which the Village will utilize to promote compatible commercial development. Include information in the data and analysis to define or explain "compatible commercial development" or include the definition in the policy. Response See revised Policy 1.3 . 6 (previously 1. 3 . 10) . b) Policy 1. 3 . 11. , page 235, does not include the implementation programs or activities which the Village will use to "achieve" compatible development in the community. In addition "compatible" is not defined. Recommendation Revise Policy 1. 3 . 11. , to include the specific programs or activities which the Village will utilize to "achieve" compatible development. Include the definition of • "compatible. " Response See revised Policy 1.3 .8 (Previously 1. 3 . 11) . c) Policy 1.5.7. , page 236, does not include the implementation program or activities which the Village will utilize to ensure compatibility of adjacent land uses. In addition "compatibility" is not defined. Recommendation Revise Policy 1. 5.7. , to include the specific programs or activities which the City will utilize to ensure compatibility of adjacent land uses. Include the definition of "compatibility. " Response See revised Policy 1. 5.7. The term compatibility has been deleted from the revision. 17 24. 9J-5.006 (3) (c) 3 . Policy 1.5.2. , page 236, does not include the implement- ation programs or activities which the Village will use to ensure that facilities and services meet acceptable levels of service (LOS) . In addition, LOS standards have not been established for public facilities or services in the Village. Recommendation Revise Policy 1.5.2. , to include the specific programs or activities which the Village will utilize to ensure facilities and services meet established LOS standards. In addition, include LOS standards for facilities and services in the other appropriate elements of the Plan. Response See revised Policy 1.5.2. Further, level-of-service standards have been included within appropriate Comprehensive Plan elements, as required by Chapter 9J- 5, Florida Administrative Code. b) Policy 1.5. 3 . , page 236, regarding the site plan review process, pertains only to PUD regulations. Policy 1. 5. 3 . , does not include the implementation programs or activities the Village will utilize to ensure that facilities and services for developments other than PUDs, meet locally established LOS standards and are available concurrent with the impacts of such development or that development order and permits are specifically conditioned on the availability of facilities and services necessary to serve the proposed development are authorized at the same time as the land uses are authorized. Recommendation Revise Policy 1.5.3. , to specify the implementation programs or activities which the Village will utilize to ensure facilities and services which meet locally established LOS standards and are available concurrent with the impacts of development. Response See revised Policies 1.5.2, 1.5.3 and 1.5.4. c) Policy 1.5.4. , page 236, does not include the implementation programs or activities which the Village will utilize to ensure that the provision of utility service is concurrent with the approval and authorization of land use development within the Village. 18 Recommendation Revise Policy 1.5.4. , to specify the implementation programs or activities which the Village will utilize to ensure concurrent provision of utility service at the same time as authorization and approval of land use development in the Village. Response See new Policy 1.11.1. 27. 9J-5. 006 (3) (c) 6. Policy 1. 1.3 . , page 234, does not include the implementation programs or activities which the Village will use to coordinate with other agencies in providing protection of potable water wellfields. Recommendation Revise Policy 1. 1. 3 to specify the actions (programs or activities) which the Village will utilize to provide protection of potable water wellfields. Response See revised Policy 1. 1. 3 . 28. 9J-5. 006 (3) (c) 7. a) A policy concerning the establishment of standards for densities or intensities of use for each future land use category is not included. Policy 1.5. 1. , page 236, does not establish standards for densities and intensities of use for future land use development. Recommendation Revise Policy 1.5. 1 or include a new policy or policies which establishes standards for densities or intensities of use for each relevant future land use use category. Response See Revised Policy 1. 4. 2 . It is of such a small size that it is difficult to identify existing traffic circulation features identified in the text, i.e. , state roads, county roads or local roads. Recommendation Include a legible (larger) existing traffic circulation map so that existing roadway features can be clearly identified. Response A new larger existing traffic circulation map has been prepared as Figure 4-1, Village of Tequesta Existing Traffic Circulation Map . 2 . 9J-5. 