AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEOUESTA, PALM BEACH COUNTY, FLORIDA, AMENDING ORDINANCE NO. 355, AS AMENDED, THE OFFICIAL ZONING ORDINANCE OF THE VILLAGE, SO AS TO AMEND THE ZONING CLASSIFICATION OF CERTAIN PRIVATE REAL PROPERTY DESCRIBED HEREIN FROM R-1 • TO R-2; PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH ARE HEREBY REPEALED; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. WHEREAS, the privately owned real property located at Tequesta Drive and Pine Tree Drive, more fully set out in the legal description attached hereto and• incorporated herein as Exhibit "A" is currently zoned as an R-1 ( low density singly-family 5. 4 dwelling units per acre) zoning use category; and �� WHEREAS, applicants, Andrew E. and Monica I. ��0 . : Armour have formally applied to the Village of Tequesta �� �1 for a change in the zoning use category from R-1 ( low 3 � density single-family 5. 4 dwelling units per acre) to a new zoning use category of R-2 ( medium density multiple- family, 12 dwelling units per acre) for the property referenced in paragraph 1, above. Applicants have provided the required survey, fees and have otherwise complied with the application for zoning change requirements. NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, as follows: Section _l. The Official Zoning Ordinance of the Village of Tequesta is hereby amended to change the zoning classification of the privately owned real property described in the legal description attached hereto as Exhibit "A", so as to reflect a change from R-1, ( low density single-family 5.4 dwelling units -per acre) zoning use category to a new zoning use category of R-2,(medium density multiple-family. 12 dwelling units per acre). Section 2. If any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance which can be given effect without the invalid provisions or applications, and to • this end the provisions of this Ordinance are hereby declared severable.• Section 3. . All ordinances or parts of ordinances in conflict herewith are hereby repealed or amended to be consistent with the terms of this Ordinance. Section„4, This Ordinance shall be codified and made a part of the official Code of Ordinances of the Village of Tequesta, Florida. Section. 5. This Ordinance shall take effect immediately upon its passage and approval, as provided by law. THE FOREGOING ORDINANCE was offered by Councilmember — , who moved its adoption.
