SUBJECT: Tequesta Branch Library Status Report; Agenda Item
Attached hereto, please find correspondence from Mayor Collings to
Commissioner Marcus in regard to the Tequesta Branch Library Site
Plan and amendments to the proposed parking lot lighting, as well
as a copy of Commissioner Karen Marcus ' response to the Mayor,
indicating a willingness of the part of Palm Beach County to amend
the parking lot lighting plan if the Village will accept all
liability associated therewith.
Staff is of the opinion that Palm Beach County staff does not
understand our suggestion. We are not suggesting that they
illuminate the parking lot at a level less than that required by
their Code. We are suggesting that they relocate lighting
standards, use different lighting standards or provide additional
lighting standards in different locations, all in an effort to
accommodate the concerns of the adjacent neighbors relative to
excessive lighting spilling over onto their property while, at the
same time, enabling the County to meet their parking lot lighting
Code.
I have asked Scott Ladd to contact Palm Beach County staff to
verbally explain our ideas . Hopefully, he will have good news at
the Village Council Meeting. If not, the Village Council should
give Village staff direction regarding the County's request that
Tequesta accept all liability associated with the parking lot.
Additionally, I have asked Mr. Ladd to update the Village Council
on the current Palm Beach County Tequesta Branch Library
Construction Schedule so we can, hopefully, see construction
activity on the near horizon.

Re: Tequesta Branch Library; Parking Lot Lighting
Dear Karen:
Attached hereto, please find a copy of a letter from the
Facilities, Planning, Design and Construction Department to
the Building Official of Tequesta in response to adjacent
residents ' concerns about parking lot lighting. The County
staff response seems, at best, unimaginative in dealing with
the remaining concern of adjacent residents .

I do not believe that the Building Official has suggested
lowering the illumination levels needed for the parking lot,
although that could be a possibility since Tequesta has not
adopted Palm Beach County's Building Security Code. I do
believe, however, that it may be possible to meet the
illumination levels desired by the County in an imaginative
way, such as using additional light sources or different light .
sources, to achieve the necessary dual goal of being a good
neighbor to the adjacent residents and meeting lighting
security concerns.
We would be most appreciative if you would look into this
matter to see if staff is capable of coming up with an
alternative other than avoiding the concern altogether. Your
time and efforts in regard to this matter will be appreciated
by all.

Dear Audrey:
Thank you for sending Carey Moulton and Lynn Thompson to the December
10, 1992 Village Council meeting. As it turned out, the review and
approval of the modifications to the proposed library site plan went
extremely well . The Village Council approved the changes as submitted
but subject to Village staff and County staff working out the
remaining concern of the adjoining residential property owners which
has to do with the proposed parking lot lighting located closest to
their homes. After the Council meeting, I met with the adjoining
property owners and it is their strong request that the three ( 3)
proposed light poles that I have highlighted on the attached sheet be
lowered in height to the lowest possible height that is feasible.

Audrey, please address this remaining concern and advise me of what
can be done to resolve this concern. If you have any questions or
need additional information, please feel free to contact me at 575-
6220.

a. Copy of a letter from Brabham, DeBay and McDonald, Inc. ,

Consulting Engineers, wherein the basis for the present design
is explained.
b. Copy of the Palm Beach County Building Security Code which
contains the requirements of Brabham, DeBay and McDonald's
design (Pages 8, .9 & 10) .
Therefore, while lowering the light poles is an option, additional
light sources would have to be added to maintain the required
levels of illumination.

Palm Beach County and the design architect agree with the
consultants position, therefore the determination has been made
that the design, as presented, will be the basis for construction.
However, we will be happy to meet with all concerned parties at
completion of construction to discuss the specifics of certain
light patterns that might be susceptible to moderation.

Dear Mayor Co in -s:
I 'd like to acknowledge and thank you for your letter of
January 7, 1993 regarding the parking lot lighting for the Tequesta
Branch Library. I apologize for the delay in responding, however,
I wanted to take the time to receive County staff's input.
As you know, our staff has several concerns with either
lowering the illumination levels or removing the light posts needed
for the parking lot. I've been informed that the consulting
engineer on the project will not make these requested modifications
unless he receives a complete waiver of responsibility from the
County with respect to any safety problems that may arise. While
I would like to cooperate with the Village on this last remaining
change request, I do not believe it to be in the best interests of
the library users. In addition to nationally recognized lighting
standards, the County's own ordinance identifies the minimum
' lighting required to provide a "safe" environment. These lighting
levels were determined through actual data in conjunction with the
Sheriff's Office. The Parking lot as designed only meets the
minimum levels contained in the ordinance.
If the Village still wants to pursue this change, the County
must request that the Village indemnify the County against any
claim that may arise. Please respond to either myself or Audrey
Wolf with the direction the Village chooses to pursue. I look
forward to hearing from you soon. l