007 (1) (a) 1. The depiction of collector traffic circulation facilities is not clear. The text on page 302 indicates the generalized location of these facilities but they are not depicted on the map. For example, Country Club Drive is described as a collector but its depiction on the map has either no corresponding map legend or the legend is incorrect. Similarly, Old Dixie Highway, described as a collector, is not shown at all. The map legend indicates a distinction between major, minor and principal collectors yet the text does not describe or make a distinction between collector facilities. Recommendation Include a revised existing traffic circulation map at a sufficient size so that the reader is able to distinguish various traffic circulation features. In addition, resolve the inconsistency between the map legend and the text to correctly identify major, minor and principal collector facilities in the Village. Analysis 3 . 9J-5. 007 (2) (a) a) The title of Table 3-2 indicates that the data represents 1988 Average Daily Traffic (ADT) Volumes. This is inconsistent with the footnote source which indicates the data was derived from a Palm Beach County Metropolitan Planning Organization (MPO) report dated 1987. The MPO has. published 1988 Average Annual Daily Traffic Data (AADT) , not ADT. The Florida Department of Transportation has published its 1985 Highway Capacity Manual which utilizes Generalized Highway Capacity Tables. Recommendation Revise Table 3-2 to reconcile this inconsistency by utilizing 1988 AADT data which is available from the Florida Department Of Transportation and the MPO. Response Based on comments received this element has been rewritten, see new Section 4.2 . 3, Table 4-2 . b) The analysis of the existing traffic circulation level of service (LOS) for roadways shown in Table 3-2 lacks documentation as to how LOS operating conditions were derived and whether the values represent peak hour conditions. The calculation of LOS does not include volume-to-capacity ratios based on latest available data for roadways in the Village. In addition, there is no capacity analysis for other collector roads such as County Line Road, Riverside Drive or Country Club Drive, based on existing design capacities to establish and adopt LOS standards. On page B11 of the solid waste sub-element is a statement that the Dyer landfill site has enough capacity to last until 2000. Table 1 in the County's proposed solid waste sub-element (page 5-SW) indicates that the remaining life of the landfill is one (1) year. Also, an evaluation of the adequacy of the current level of service provided by the landfill is not included. Based on this information, one is uncertain as to the remaining life and capacity of the landfill to serve the Village to the year 2000. Recommendation Revise the data and analysis to include the necessary clarification or explanation to resolve the apparent 45 inconsistency between the solid waste sub-elements of the Village and county comprehensive plans regarding the remaining life of the Dyer landfill. Include an evaluation of the adequacy of the current level of service. Response Due to the confusion created by this part of the Solid Waste sub-element, the data and analysis regarding this subject matter has been totally re-written. New sub- section 6.2. 3. 1. Solid Waste Generation addressed the matter of evaluating LOS standards and sub-section 6. 2 .2 .2 Solid Waste Disposal also adds to the data and analysis referred to in this Objection. Also, remove the 140 Regional Goal 10. 1.3 is addressed not only in the Coastal Management and Conservation elements, as revised, but also in the revised Future Land Use element by placing importance on the site plan review process in the decision making process. Protection of the regions natural resources have been commented on in detail in previous Responses. The revised Conservation and Coastal Management elements, in particular, address this regional issue in detail. The regional recreation Goal 9.3.1 regarding access to the regions beaches is addressed in the revised Coastal Management element, specifically, Objectives 1.3.0, 1.4.0, and 1.6.0 and their respective Policies. Also, the revised Conservation element addressed this regional issue in Objective 2.8.0 and Policy 2.8.1. Regional Goal 10.4.1 to provide regional parks is addressed in the revised Coastal Management element, specifically in Objective 1.6.0 and Policies 1. 6.1 and 1.6.2 as Coral Cove Park is the only regional type facility within the Village of Tequesta. The Regional Goal 16. 1.1 has been commented on in previous responses. The Regional Policy 20.1.1.2 establishing a mechanism to resolve conflicts and mediate disputes is included in the revised Intergovernmental Coordination element in Policy 1.2.5. The Regional Goal 16.1.1 to provide levels of service for high quality of life are reflected in Table CI-1 in the revised Capital Improvements element. The revised Capital Improvements element addresses the regional Goal 17.2.1 to efficiently provide for public services concurrent with need throughout the element. Specifically, Objective 1.1.0 and Policies 1.1.1 through 1.1.4 and Objective 1.4.0 and its policies address this regional issue. B. COMMENTS None 139 Regional Policies 2.2.1.8, 4. 