Subject: Village Manager Objectives-FY 1997; Annexation Referendum
Status Report: Pursue Annexation During Calendar Year 1998 or Sooner, If Possible, Within
at Least One Annexation Area
As you know, there are four types of annexation. Florida Statutes Chapter 171 provides the
legislative standards for the first three:
1) Voluntary - Annexation at the request of the property owner.
2) Involuntary - Annexation when a municipality seeks to annex an area by passing an
ordinance which schedules a referendum.. The municipality must complete
an Urban Services Report(which must be filed with the Palm Beach
County Board of County Commissioners prior to commencing annexation
procedures)and, prior to the ordinance becoming effective,hold a
referendum on the annexation.
3) Interlocal - Annexation of enclaves less than 10 acres in size through Interlocal
Agreement.
4) Legislative - In addition to the types of annexation under the Statute, annexation can
also be initiated by Legislative Act.
Per the direction of the Village Council, the Village will pursue "involuntary" annexation of at
least one of the 10 annexation areas as defined on The Village of Tequesta Future Annexation
Area Map(March 1997) during calendar year 1998. Note: Some of the original 5 annexation
areas which went to Referendum on March 14, 1995,have been redefined.
At this time, three annexation areas - Area 2, Bermuda Terrace; Area 6, County Line Road East
of FEC Railroad; and Area 10,Waterway Village-appear to be the most likely areas to pursue.
Area;2, Bermuda Terrace- An area of special interest due to the ENCON sewer controversy.
Residents of Bermuda Terrace seem to have established an affinity with the Village of Tequesta as
a result of Tequesta's staunch position and legal actions against ENCON in defending the rights of
Tequesta residents, as well as, Bermuda Terrace residents. It may be an opportune time for
Bermuda Terrace residents to join the Village of Tequesta.

Area 6 county Line Road East of FEC Railroad- (Originally, Annexation Area "E" which
also included County Line Road West of the FEC Railroad.) This area had the highest vote "for"
annexation (38%) in the 1995 Referendum. It includes the Tequesta Hills subdivision whose
residents, we believe, are desirous of greater police presence and protectio and quicker response
time provided by both the Tequesta Police and Fire-Rescue Departments. This area may still be
strongly supportive of annexation.
Area 10, Waterway Village- There is an estimated 2.4 lane miles of streets owned and
maintained by the Waterway Village Property Owners' Association which are in need of repair.
Existing drainage infrastructure needs repair as well. The Village of Tequesta can pursue the
Palm Beach County Annexation Incentive Program which provides for infrastructure
improvement costs to be divided three ways: 33%County; 33%Tequesta; and 33%homeowners.
As an extra added incentive, Tequesta could offer to pay the homeowners' share. This could be
very enticing for the residents who voted 33% "for" annexation in the 1995 Referendum.
I will be working with Scott Ladd, Director of Community Development, and Michelle Falasz,
Planner,to coordinate this annexation effort. Staff will meet to review and analyze the annexation
data and, ultimately, make recommendation to the Village Council as to the most likely area(s)to
take to an Annexation Referendum.
The date of the Annexation. Referendum has not yet been discussed by Staff.. However, for
planning purposes,I have taken the liberty of choosing Tuesday, May 26, 1998, as the date of the
proposed Annexation Referendum and I have prepared an Annexation Referendum Pert Chart
which will serve as a guideline and break down of all aspects of the annexation assignment which
must be completed. Realistically, as reflected in the Pert Chart, it may be nearly impossible to
meet all the requirements and schedule the Annexation Referendum any sooner.
Attached, please find the Annexation Referendum Pert Chart, as requested, for your
information and reference.
