RE: Ordinance Including the Boundaries of Tequesta in the Palm
Beach County Fire—Rescue MSTU; Agenda Item
This Ordinance is on the Village Council Agenda to comply with your
request that the same be brought forth for your consideration.
This matter was discussed in regard to letting it be known to the
electorate that it is the intent of some Village Councilmen to
completely turn over fire-rescue services to Palm Beach County in
the event that the referendum providing for Tequesta to provide for
and manage its own fire-rescue department is unsuccessful.
Currently, Palm Beach County provides the service by way of
contract with the Village. Consequently, the cost of the county
services are in the Village General Fund Budget and Milleage Rate
of 5 .9000 . By joining the MSTU, the cost of the fire-rescue
service is removed from Tequesta's General Fund Budget, lowering
Tequesta's milleage rate and causing Tequesta residents to be
billed directly on their tax bill by Palm Beach County for this
service provided by Palm Beach County.

AN ORDINANCE OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, FLORIDA, PROVIDING FOR
THE INCLUSION OF THE TERRITORY LYING WITHIN
THE MUNICIPAL BOUNDARIES OF THE VILLAGE OF
TEQUESTA WITHIN THE PALM BEACH COUNTY
MUNICIPAL SERVICE TAXING UNIT/ PROVIDING FOR
INTENT, PURPOSE, AND EFFECT; PROVIDING FOR
SEVERAHILITY; PROVIDING FOR REPEAL OF
ORDINANCES IN CONFLICT; PROVIDING FOR
CODIFICATION; PROVIDING AN EFFECTIVE DATE.
WHEREAS, tho Florida Legislature has empowered and authorized
all counties to levy additional taxes within the limits fixed for
municipal services within municipal service taxing units for
Fire/Rescue purposes; and
WHEREAS, the Florida Legislature pursuant to Chapter 125,
Florida Statutes, has provided for the inclusion of any
municipality or portion thereof within a municipal service taxing
unit for the provision of Fire/Rescue services; and
WHEREAS, no such inclusion may be authorized unless approved
by ordinance of the governing body of the municipality; and
WHEREAS, the governing body of the Village of Tequesta desires
that all of the territory lying within the municipal limits of the
Village of Tequesta be included within the County municipal service
taxing unit providing Fire/Rescue services; and
WHEREAS, the governing body of the Village of Tequesta desires
that Palm Beach County be authorized to levy the taxes necessary to
carry out the said Fire/Rescue services.
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, FLORIDA, THAT:
Section 1. Intent, Purpose and Effect.
It is the intent, purpose and effect of this Ordinance to •
comply with the provisions of Chapter 125, Florida Statutes. All
or part of the area within the municipal boundaries of the Village
of Tequesta as set forth in Exhibit "A" attached hereto shall be
included within the County Fire/Rescue municipal service taxing
unit as shown on Exhibit "B" attached hereto for the purpose of
providing Fire/Rescue services upon the adoption of this Ordinance
and upon the adoption of an Ordinance of the Board of County
Commissioners of Palm Beech County, Florida, providing for the
inclusion of the territorial limits or part thereof of the Village
of Tequesta within County Fire/Rescue municipal service taxing unit
number for Fire/Rescue purposes.
Section 2. Severability.
If any provision of this Ordinance or the application thereof
is held invalid, such invalidity shall not affect the other
provisions or applications of this Ordinance which can be given
effect without the invalid provisions or applications, and to this
end, the provisions of this Ordinance are hereby declared
severable.
section 3. Repeal of Ordinances in Conflict.
All other ordinances of the Village of Tequesta, Florida, or
parts thereof which conflict with this or any part of this
Ordinance are hereby repealed.

Section 4. Codification.
This Ordinance shall be codified and made a part of the
official ,Code of Ordinances of the Village of Tequesta.
Section 5. Effective Date.
This Ordinance shall take effect immediately upon its passage
and approval, as provided by law.