1.2. 1 and 5. 1. 1.6 are addressed in the revised Housing element. Specifically Objective 1.2.0 and its Policies, Objective 1.4. 0 and Policies 1.4.2, 1.4.5 and 1.4.6 address these regional issues. Affordable housing is addressed throughout the revised housing element and the location of housing as depicted on the Future Land Use Map dictate its proximity to employment and necessary public services. Regional Policy 5. 1.1.3 is addressed in this manner on the proposed Future Land Use Map. Regional Policy 8.1.1.6 regarding water conservation programs are addressed in the revised Plan in Objective 1. 3.0 and its Policies in the Potable Water Sub-element and in Objective 2.11.0 and Policy 2. 11. 1 o the Conservation element. Regional Goal 16. 1.1 to provide levels of service necessary to achieve high quality of life is address in various elements of the revised Comprehensive Development Plan where Level of Service Standards are established as required. Central systems are promoted in the Potable Water and Sanitary Sub-elements which prohibits the proliferation of small individual systems consistent with regional Policy 16.1. 1.3 . The Solid Waste Sub-element as revised also supports the Countywide System for disposal of Solid Waste and hazardous wastes. Collection is by a single hauler, so Policy 16. 1.1.3 is address in this manner. The Regional Goal 8.3.1 and Policy 9.2.1 issues have been addressed in the revised Comprehensive Development Plan, in particular the Conservation and Coastal Management elements. Previous responses above provide the citations in the Plan where these are addressed. Regional Policy 9.2.1.4 regarding establishing a marina/multislip plan is addressed in Policy 1.3.3 and Policy 5.2.2 of the revised Coastal Management element. Regional Goal 10.2.1 is addressed in the revised Conservation and Coastal Management elements and as cited in previous responses. Although specific percentages as addressed in Regional Policy 10.1.2.2 are not addressed in the revised Comprehensive Development Plan, the Conservation and Coastal Management elements address the need for native vegetation xeriscape and removal of exotics. The Objectives and Policies in the revised elements have been previously cited in responses. Percentage, as such, will be addressed as land development and landscape regulation revisions are made as a result of this Comprehensive Development Plan. 138 e) Recreation Element is inconsistent with: 1) Goal 9. 3.1. , to make available to all citizens reasonable access to the regions beaches; 2) Goal 10.4.1. , to provide the quantity and quality of regional resource-based parks and outdoor recreational opportunities; and 3) Goal 16. 1.1. , to provide the levels of service necessary to achieve a high quality of life. f) Intergovernmental Element is inconsistent with: 1) Policy 20.1.1.2. , establishing a mechanism to resolve conflicts and mediate disputes. g) Capital Improvements Element is inconsistent with: 1) Goal 16.1. 1. , to provide the levels of service necessary to achieve a high quality of life; and 2) Goal 17.2. 1. , to efficiently provide for public services concurrent with need.. Recommendation Revise the comprehensive plan to include goals, objectives and policies consistent with the Comprehensive Policy Plan of the Treasure Coast Regional Planning Council. Response The revised Village of Tequesta Comprehensive Development Plan contains Level of Service Standards in various elements of the Plan which address the regional land use Goal 16. 1. 1. OBJECTIONS 1. 9J-5. 021 (1) The Village of Tequesta's proposed comprehensive plan is inconsistent with the Comprehensive Regional Policy Plan (CRPP) of the Treasure Coast Regional Planning Council as follows: a) Future Land Use Element is inconsistent with: 1) Goal 16.1.1. , to provide levels of service necessary to achieve a high quality of life; 2) Policy 16.1.1.2. , that all development shall take place concurrent with, or after the provision of, necessary infrastructure and services; 3) Goal 16.2. 1. , to preserve and protect the regions natural resources; 4) Policy 16.2.1.2. , prior to making any land use decision that may have an adverse ecological and environmental impact, a written assessment of such impacts must be prepared; and 5) Goal 10.3.1. , to assure that private and public land management use and acquisition is compatible with the maintenance of wildlife and natural systems. b) Housing Element is inconsistent with: 1) Policy 2.2.1.8. , an increased number of foster homes and temporary shelters should be secured; 2) Policy 4.1.2.1. , addressing the special housing needs of the elderly; 135 3. Coastal/Conservation Element is inconsistent with: a) Policy (9) (b) 4. , protect coastal and marine resources from the adverse effects of development. b) Policy (9) (b) 7. , protect marine fisheries, habitat and other aquatic resources. c) Policy (10) (b) 7. , protect the ecological function of wetlands. Recommendation. Revise the Comprehensive Plan to include goals, objectives and policies to further consistency with the State Comprehensive Plan. Objectives 1.4.0, 1.5.0, 1.6.0, 2.1.0, 2.2 .0, 2.3.0, 2.4.0 and their respective Policies in the Conservation element; and Objective 1.1.0, 1.2.0, 1.3 .0, 1.4. 