I recommend the Village accept the proposal from Wynn for the ROW Improvement and the seal coating work combined, for a total cost of $43,723.00. NOTE - Signs by others 93-004.4/105 rev. 6/4193 t AGREEMENT THIS AGREEMENT is made and entered into this _ - day of , 1993, by and between the VILLAGE OF TEQUESTA, a Florida► municipal corporation, 357 Tequesta Drive, Tequesta, Florida 33469, hereinafter called the "Village", and DOROTHY M. CAMPBELL, MURIEL G. MANNING and LIGHTHOUSE GALLERY, INC. , hereinafter called "Owners". W I T N E S S E T H : WHEREAS, the Village of Tequesta intends on entering into a contract for right-of-way improvements adjacent to the property of the Owners; and WHEREAS, it is the desire of the Owners that the Village, in conducting said right-of-way improvements, simultaneously conduct improvements to the parking lot owned by the Village adjacent to Owners• property and to make certain other landscape and irrigation improvements in conjunction with the right-of-way improvements which will be of benefit to Owners; WHEREAS, the Village is entering into a single contract to cover the cost orf all of the improvements; and WHEREAS, it is the intention of the Owners to reimburse the Village for the cost of the improvements which they have requested adjacent to their property. E00 N31903 `S3NOI £T:9T £6470/99 NOW, THEREFORE, in consideration of the mutual promises set forth herein, it is agreed as followst 1. The Village shall complete all of the right--of-way improvements and the improvements described in paragraph 2 below for a total cost to the Village of $43,723.00. 2. The improvements made at the request of the Owners are as follows: A. Five foot landscape area along property line; D. Landscape new islands; C. Construct curbs; D. Construct additional parking; E. Install lighting; F. Asphalt sealcoat parking lot and striping of parking lot; all in accordance with the conditions of the specifications of the contract attached hereto and incorporated as a part of this agreement. The cost of said improvements on behalf of the Owners is $14,770.00. 3. The owners hereby agree to pay to the Village the stun of $14,770.00, said sum to be paid prior to the issuance by the Village of a notice to proceed with the construction of the improvements described herein. 4. owners further agree to pay\ for and be responsible to the Village for any change orders relating to the items referenced in paragraph 2 above, said amounts to be reimbursed to the Village upon completion of the improvements. 2 E00 en150u 'S9HOf bI:9T 26/b0/90 5. Village shall complete all improvements pursuant to the terms of the contract attached hereto. Acceptance and approval of all work shall be subject, to the sole discretion of the Village. 6. This agreement represents the entire agreement between the parties as to its subject matter and may not be amended except by written agreement executed by both parties.
