SUBJECT: Resolution No. 16-92/93; Agreement for Easement
Between the Gulf Stream Council Boy Scouts of .
America; Agenda Item

On November 21, 1991, the Village Council adopted Resolution 1-
91/92 authorizing the acquisition of certain easements rights for
location of underground utilities on specific lands located in
Martin County. We have been able to negotiate a 22 foot easement
for the water transmission lines associated with the Well 25, 26
and 27 Project from the Gulf Stream Council Boy Scouts of America
in return for a contribution to the Grantor in the amount of
$1, 900 . 00 . Although our appraiser appraised a 12 foot easement to
be worth $100 . 00, we have received a 22 foot easement which is well
worth the contribution of $1, 900. 00 and is far less than the cost
that would be incurred if this were to be taken to trial .
Additionally, the square footage of the property needed for the
easement has a taxable value of $1, 900 .
It is recommended that the Village Council approve the Agreement
for Easement as referenced herein the amount of $1, 900 . 00 and
authorize Mayor Mackail to execute the same on behalf of the
Village.

RESOLUTION NO. 16 - 92/93
A RESOLUTION OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA,
APPROVING AN AGREEMENT FOR EASEMENT BETWEEN THE
GULFSTREAM COUNCIL BOY SCOUTS OF AMERICA AND THE
VILLAGE OF TEQUESTA FOR AN EASEMENT NECESSARY FOR
THE LOCATION OF THE WATER MAIN IN CONJUNCTION WITH
THE WELL 25, 26 AND 27 PROJECT.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1. The Agreement for Easement between the Gulf stream
Council Boy Scouts of America and the Village of Tequesta for
an Easement necessary for the location of a water main in
conjunction with the Well 25, 26 and 27 Project for a
contribution of $1,900 attached hereto as Exhibit "A" and
incorporated by reference as a part of this Resolution is
hereby'approved and the Mayor of the Village is authorized to
execute the same on behalf of the Village of Tequesta.
THE FOREGOING RESOLUTION was offered by Councilmember
, who moved its adoption. The motion
was seconded by Councilmember , and •
upon being put to a vote, the vote was as follows:

The Mayor thereupon declared the Resolution duly passed and

Dear Mr. Hall:
tl Pursuant to your request, we have made an investigation and analysis
of the proposed utility easement located on the north side of S.E.
County Line Road and S.E. Girl Scout Camp Road between S.E. Country
Club Drive and Wooden Bridge Lane, in unincorporated Martin County,
fFlorida. The purpose of this' investigation and analysis was to
EJ estimate the Market Value of the Fee Simple Estate of the part taken,
plus damages to the remainder, if any (Just Compensation due the
property owner) , as of April 14, 1992.

THIS AGREEMENT, made and entered into on this 9 day
of Ju , 1993, by and between GULF STREAM COUNCIL BOY
SCOUTS OF AMERICA, hereinafter referred to as "GRANTOR" and the
VILLAGE OF TEQUESTA, a Florida municipal corporation, hereinafter
referred to as "GRANTEE".
WITNESSETH,
For and in consideration, of mutual covenants and
conditions herein contained, GRANTOR has hereby agreed to grant and
GRANTEE hereby agrees to use a water utility easement over the
following property upon the following terms and conditions.
I. Description.
The real property more particularly set forth on the
legal description attached hereto and made a part hereof.
II. Contribution to GULF STREAM COUNCIL.
Contribution to be made by GRANTEE to
GRANTOR $1,900.00
III. Conditions and Limitations.
a. It is mutually understood that this Easement
Agreement is executed by GRANTEE subject to final acceptance by the
Village Council of the Village of Tequesta at an open public
meeting held in accordance with applicable Florida Statutes.
Notice of final acceptance shall be evidenced by the signature of
GRANTEE in Section VII herein and delivery to GRANTOR within ten
(10) days of acceptance.
b. GRANTOR is responsible for all taxes due and owing on
the property as of the date of closing. GRANTEE is not responsible
by virtue of the granting of this easement for real estate taxes on
the property.
c. GRANTOR is responsible for delivering an unencumbered
water utility easement to GRANTEE at closing.
d. Other:
IV. Closing Date.
This transaction shall be closed and the instrument of
Grant of Easement delivered within thirty (30) days of the date of
acceptance by the Village Council of the Village of Tequesta.

Typewritten or handwritten provisions inserted herein or
attached hereto as addenda, and initialed by all parties, shall
control all printed provisions in conflict therewith.