0, 1.6. 0, 2.2.0, 3.1.0, 3.4.0, 3.5.0, 3.6.0, 3.7.0 of the Coastal 134 Policies 1. 1. 1 through 1. 1.5 address the water recharge protection concern. Additionally, revisions in the Drainage Sub-element also address this issue. Both the revised Conservation and Coastal Management elements address the protection of natural systems. Specifically, Objective 1.6.0 and Policies 1.6.1 and 1.6.2,Objective 2 .2.0 and Policy 2.3 .0 of the Conservation element and Objective 1. 1. 0 and Policy 1. 1.2; Objective 2.2.0 and Policies 2.2.3 and 2.2 .5 of the Coastal Management element address State Policy (10) (b) 1 while Objective 1.6.0 and Policy 1.6.3 of the Conservation element and Objective 2 .2. 0 and Policies 2.2.3 and 2.2.5 also address protecting endangered species and their habitats. Objective 2. 12.0 and Policy 2.12.1 in the Conservation element addresses the solid and hazardous waste issue addressed in State Goal (13) (a) , as well as Objective 2. 1.0 and Policy 2.1.2 of the Coastal Management element also address this issue. b) The Village of Tequesta,s proposed Comprehensive Plan does not further consistency with the State Comprehensive Plan as follows: 1. Future Land Use Element is inconsistent with: a) Policy (16) (b) 6. , consider, in land use planning and regulation, the impact of land use on water quality and quantity. b) Policy (18) (b) 9. , identify and use stable revenue sources responsive to growth for financing public facilities. 2. Infrastructure Sub-elements are inconsistent with: a) Policy (8) (b) 5. , ensure that new development is compatible with existing local and regional water supplies; b) Policy (8) (b) 1O. , protect surface and groundwater quality; and c) Policy (8) (b) 12. , elimination of inadequately treated stormwater runoff into the waters of the State. 133 STATE COMPREHENSIVE PLAN CONSISTENCY A. OBJECTIONS 1. 9J-5. 021 a) The Village of Tequesta's proposed comprehensive plan is not consistent with the State Comprehensive Plan because it fails to address the following subsections of s. 187.201, Florida Statutes, State Comprehensive Plan goals and policies: 1) Goal (5) (a) , affordable housing; Policy (5) (b) 3. , increasing the supply of affordable housing for low and moderate income persons; Policy (5) (b) 1. , eliminate public policies which result in housing discrimination; 2) Goal (8) (a) , protecting water resources; Policy (8) (b) 2. , protecting water recharge areas; Policy (8) (b) 10. , protect surface and groundwater quality; 3) Goal (10) (a) , protecting natural systems; Policy (10) (b)l. , conserving forests, wetlands, fish and wildlife; Policy (10) (b) 3. , protecting endangered species and their habitats; and 4) 5) Goal (13) (a) , management of solid and hazardous waste. Recommendation Include objectives and policies to establish consistency with the above-referenced State Comprehensive Plan goals and policies. Response Revised Objectives 1.2.0 and 1.4.0 in the Housing element and their respective Policies address the State Goal regarding affordable housing and State Policies (5) (b) 3. and (5) (b) 1. The revised Natural Groundwater Aquifer Recharge Sub-element specifically Objective 1.1.0 and 132 Recommendation Include a monitoring and evaluation plan and a provision for reviewing the Capitol Improvements Element on an annual basis. These programs shall include provisions that facilities and services at least meet the LOS standards established and are available concurrent with the impacts of development so that no development order or development permit may be issued which results in a reduction in the levels of service below the level of service standards established in the plan. Recommendation Include the programs to be adopted, such as specific land development regulations, monitoring and evaluation programs and new programs to be established. Recommendation Policies addressing these requirements must be included which state the programs or activities to be taken by the Village to achieve the relevant objectives. In addition, the cost of beach renourishment is not listed. Recommendation Revise the five-year schedule of improvements to include the above projects. Also, include any other deficiencies based on revisions to the data and analysis in the other elements of the plan. 129 b) Policy 1. 1.2, page 1203, regarding the programming process; c) Policy 1. 1.3, page 1203, regarding a prudent borrowing policy; d) Policy 1.1.4, page 1203, regarding coordinating capital improvement update; e) Policy 1.2. 