Hall, Water System Manager El DATE: April 1, 1993 SUBJECT: Ordinance for Emergency Service Bulk Water Rate As you know, Village staff, along with the Village Attorney, are working with our Jupiter counterparts in completing interlocal agreements for establishing an emergency interconnection between our utility systems. This interconnection will mutually benefit both water systems in times of emergency and disaster. Prior to construction commencement, the Village must adopt a Bulk Water Rate for the sale of water which is based upon actual costs. Village staff, along with bur attorney and consultants, have recently completed this task. Please find attached, a proposed Ordinance establishing an emergency service bulk water rate which is applicable to only public community water systems in times of emergency. Service to • any neighboring water system will be provided through interlocal agreements. This Ordinance merely establishes a rate for ' quantities sold. AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING CHAPTER 18 OF THE CODE OF ORDINANCES "WATER" AT SECTION 18-3 BY INCLUDING A NEW SUBPARAGRAPH (j) SO AS TO PROVIDE AN EMERGENCY SERVICE BULK WATER RATE FOR WATER SUPPLIED THROUGH THE EMERGENCY INTERCONNECTIONS BETWEEN THE VILLAGE OF TEQUESTA AND OTHER PUBLIC COMMUNITY WATER SYSTEMS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AS FOLLOWS: Section 1. Chapter 18 of the Code of Ordinance of the Village of Tequesta relating to "Water" is hereby amended at Section 18-3 to include a new subparagraph (j) to read as follows: "(j) There is hereby established an emergency service bulk water rate which shall be applicable to metered connections specifically identified by the Village as emergency interconnections. The emergency service bulk water rate is hereby established at $1.29 per 1,000 gallons. This rate shall be reviewed periodically and revised as necessary based upon changes in the operating, • maintenance or purchase water costs." Section 2. Severability. If any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance which can be given effect without the invalid provisions or applications, and to this end, the provisions of this Ordinance are hereby declared severable. Section 3. Repeal of Ordinances in Conflict. All other ordinances of the Village of Tequesta, Florida, or parts thereof which conflict with this or any part of this Ordinance are hereby repealed. Section 4. Codification. This Ordinance shall be codified and made a part of the official Code of Ordinances of the Village of Tequesta. Section 5. Effective Date. This Ordinance shall take effect immediately upon its passage and approval, as provided by law. • x THE FOREGOING ORDINANCE was offered by Councilmember '( , who moved its adoption.
