SUBJECT: Water Main Painting/Replacement (Bridge Crossings)
On April 5, 1993, Sealed Bids were received and opened
relative to the above project. As you know, this Bid contained an
alternate bid item for joint participation by ENCON for a force
main replacement on Tequesta Drive Bridge. Fortunately, low bid
was favorable to Tequesta, but the alternate bid exceeded budget
limitations of ENCON and they, therefore, rejected their portion of
the Bid.
After some lengthy delays, qualifications of low bidder have
been reviewed by the Engineering firm of Reese, Macon & Associates
and bid award is recommended to TLC Diversified of West Palm Beach
in the amount of $147, 806. A bid tabulation is attached.
This project consists of two tasks, one, beings removal and
replacement of our ten inch ( 10" ) Water Main on the hbrth side of
Tequesta Drive Bridge and two, chemical stripping and painting of
our twenty inch (20" ) Water Main on the Alternate AIA Bridge. Both
of these projects are vital to ensuring continued uninterruptible
water service to the customers of our Water System and I recommend
presentation to Council for their approval on June 24, 1993.

You will recall, the base bid covers the Tequesta work and the additive item was
for Encon's force main. Encon has elected not to award this work.
We have investigated the qualifications of the low bidder to perform this work
and believe they have satisfied the intent of the documents in this regard. It must be
noted that there are pending new rules which will.impact this type of work. The
• consensus is that the rules, when promulgated, will increase costs. The rules are not
currently available and at this time a schedule for implementation is unknown. There is
a risk that, when issued, the rules could impact this project, even though it is currently
under construction. The effect could be to force the contractor to adopt different
measures concerning lead, and increase costs. We feel the probability of the rules being
adopted during this construction period is low and the chance that they would be applied
to work already under contract is even lower. This opinion is based on typical
environmental rule making processes. However, we obviously cannot guarantee this will
not occur. The Village can elect to award at this time or reject all bids and re-bid after

rule finalization. If you elect to award we recommend TLC Diversified, Inc. for the low
bid amount of $147,806.00.