1, page 1203, regarding the water supply system; • f) Policy 1.3.1, page 1204, regarding the building permit review process; and g) Policy 1.3.2, page 1204, regarding inadequate infrastructure. Recommendation Revise the policies to specify the implementation programs or activities to be taken by the Village to achieve the relevant objective. Response See added Section 11.3 of the Support Documentation Report. 9. 9J-5. 016 (2) (f) The analysis of the Village's forecast of revenue and expenditures as shown in the Table of Five Year Projections (pages 32 and 40) reveals that the Village's plan for Capital Improvements is not financially feasible. A deficit of $2,667,030 is shown for the identified improvements but specific financing for these improvements, other than general revenue, has not been analyzed. Recommendation Include a revised analysis of projected revenue and expenditures for the five-year period identified. Project all revenue sources utilized by the Village and allocate finding on a project-by-project basis. Response See Table 11-10, Table 11-13 and sub-section 11.3.4. 10. 9J-5. 016(2) (f) 2. 3. 4. 5 and 6 • The five-year assessment of the Village's ability to finance capital improvements does not include a projection of other revenue sources such as impact fees, ad valorem taxes, millage rates and user fees, a projection of operating cost considerations and a projection of debt capacity. Recommendation Include the required analysis of other projected revenue sources, projection of operating cost considerations and projection of debt capacity. Response See added Section 11.3.3.2 of the Support Documentation Report. 125 Monitoring and Evaluation subsection of the Comprehensive Development Plan Document. 6. 9J-5. 016 (2) (c) The analysis of the costs of needed capital improvements for mitigation of existing deficiencies, replacement and new growth needs pursuant to the Future Land Use Element does not list any expenditures for correcting existing drainage facility deficiencies related to stormwater management, alleviation of flooding problems or mitigating traffic impacts associated with continued commercial development along U.S. 1. The basis for cost estimates has not been included. Recommendation Revise the analysis to include all existing deficiencies and explain the basis for the estimates of cost to correct these deficiencies. Response See Response to Objection #1. 7. 9J-5. 016(2) (d) The analysis of the impact of new or improved public education and public health care systems and facilities on the provision of infrastructure was not included. . Recommendation Include the required analysis of public education and public health systems. Response See response to Objection #2. 8. 9J-5.016(2) (e) The analysis on page 1202 does not include the use of timing and location of capital improvements to public facilities to support efficient land development and the goals, objectives and policies in the Future Land Use Element. In addition, consideration of the plans of other State agencies and the Water Management District were not included. 124 Recommendation Revise the inventory to include current revenue sources, including dollar values, for all revenue sources utilized by the Village. Response See added Section 11.2.1.1 of the Support Documentation Report. Analysis 4 . 9J-5.016 (2) (a) The analysis of current local practices that guide the timing and location of construction, extension or increase in capacity of each public facility is not included. Recommendation Include the analysis of current local practices that guide the timing and location of public facilities. Response See added Section 11.3.1.of the Support Documentation Report. 5. 9J-5. 016 (2) (b) The analysis of the general fiscal implications of the existing deficiencies and future needs for each type of facility is incomplete. The analysis is based on an incomplete analysis of deficiencies identified in the. other elements of the plan and does not give a complete listing of deficiencies, i.e. , drainage (flooding problems) , beach renourishment, stormwater runoff, and pollution abatement. Recommendation Revise the analysis based on capital improvement needs or deficiencies found in the other elements of the plan. Include the fiscal implications of correcting deficiencies and future capital needs. (e.g. , new staff, operation and maintenance costs) . Response See added Section 11.3.3.2 of the Support Documentation Report, the Capital Improvements Implementation section and 5-Year Schedule of Improvements and Implementation, 123 CAPITAL IMPROVEMENTS ELEMENT A. OBJECTIONS Data 1. 9J-5. 016(1) (a) Public facility needs for the entire planning timeframe, including existing deficiencies and projected needs have not been adequately identified in the traffic, infrastructure and recreation and open space elements of the plan because of incomplete data and analysis in those elements. Recommendation Include any additional public facility needs identified as a result of revised data and analysis in the various comprehensive plan elements (i.e. , beach renourishment, pollution and flood control, drainage structures and intersection improvements) . Response Referenced elements have been updated and additional improvements have been included within the 5-Year Schedule of Improvements, as necessary. 