SUBJECT: Resolution No. 8-92/93; Supporting the Request of the
Florida Department of Natural Resources for Additional
Time and Money to Further Study the Re-establishment of
the Coastal Construction Control Line in Palm Beach
County; Agenda Item
As you may know, the State of Florida Department of Natural
Resources (DNR) has been adjusting the Coastal Construction Control
Line (CCCL) throughout the State of Florida and recently proposed
to do the same in Palm Beach County. Re-establishment of the CCCL
in Palm Beach County in many communities, including Tequesta,
relocates the CCCL significantly westward to the consternation of
many oceanfront property owners who claim that building additions
and improvements will be subjected to unnecessary bureaucratic
procedures by virtue of this change, further uping the cost of such
activities . Furthermore, some people feel that the re-
establishment of the CCCL westward, in some instances, may amount
to a taking of property rights for remaining undeveloped parcels.
In reaction to this DNR initiative, concerned citizens and
communities in Palm Beach County formed the Coastal Communities
Coalition. The Coalition was sucessful in convincing the State of
Florida that there were serious discrepancies in the Model used to
establish the Palm Beach County CCCL. Subsequently, DNR sought
approval from the Governor and Cabinet to have additional time and
funding to address the Palm Beach County Model.
It is recommended that the Village Council adopt Resolution No. 8-
92/93, which supports the DNR request for additional time and
monies to review the Model for the location of the Palm Beach
County CCCL.

RESOLUTION NO. 8 - 92/93
A RESOLUTION OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA,
SUPPORTING THE REQUEST OF THE FLORIDA DEPARTMENT
OF NATURAL RESOURCES FOR ADDITIONAL TIME AND MONEY
TO FURTHER STUDY THE RE-ESTABLISHMENT OF THE
COASTAL CONSTRUCTION CONTROL LINE IN PALM BEACH
COUNTY.
WHEREAS, the Village Council of the Village of Tequesta is
concerned about the potential negative impact of the proposed
relocation of the State's Coastal Construction Control Line
(CCCL) upon the development rights of the Village and
property owners throughout Palm Beach County; and
WHEREAS, based upon the concerns which have been raised by
the Village, Village residents and other local Agencies, the
Florida Department of Natural Resources (FDNR) has indicated
its desire to perform additional analysis and reconsider the
proposed location of the re-established CCCL; and
WHEREAS, the FDNR has requested an extension of time and an
appropriation of State funds to facilitate this additional
analysis; and
WHEREAS, the Village Council supports the FDNR's position and
believe that the extension of time and appropriation of funds
would be in the best interests. of the residents of the
Village of Tequesta, Palm Beach County, and the State of
Florida.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1. The Village of Tequesta endorses the request of
the Florida Department of Natural Resources (FDNR) for an
extension of time and an appropriation of State funds to
facilitate additional analysis and further consideration of
the proposed relocation of the Coastal Construction Control
Line (CCCL) throughout Palm Beach County.
Section 2. The Village of Tequesta requests the Florida
Legislature' to grant the FDNR's request so as to prevent
technically unsubstantiated regulation via a prematurely
relocated CCCL and the litigation which would result
therefrom.
Section 3. The Village Clerk is directed to forward a copy
of this Resolution to all members of the Palm Beach County
Legislative Delegation and to other local and State Officials
as deemed appropriate.
THE FOREGOING RESOLUTION WAS OFFERED by Councilmember
who moved its adoption. The motion was
seconded by Councilmember _ , and upon being
put to a vote, the vote was as follows:

adopted this day of April, A.D., 1993.