2 . 9J-5. 016 (1) (b) The geographic service area and location of major system components for the public education and health systems within the Village were not included. Recommendation Revise the data to include the geographic service area and location of major system components for the public education and health systems within the Village. Response There are no public educational/health systems within the Village (Ref: Section 11.2.2. of the Support Documentation Report) 3. 9J-5.016(1) (c) The inventory of existing revenue sources and funding mechanisms for capital improvements financing is incomplete. Response A Policy was added to address this area of concern. 28 . 9J-5. 012 (3) (c) 14. A policy was not included to address the requirement to demonstrate how the Village will coordinate with existing resource protection plans, aquatic preserve plans and estuarine sanctuary plans. Recommendation Include a policy which states the specific action the Village will undertake to coordinate with existing resource protection plans, aquatic preserve plans and estuarine sanctuary plans. Response Figure 3-4 , Coastal Management/Conservation Map have been included which identifies public access points to the River, estuary and ocean. In addition, an inventory of Coral Cove Park, including facilities, beach and intracoastal frontage and parking has been included in the revised Support Documentation. Figure 3-4 also, -includes all water-related and water-dependent land uses in the Village. 6. 9J-5.012 (2) (h) The analysis of infrastructure in the coastal area does not include information on bridges. Recommendation Include bridges in the inventory of infrastructure in the coastal area. 107 required inventory of natural resources on the Future Land Use Map or map series. Include data and analysis which support the amount of development proposed in natural resource areas. Revise the Future Land Use Map, as appropriate, to show development consistent with the data and analysis. Responses The Support Documentation has been amended to include an inventory of wetlands, marine resources and other natural resources. Figure 3-4 identifies mangroves, sea grasses, beaches and dunes, wildlife habitats, vegetative cover and areas of special concern (i.e. aquatic preserves and Florida Outstanding Waters) . Future development in the coastal area is described and Figure 3-4 Coastal Management/Conservation Map identified areas to be conserved. 3 . 9J-5. 012 (2) (e) The text on page 1058 is not specific as to the number of persons requiring evacuation or the number of persons requiring public shelter. Table 10-10 does not indicate shelter capacity. In addition hurricane evacuation times are not included. Recommendation Include the required analysis of persons requiring evacuation from the Village, the number of persons requiring public shelter and the capacity of shelters utilized by the Village. Include hurricane evacuation times. Response The Support documentation has been amended to specifically state the number of persons requiring evacuation and shelter. Shelter capacities are identified and hurricane evacuation times are included. 4. 9J-5. 012 (2) (f) Although the analysis on page 1062 indicates beach erosion problems, the analysis of beach erosion and accretion trends and potential beach renourishment areas, specific to the Village of Tequesta, is not included. 106 COASTAL MANAGEMENT ELEMENT A. OBJECTIONS Data and Analysis 1. 9J-5. 012 (2) (a) An analysis of the economic base of the coastal area or identification of areas in need of redevelopment were not included. In addition, a map showing existing water- dependent and water-related uses is not included. Recommendation Include the analysis of existing land uses in the coastal area and include existing water-dependent and water related uses on the existing land use map or map series. Response Single-family and multi-family residential development comprises the economic base in the coastal area with one exception, the JIB Club Marina. No redevelopment areas were identified and none are proposed in the Future Land Use element in the coastal area. Figure 3-4 identifies water-dependent and water-related land uses and is discussed in the revised Coastal Management Support Documentation. 2 . 9J-5. 012 (2) (b) The inventory and analysis of the effect of future land uses on natural resources in the coastal areas is incomplete. Conservation areas, wetland marshes and mangrove areas are not identified on the Future Land Use Map. These coastal areas are designated for medium- density residential development on the Future Land Use Map, which conflicts with the intent to limit development in coastal areas. In addition, the map series did not include vegetative cover, wildlife habitat or other areas of special concern to the Village. Recommendation Include the required inventory and analysis of the effect of future land uses on natural resources in the coastal areas. Developmental impacts on the coastal area must be addressed with regard to environmental protection - standards, development constraints and mitigation of adverse impacts on natural resources. Include the 105 B. COMMENTS The Village depends on other governmental entities for the provision of most of its public facilities but provides potable water to areas outside its jurisdiction. It is also affected by traffic from the communities on either side of the Village. Therefore, the Village must adopt very specific policies to fulfill the need for intergovernmental coordination in order to ensure that the Village can adequately provide its citizens with the necessary facilities and services. 104 adjacent jurisdictions in such matters as traffic regulations, aesthetics, etc. ". Recommendation Revise the policy to state the actions (programs or activities) that the Village will undertake to promote compatibility between the Village and adjacent jurisdictions. Response See revised Policy 1.1.3. b) Policy 1.2.3 (page 811) , concerning the State Comprehensive Plan, does not include the actions (programs or activities) that the Village will undertake to determine whether the State Comprehensive Plan implies a need for intergovernmental coordination at the local level. Recommendation Revise the policy to state that the Village will review the State Comprehensive Plan to determine if it implies a need for intergovernmental coordination at the local level. Response See revised Policy 1.2. 3. c) Policy 1.5. 1 (page 812) does not clearly state that the assessment of the effects of rezoning, annexation and development activities will be to determine their effect on the ability to provide services under the interlocal agreements. Recommendation Revise the policy to clarify that the assessment will be to determine any effect on the ability to provide the services which are the subject of the interlocal agreements. Response Existing land uses in the coastal area are discussed in the revised Coastal Management element, particularly in relation to existing natural resources, known pollution problems, particularly non-paint sources associated with urban stormwater runoff, are also discussed. Hazardous wastes are discussed in the amended Conservation element under Section 7.3.2. The statement on page 603 indicating that "this is not a significant issue" is not valid as beach and dune erosion problems in addition to areas of erosion identified by the soil and water conservation district have not been discussed. Also, beach renourishment projects are cross- referenced to the Coastal Element but are not discussed in that element. Recommendation Revise the analysis to include soil erosion problems in the Village including areas designated for beach renourishment. Response The Coastal Management element has been amended to include a discussion of beach width, erosion trends and renourishment needs. The revised Support Documentation also identifies the renourishment and barrow areas. - 4 . 9J-5.013 (1) (b) The existing commercial, recreational or conservation uses are not indicated for natural resources located in the Village. Known pollution problems referred to on page 604, as well as hazardous waste disposal affecting the quality of the Loxahatchee and Intercoastal Waterway, are not included. The North Fork and Northwest Fork of the Loxahatchee River have been identified as being severely impaired due to urban drainage problems, septic tanks and hydrological modifications. The potential for conservation of this resource has not been addressed. Analysis of hazardous wastes generated by commercial and industrial land uses, disposal of hazardous materials in water bodies, pollution generated by marinas, fish camps, stormwater run-off, septic tanks and other water- dependent uses have not been included. 70 CONSERVATION ELEMENT A. OBJECTIONS Data and Analysis 1. 9J-5.013 (1) (a) 1. a) Mangroves, wetland areas including estuarine marshes, are not included or shown as conservation areas on the Future Land Use Map or map series. Recommendation Revise the analysis to include the delineation of wetland areas. Response Mangroves, wetlands, seagrasses, vegetative cover and wildlife habitats, as well as natural resources and public access areas are depicted on Figure 3-4, Coastal Management/Conservation Map and discussed in the revised Support Documentation in the Coastal Management element. b) The data and analysis of the water quality of the Loxahatchee River and other water bodies does not include information on the quality of the water resources available from the Department of Environmental Regulation. Recommendation Revise the analysis to include additional information on the quality of the water bodies within the Village's jurisdiction available from the Florida Department of : Environmental Regulation. Response FDER does not have an ongoing water qulaity monitoring program in the Loxahatchee River, Indian River Lagoon Aquatic Preserve or the estuary. The Palm Beach County Health Department and the Department of Environmental Resource Management have a joint water qulaity program in this area and a summary of the data is included in the Coastal Management Support documentation (Estuarine Pollution) and sampling stations are located on Figure 3-4. 2. 9J-5.013 (1) (a) 2. The Floodprone Areas Map (Figure 3) does not include the correct date of the Flood Insurance Rate Map (FIRM) . 69 Goals, Objectives and Policies 3 . 9J-5.011 (2) (b) 5. Objective 1.1.0 (page 511) , concerning the maintenance of aquifer recharge area functions, does not include the specific, measurable, intermediate end result that the the Village will achieve toward protecting the functions of natural groundwater recharge areas. The objective includes only "prime" recharge areas rather than all aquifer recharge areas within the Village's jurisdiction. Also, the objective is not supported by the data and analysis. Recommendation Revise the objective to include the specific measurable, intermediate end result that the Village will achieve toward protecting the functions of natural groundwater recharge areas, including those that are not classified as "prime" recharge areas. To be measurable, an objective must contain a quantity to be increased or decreased within a specific time frame or a specific standard to be applied that is achievable and marks progress toward the goal. Also, identify the natural groundwater recharge areas within the Village's jurisdiction and include the information in the data and analysis. Response Since the SFWMD has- not adopted or designated any prime natural groundwater aquiver recharge areas, objective 1. 1.0 has been rewritten to be more specific in identifying how the Village will work toward achieving its goal. Also, an additional policy (i.e. 1.1.5) has been added to further enhance groundwater recharge quality by the establishment of a wellfield protection program. B. COMMENTS None 68 NATURAL GROUNDWATER AOUIFER RECHARGE SUB-ELEMENT A. OBJECTIONS Data and Analysis 1. 9J-5.011(1) (g) Natural groundwater aquifer recharge areas within the Village of Tequesta have not been identified. Recommendation Include information identifying aquifer recharge areas within the Village. If there are none, then this information must be stated in the plan. Response As presented in the revised 6.5, Natural Groundwater Aquifer Recharge Sub-element, Section 6.5. 1, the South Florida Water Management District has not adopted or designated any areas as prime recharge areas within Palm Beach County. However, the SFWMD regards all undeveloped and open space areas in Palm Beach County as high recharge areas due to the shallow aquifer/surficial aquifer supporting the County. This is the main source of groundwater recharge in the Village with a further discussion found in Section 6.5.3, Natural Groundwater Aquifer Recharge Analysis, of the Village's revised Support Documentation. 2 . 9J-5. 011(1) (h) An assessment of strengths and deficiencies in programs : and regulations which govern land use and development of groundwater recharge areas in maintaining the natural functions of groundwater recharge areas was not included. Recommendation Include an assessment of the strengths and deficiencies in existing programs and regulations in maintaining the natural functions of groundwater recharge areas. A facility capacity analysis indicating capacity surpluses and deficiencies for existing conditions is incomplete and the analysis is not included for the initial increment ' of the planning period or for the remaining increment of the planning period. The existing conditions is incomplete because only the Village,s water demands from the Tequesta wells and the Jupiter system are included rather than the demands for the entire service areas. As a result, the excess capacity of 520, 000 gallons per day available from the Tequesta wells is not accurate. The amount of this water that is provided to areas outside the Village is not included. Also, it is not demonstrated that final upgrading of the treatment plant to a capacity of 3.0 million gallons per day will be adequate to meet the Village,s future needs. Recommendation Include a facility capacity analysis for existing conditions, the initial increment of the planning period and for the remaining increment of the planning period. The analysis must include the entire service area for the Tequesta and Jupiter systems in order to assess the Village,s water needs and determine if enough water will be available to supply those needs throughout the planning time frames. 60 Response The geographic service areas for the Village's Potable Water facilities is provided as Figure 6.4-1 in Section 6.4 .2 , Potable Water Data Summary, of the Village's Revised Support Documentation. 6. 9J-5.011 (1) (e) 3 .
